企业员工聘用合同英文版样本---EMPLOYMENTCONTRACT(ForCorporateEmployees)THISEMPLOYMENTCONTRACT(the"Contract")ismadeandenteredintoasof[Date](the"EffectiveDate")byandbetween:AndEmployee:[Employee'sFullName],holding[Nationality]nationality,withpassport/IDnumber[Passport/IDNumber]andresidentialaddressat[EmployeeAddress](hereinafterreferredtoasthe"Employee").WHEREAStheEmployerisengagedinthebusinessof[BriefDescriptionofBusiness],andisdesirousofemployingtheEmployee,andtheEmployeeiswillingtoacceptsuchemployment,uponthetermsandconditionshereinaftersetforth;1.POSITIONANDDUTIES1.1TheEmployerherebyemploystheEmployee,andtheEmployeeherebyacceptsemploymentwiththeEmployer,inthepositionof[JobTitle](the"Position").1.2TheEmployeeshallreportto[DirectSupervisor'sName/JobTitle].1.4TheEmployee'sprimaryplaceofworkshallbeat[PrimaryWorkLocation].TheEmployeemay,however,berequiredtotraveltemporarilyorrelocatepermanently,subjecttomutualagreement,forbusinesspurposesasreasonablynecessaryfortheperformanceofhis/herduties.2.2ThisContractshallbeforan[indefiniteterm/fixedtermendingon[EndDate]].Ifforafixedterm,unlessterminatedearlierinaccordancewiththeprovisionsherein,thisContractshallautomaticallyterminateon[EndDate]withoutfurthernotice.3.WORKINGHOURS3.1TheEmployee'snormalworkinghoursshallbe[Number]hoursperweek,from[StartTime]to[EndTime],Mondayto[Friday/Saturday],with[X]minutes/hour(s)forlunch/breaks,inaccordancewiththeEmployer'sworkingtimepolicyandapplicablelaborlaws.4.REMUNERATIONANDBENEFITS4.3Bonus(ifapplicable):TheEmployeeshallbeeligibletoparticipateintheEmployer'sannualbonusscheme,ifany,subjecttothetermsandconditionsofsuchscheme,theEmployee'sperformance,andtheoverallperformanceoftheEmployer.4.4Benefits:TheEmployeeshallbeentitledtothefollowingbenefitsinaccordancewiththeEmployer'spoliciesandapplicablelaws:c)Publicholidaysasprescribedbyapplicablelaw.d)[Otherbenefits,e.g.,MedicalInsurance,Retirement/PensionPlancontributions,ProfessionalDevelopmentAllowance,etc.,asapplicable].5.CONFIDENTIALITY5.1TheEmployeeacknowledgesthatduringthecourseofemployment,he/shewillhaveaccesstoconfidentialinformation,tradesecrets,andproprietarydataoftheEmployer,includingbutnotlimitedtocustomerlists,businessplans,financialinformation,technicalknow-how,andmarketingstrategies("ConfidentialInformation").5.3ThisconfidentialityobligationshallsurvivetheterminationofthisContract.6.INTELLECTUALPROPERTY6.1Allintellectualpropertyrights,includingbutnotlimitedtocopyrights,patents,trademarks,andtradesecrets,developed,created,orinventedbytheEmployeeduringthecourseofemployment,eithersolelyorjointlywithothers,andwhichrelatetotheEmployer'sbusinessorresultfromtheEmployee'sperformanceofhis/herdutieshereunder,shallbethesoleandexclusivepropertyoftheEmployer.6.2TheEmployeeagreestoexecuteanyandalldocumentsandprovideallnecessaryassistancetotheEmployertoperfect,register,andenforcesuchintellectualpropertyrights.7.TERMINATION7.1TerminationbyMutualAgreement:ThisContractmaybeterminatedatanytimebythemutualwrittenagreementofbothparties.7.2TerminationbyEmployerwithCause:TheEmployermayterminatethisContractimmediatelywithoutnoticeorpaymentinlieuofnoticeiftheEmployee:b)Engagesinmisconduct,fraud,dishonesty,orwillfuldamagetotheEmployer'sproperty;c)Isguiltyofgrossnegligenceintheperformanceofhis/herduties;e)Isconvictedofacriminaloffenseinvolvingmoralturpitude.7.3TerminationbyEmployerwithoutCause:TheEmployermayterminatethisContractwithoutcausebygivingtheEmployee[X]days'priorwrittennotice,orpaymentinlieuofsuchnotice,inaccordancewithapplicablelawandtheEmployee'slengthofservice.7.4TerminationbyEmployee:TheEmployeemayterminatethisContractbygivingtheEmployer[Y]days'priorwrittennotice(orsuchlongerperiodasmaybespecifiedintheprobationaryperiodclause,ifapplicable).8.1Foraperiodof[X]monthsfollowingtheterminationofemployment,theEmployeeagreesthathe/sheshallnot,withoutthepriorwrittenconsentoftheEmployer:b)Solicit,entice,orattempttosolicitorenticeawayanyclient,customer,supplier,orkeyemployeeoftheEmployer.9.MISCELLANEOUSPROVISIONS9.1EntireAgreement:ThisContractconstitutestheentireagreementbetweenthepartieswithrespecttothesubjectmatterhereofandsupersedesallpriordiscussions,negotiations,andagreements,whetheroralorwritten.9.2Amendment:NoamendmentormodificationtothisContractshallbeeffectiveunlessmadeinwritingandsignedbybothparties.9.4Assignment:ThisContractispersonaltotheEmployeeandshallnotbeassignablebytheEmployee.TheEmployermayassignthisContracttoanysuccessorininteresttoallorsubstantiallyallofitsbusinessorassets.9.5GoverningLaw:ThisContractshallbegovernedbyandconstruedinaccordancewiththelawsof[Jurisdiction].9.6DisputeResolution:AnydisputearisingoutoforinconnectionwiththisContractshallfirstbeattemptedtoberesolvedamicablythroughnegotiationbetweentheparties.Ifthedisputecannotberesolvedwithin[X]days,itshallbesubmittedtotheexclusivejurisdictionofthecourtsof[Jurisdiction](ortoarbitrationinaccordancewiththerulesof[ArbitrationBody],ifsoagreed).INWITNESSWHEREOF,thepartiesheretohaveexecutedthisEmploymentContractasoftheEffectiveDate._____________
