2024版狗咬伤赔偿协议书2024DogBiteInjuryCompensationAgreementPartyA(VictimorLegalGuardianoftheVictim):_______________________PartyB(DogOwnerorLegalGuardianoftheDogOwner):_______________________ConsideringthatPartyAhassufferedinjuryduetoadogbiteincidentinvolvingadogownedorunderthecareofPartyB,andPartyBacknowledgestheincidentandagreestocompensatePartyAaccordingly,bothparties,basedontheprinciplesoffairness,reasonableness,andgoodfaith,havereachedthefollowingagreementoncompensationmatters:Article1:IncidentDescription1.1On_______(dateofincident),PartyAwasbittenbyadogunderthecareofPartyBatthelocationof_______.1.2TheincidentresultedininjuriestoPartyA,whichrequiredmedicaltreatment.Article2:AcknowledgmentofLiability2.1PartyBacknowledgesthatthedogunderitscarecausedtheinjurytoPartyAandassumesfullliabilityfortheincident.Article3:MedicalExpensesandTreatment3.1PartyBshallcoverallmedicalexpensesincurredbyPartyAasaresultofthedogbite,includingbutnotlimitedtocostsforemergencytreatment,hospitalization,medication,andrehabilitation.3.2PartyAshallprovidePartyBwithvalidreceiptsandmedicalrecordsasproofofexpenses.Article4:CompensationAmount4.1PartyBagreestocompensatePartyAwithalumpsumpaymentof_______(amountincurrency)forpainandsuffering,lossofincome,andotherdamagesresultingfromtheincident.Article5:PaymentTerms5.1PartyBshallmakethecompensationpaymenttoPartyAwithin_______(timeframe)afterthesigningofthisagreement.5.2Thepaymentshallbemadethrough_______(methodofpayment,e.g.,banktransfer,check,etc.).Article6:WaiverofRights6.1Uponreceiptofthecompensationpayment,PartyAwaivesanyandallrightstopursuefurtherlegalactionorclaimadditionalcompensationrelatedtothedogbiteincident.Article7:Confidentiality7.1Bothpartiesagreetokeepthecontentofthisagreementandtheincidentstrictlyconfidentialandnotdiscloseittoanythirdpartywithoutmutualconsent.Article8:BreachofAgreement8.1Intheeventofabreachofthisagreementbyeitherparty,thebreachingpartyshallbeliablefordamagesandanycostsincurredbythenon-breachingpartyasaresultofthebreach.Article9:DisputeResolution9.1Anydisputesarisingfromtheinterpretationorexecutionofthisagreementshallberesolvedthroughnegotiationbetweentheparties.Ifnegotiationfails,eitherpartymaysubmitthedisputetothecourtwithjurisdictionoverthelocationoftheincident.Article10:GoverningLaw10.1Thisagreementshallbegovernedbyandconstruedinaccordancewiththelawsofthejurisdictionwheretheincidentoccurred.Article11:EntireAgreement11.1Thisagreementconstitutestheentireagreementbetweenthepartieswithrespecttothedogbiteincidentandsupersedesallpriornegotiations,understandings,oragreements,whetherwrittenororal.Article12:Modification12.1Thisagreementmaynotbeamendedormodifiedexceptinwritingsignedbybothparties.Article13:EffectiveDate13.1Thisagreementshallbeeffectiveasofthedateofsigningbybothparties.PartyA(Signature):_______________________Name(ifPartyAisalegalguardian):_______________________Date:__________PartyB(Signature):_______________________Name(ifPartyBisalegalguardian):_______________________Date:__________[Note:Theaboveisthefirsthalfoftheagreement,andthesecondhalfwillbeprovidedinthenextquestion.]Endoftext.Article14:AdditionalCompensation14.1ShouldPartyArequireadditionalmedicaltreatmentbeyondwhathasbeeninitiallycovered,PartyBagreestoreviewandconsiderfurthercompensationonacase-by-casebasis.Article15:FutureIncidents15.1PartyBwarrantsthatitwilltakeallnecessaryprecautionstopreventanyfutureincidentsinvolvingitsdog.15.2Intheeventofanyfurtherincidentsinvolvingthesamedogcausingharmtoanyperson,thetermsofthisagreementshallbereviewed.Article16:Attachments16.1Thefollowingdocumentsareattachedtoandformpartofthisagreement:AttachmentA:MedicalrecordsandtreatmentreportsofPartyA.AttachmentB:ReceiptsofmedicalexpensesincurredbyPartyA.AttachmentC:Proofofpaymentforthecompensationamount.Article17:BreachofAgreementandDetermination17.1Abreachofthisagreementoccursif:17.1.1PartyBfailstomakethecompensationpaymentwithintheagreedtimeframe.17.1.2PartyAinitiateslegalactionormakesadditionalclaimsrelatedtotheincidentafterreceivingcompensation.17.1.3Eitherpartydisclosesthecontentofthisagreementtothirdpartieswithoutconsent.Article18:LegalTermsandDefinitions18.1Forthepurposesofthisagreement,thefollowingtermsaredefinedas:18.1.1"DogBiteIncident"referstothespecificeventonthespecifieddatewherePartyAwasbittenbythedogunderPartyB'scare.18.1.2"CompensationPayment"referstothelumpsumamountagreeduponbyPartyBtocompensatePartyAfordamagesincurred.18.1.3"MedicalExpenses"includeallcostsassociatedwiththetreatmentandrehabilitationofPartyAresultingfromtheincident.Article19:IssuesandResolutionsinExecution19.1Shouldanyissuesariseduringtheexecutionofthisagreement,thefollowingresolutionsshallapply:19.1.1Disputesovermedicalexpensesshallberesolvedbyprovidingadditionaldocumentationasrequired.19.1.2IfPartyArequiresfurthertreatment,bothpartiesshallnegotiateingoodfaithregardingadditionalcompensation.19.1.3Intheeventofabreach,thenon-breachingpartymayseeklegalremedies,includingbutnotlimitedtodamagesandinjunctiverelief.Article20:ApplicableScenarios
