2025建筑工程施工合同（标准中英）ContractNo.:Dateofsigning:Placeofsigning:CONTRACTBETWEEN(hereinafterreferredtoas"PartyA")and(hereinafterreferredtoas"PartyB")1.GeneralProvisionsThisContractisenteredintoonthisdayof,2025,byandbetweenPartyAandPartyB,以下简称甲方and乙方respectively.ThisContractismadetoregulatetherightsandobligationsofbothpartiesintheexecutionoftheConstructionProjectdescribedherein.1.1Theconstructionproject,referredtoasthe"Project",islocatedat,withatotalareaofsquaremeters,andincludesthefollowingscopesofwork:.1.2PartyAshallprovidethenecessarysitepreparation,approvals,andresourcesrequiredforthecommencementoftheProject.PartyBshallberesponsibleforthedesign,materials,andconstructionoftheProjectinaccordancewiththeagreed-uponplansandspecifications.1.3Bothpartiesagreetocomplywithallapplicablelaws,regulations,andstandardsinthePeople'sRepublicofChina,aswellasinternationalbestpracticesinconstructionandengineering.2.ResponsibilitiesandObligations2.1ResponsibilitiesofPartyA:Provideaccurateandcompletedesigndocumentsandtechnicalspecifications.EnsureallpermitsandapprovalsrequiredfortheProjectareobtainedandmaintained.Timelyreviewandapproveallsubmissions,reports,andpaymentrequestsfromPartyB.Provideasafeandaccessiblesiteforconstructionactivities.2.2ResponsibilitiesofPartyB:Performtheconstructionworkinaccordancewiththeplans,specifications,andtimelinesagreeduponinthisContract.UsematerialsandequipmentthatmeetthequalitystandardsspecifiedintheContract.Ensurecompliancewithallapplicablesafety,health,andenvironmentalregulations.MaintainproperdocumentationoftheconstructionprocessandsubmitthesametoPartyAuponrequest.3.ScheduleofWorks3.1ThetotaldurationoftheProjectshallbecalendardays,startingfromthedateofcommencement,whichisscheduledfor,2025.3.2PartyBshallsubmitadetailedconstructionscheduletoPartyAwithindaysofthesigningofthisContract.AnydeviationfromthescheduleshallbepromptlycommunicatedtoPartyA,andadjustmentsshallbemadewithmutualagreement.3.3PartyAshallnotunreasonablydelaythecommencementoftheProject,andanydelayscausedbyPartyAshallresultinanextensionofthe工期.4.QualityStandards4.1AllworksperformedbyPartyBshallcomplywiththeChinesenationalstandardsforconstructionquality,aswellasthespecificationsoutlinedinthedesigndocuments.4.2PartyBshallusematerialsandequipmentthatareofthesamequalityasspecifiedintheContract,andensurethatsuchmaterialsaresuppliedbyreputablemanufacturers.4.3PartyAshallhavetherighttoinspectandacceptthecompletedworksatanystageofconstruction.AnydefectsfoundduringinspectionshallbepromptlyrectifiedbyPartyBatnoadditionalcost.5.CostsandPaymentTerms5.1ThetotalcontractpricefortheProjectis(RMB),whichincludesallcostsassociatedwiththedesign,materials,andconstructionoftheProject,asoutlinedintheContract.5.2PaymentshallbemadebyPartyAtoPartyBinaccordancewiththefollowingschedule:%ofthetotalcontractpriceuponcommencementoftheProject.%ofthetotalcontractpriceuponthecompletionof%oftheworks.Theremaining%shallbepaidwithindaysofthefinalacceptanceoftheProject.5.3PartyBshallprovidevalidinvoicesforallpaymentsmadeunderthisContract,andPartyAshallensuretimelypaymentaspertheagreedschedule.6.ChangesandClaims6.1AnychangestotheProjectscope,design,orscheduleshallbeagreeduponinwritingbybothparties.SuchchangesshallbedocumentedinaformalChangeOrder,whichshallbeappendedtothisContract.6.2PartyBshallnotifyPartyAofanyclaimsforadditionalcompensationorextensionsoftimewithindaysoftheoccurrenceoftheeventgivingrisetotheclaim.PartyAshallpromptlyreviewandrespondtotheclaiminaccordancewiththeagreedprocedures.6.3Allclaimsshallberesolvedthroughfriendly协商betweentheparties,andanyunresolvedclaimsshallbeaddressedthroughthedisputeresolutionproceduresoutlinedinthisContract.7.Completion,Inspection,andAcceptance7.1TheProjectshallbedeemedcompletewhenallworksarefullyexecutedinaccordancewiththeContractandtheagreed-uponstandards.PartyBshallnotifyPartyAofthecompletionoftheProjectinwriting,andafinalinspectionshallbeconductedwithindaysofsuchnotification.7.2PartyAshallhavetherighttomakereasonablerequestsforrectificationsofanydefectsfoundduringthefinalinspection.PartyBshallcompletesuchrectificationswithindaysofreceivingwrittennoticefromPartyA.7.3TheProjectshallbeacceptedascompleteandsatisfactoryonlyafteralldefectshavebeenrectifiedtothesatisfactionofPartyA.8.WarrantyandMaintenance8.1PartyBshallprovideawarrantyforthecompletedworksforaperiodofyearsfromthedateoffinalacceptance.Duringthisperiod,PartyBshallpromptlyaddressanydefectsordamagesarisingfromconstructiondefects.8.2PartyBshallalsoprovidemaintenanceservicesfortheProjectforaperiodofmonthsfollowingtheexpirationofthewarrantyperiod,atarateof%ofthetotalcontractprice.9.LiabilityandCompensation9.1BothpartiesshallbeliableforanylossesordamagescausedtotheotherpartyduetoabreachoftheContractorfailureto履行theirrespectiveobligations.9.2Intheeventofa违约,the违约ingpartyshallcompensatetheotherpartyforalldirectandindirectlossesincurredasaresultofthebreach.9.3TheliabilityofeitherpartyshallnotexceedthescopeoftheirrespectiveobligationsunderthisContract.10.DisputeResolution10.1IntheeventofanydisputesarisingoutoforinconnectionwiththisContract,thepartiesshallfirstattempttoresolvethematterthrough友好协商.10.2Ifthedisputecannotberesolvedthrough协商withindaysofitsoccurrence,themattershallbereferredtoformediation.10.3Ifthedisputeremainsunresolvedaftermediation,eitherpartymaybringthemattertotheCourtforresolution.10.4AlldisputesshallbegovernedbythelawsofthePeople'sRepublicofChina.11.MiscellaneousProvisions11.1ThisContractconstitutestheentireagreementbetweenthepartiesandsupersedesallprioragreements,understandings,orarrangements,whetheroralorwritten.11.2Anyame
