2024版英伦游学夏令营服务协议书2024BritishStudyTourSummerCampServiceAgreementAgreementNo.:________________________Organizer(PartyA):_________________________Address:___________________________________LegalRepresentative:_______________________ContactNumber:_________________________ParticipantorParent/Guardian(PartyB):_________________________Address:___________________________________ContactNumber:_________________________Preamble:Thisserviceagreement("Agreement")ismadeandenteredintobyandbetweenPartyA,anorganizerspecializingineducationaltoursandsummercamps,andPartyB,aparticipantortheparent/guardianofaparticipant,forthepurposeoftheParticipantattendingtheBritishStudyTourSummerCamporganizedbyPartyA.Article1:DescriptionoftheService1.1PartyAagreestoprovidetheParticipantwithastudytoursummercampserviceintheUnitedKingdom,whichincludesbutisnotlimitedtoeducationalactivities,accommodation,meals,andtransportationasdetailedinAppendix1.Article2:DurationoftheService2.1Theserviceshallcommenceon________andconcludeon________.Article3:FeesandPaymentTerms3.1ThetotalservicefeefortheParticipant'sattendanceatthesummercampis£_______,whichincludesalltheserviceslistedinAppendix1.3.2PartyBshallpayadepositof£_______uponsigningthisAgreement,withthebalanceduenolaterthan________.Article4:Participant'sResponsibilities4.1TheParticipantshallabidebytherulesandregulationssetbyPartyAduringthesummercamp.4.2TheParticipantshallprovideallnecessarytraveldocumentsandobtainanyrequiredvisas.Article5:Organizer'sResponsibilities5.1PartyAshallensurethatallactivitiesandaccommodationsmeetthestandardsoutlinedinAppendix1.5.2PartyAshallprovidea24-houremergencycontactforthedurationofthesummercamp.Article6:Insurance6.1PartyAshallarrangeforcomprehensiveinsurancecoveragefortheParticipantduringthesummercamp,includingbutnotlimitedtotravel,medical,andpersonalaccidentinsurance.Article7:CancellationandRefundPolicy7.1IntheeventofcancellationbyPartyB,thefollowingrefundpolicyshallapply:Morethan30daysbeforethestartdate:Fullrefundminusa£_______administrationfee.Lessthan30daysbutmorethan15daysbeforethestartdate:50%refund.Lessthan15daysbeforethestartdate:Norefund.7.2PartyAreservestherighttocancelthesummercampduetounforeseencircumstances,inwhichcaseafullrefundwillbeprovided.Article8:LiabilityandIndemnification8.1PartyAshallnotbeliableforanylossordamagetotheParticipant'spropertyunlesscausedbythegrossnegligenceofPartyA.8.2TheParticipantshallindemnifyandholdharmlessPartyAfromanyclaims,damages,orlossesarisingfromtheParticipant'sactionsduringthesummercamp.Article9:DisputeResolution9.1AnydisputesarisingfromthisAgreementshallberesolvedthroughnegotiation.Ifnegotiationfails,eitherPartymaysubmitthedisputeto________forarbitration.Article10:GoverningLaw10.1ThisAgreementshallbegovernedbyandconstruedinaccordancewiththelawsof________.Article11:Amendments11.1ThisAgreementmayonlybeamendedinwritingandsignedbybothParties.Article12:EntireAgreement12.1ThisAgreementconstitutestheentireagreementbetweenthePartiesandsupersedesallpriornegotiations,understandings,andagreements.Appendix1:DetailedItineraryandServiceStandardsAppendix2:RulesandRegulationsoftheSummerCampAppendix3:InsuranceCoverageDetailsPartyA(Organizer)(Stamp):_________________________AuthorizedSignatory:___________________________Date:____________________________________PartyB(ParticipantorParent/Guardian)(Signature):_________________________Date:__________________________________--[Endofthefirsthalfofthecontract]2024BritishStudyTourSummerCampServiceAgreement(Continued)Article13:Confidentiality13.1BothPartiesagreetokeepconfidentialanypersonalinformationoftheParticipantobtainedinrelationtothisAgreement,exceptasrequiredbylaworwiththeParticipant'sconsent.Article14:ForceMajeure14.1NeitherPartyshallbeliableforfailureordelayinperformingitsobligationsunderthisAgreementtotheextentthatsuchfailureordelayiscausedbyeventsofforcemajeure.Article15:RightofSubrogation15.1PartyAshallhavetherighttosubrogateintheParticipant'splaceintheeventofaclaimundertheinsurancearrangedbyPartyA.Article16:IndependentContractors16.1ThePartiesareindependentcontractorsandnothinginthisAgreementshallbedeemedtocreateapartnership,agency,orjointventurebetweenthem.Article17:Notices17.1AllnoticesorcommunicationsrequiredorpermittedbythisAgreementshallbeinwritingandshallbedeemedgivenwhendeliveredpersonallyorsentbyregisteredmail,returnreceiptrequested,totheaddressoftherespectivePartiesassetforthaboveortosuchotheraddressaseitherPartymaydesignateinwritinginaccordancewiththisArticle.Article18:ExecutioninCounterparts18.1ThisAgreementmaybeexecutedincounterparts,eachofwhichshallbedeemedanoriginal,butallofwhichtogethershallconstituteoneandthesameinstrument.Article19:Waiver19.1ThewaiverbyeitherPartyofanybreachordefaulthereundershallnotbedeemedawaiverofanyprecedingorsubsequentbreachordefault.Article20:Termination20.1ThisAgreementmaybeterminatedbyeitherPartyuponwrittennoticetotheotherPartyintheeventofamaterialbreachbytheotherPartythatremainsuncuredforaperiodof30daysafterwrittennoticethereof.AttachmentsandSupplementaryExplanationsI.AttachmentList:Appendix1:DetailedItineraryandServiceStandards,outliningthedailyschedule,accommodationdetails,mealplans,andeducationalactivities.Appendix2:RulesandRegulationsoftheSummerCamp,includingconductexpectations,safetyguidelines,anddisciplinaryprocedures.Appendix3:InsuranceCoverageDetails,specifyingthecoverageprovided,exclusions,andproceduresforfilingclaims.Appendix4:ParticipantInformationForm,tobecompletedbyPartyBprovidingnecessarypersonalandemergencycontactdetails.Appendix5:ParentalConsentForm(ifParticipantisaminor),grantingpermissionfortheParticipant'sparticipationandacknowledgingtherisksinvolved.II.BreachofContractandDetermination:Non-paymentoffeesbytheduedateasspecifiedinArticle3.Participant'sviolationoftherulesandregulationsoutlinedinAppendix2.Organizer'sfailuretoprovidetheservicesasdescribedinAppendix1.Participant'searlywithdrawalfromthesummercampwithoutjustcause.Organizer'scancellationofthesummercampwithoutavalidreasonofforcemajeure.III.LegalTermsandDefinitions:ForceMajeure:EventsbeyondthecontrolofthePartiesthatcannotbereasonablyanticipated,avoided,orovercome.IndependentContractors:ThePartiesoperateindependentlyandarenotagents,partners,orjointventurers.Subrogation:TherightofonePartytostepintotheshoesofanotherPartytoenforcearightorclaim.BreachofContract:FailuretoperformanytermoftheAgreement,whetherconditionallyorunconditionally.IV.IssuesEncounteredDuringExecutionandSolutions:PaymentDelays:PartyBshouldcommunicatewithPartyAtonegotiatearevisedpaymentschedule.Participant'sIllnessorInjury:Immediatemed
