4.2TheThirdPartyshallnotbeliableforanyactsoromissionsoftheBabysitter,exceptincasesofnegligenceorwillfulmisconductonthepartoftheThirdParty.

5.Employer'sRightsandObligations

5.1TheEmployershallhavethefollowingrights:

(a)TorequesttheBabysittertoprovideproofofqualificationsandcriminalrecord;

(b)DiscloseanyconfidentialinformationregardingtheEmployerortheChild/Children;

(c)FailtoprovidetherequiredchildcareservicesasperthetermsofthisContract.

8.2IntheeventofabreachofthisContractbytheBabysitter,thefollowingconsequencesshallapply:

(a)ImmediateterminationofthisContract;

(b)ReimbursementofanyexpensesincurredbytheEmployerduetothebreach;

(c)LegalactionmaybetakenagainsttheBabysitter.

9.GoverningLawandDisputeResolution
