中英文版酒店西餐厅经理劳动合同LabourContractfortheManageroftheWesternRestaurantintheHotel(inChineseandEnglish)甲方(用人单位)Employer(PartyA):公司名称CompanyName:[酒店全称FullNameoftheHotel]法定代表人LegalRepresentative:[法人姓名NameoftheLegalRepresentative]地址Address:[酒店地址HotelAddress]联系电话ContactNumber:[联系电话TelephoneNumber]乙方(劳动者)Employee(PartyB):姓名Name:[乙方姓名FullNameofPartyB]性别Gender:[性别Male/Female]身份证号码IDNumber:[身份证号IDCardNumber]地址Address:[常住地址PermanentAddress]联系电话ContactNumber:[联系电话TelephoneNumber]根据《中华人民共和国劳动法》《中华人民共和国劳动合同法》及其他相关法律法规的规定,甲乙双方在平等自愿、协商一致、诚实守信的基础上,签订本劳动合同,共同遵守本合同所列条款。InaccordancewiththeLaborLawofthePeople'sRepublicofChina,theLaborContractLawofthePeople'sRepublicofChina,andotherrelevantlawsandregulations,PartyAandPartyB,onthebasisofequality,voluntariness,consensusthroughnegotiation,andgoodfaith,herebyconcludethislaborcontractandjointlyabidebythetermslistedherein.一、劳动合同期限I.TermoftheLaborContract1.本合同为固定期限劳动合同,合同期限自[起始日期StartDate]起至[结束日期EndDate]止。Thiscontractisafixed-termlaborcontract,andthetermofthecontractshallbefrom[StartDate]to[EndDate].2.试用期为[试用期时长DurationofProbationPeriod],自[试用期起始日期StartDateofProbationPeriod]起至[试用期结束日期EndDateofProbationPeriod]止。Theprobationperiodis[DurationofProbationPeriod],from[StartDateofProbationPeriod]to[EndDateofProbationPeriod].二、工作内容和工作地点II.JobContentandWorkLocation1.乙方同意根据甲方工作需要,担任酒店西餐厅经理岗位工作,负责西餐厅的全面管理工作,包括但不限于人员管理、菜品质量控制、客户服务提升、成本控制、营销策划等工作内容,确保西餐厅的高效运营和服务质量的提升。具体工作职责和工作要求以甲方制定的岗位说明书为准。PartyBagreestoassumethepositionofthemanagerofthehotel'swesternrestaurantaccordingtotheworkneedsofPartyA,andisresponsiblefortheoverallmanagementofthewesternrestaurant,includingbutnotlimitedtopersonnelmanagement,foodqualitycontrol,customerserviceimprovement,costcontrol,marketingplanning,etc.,toensuretheefficientoperationofthewesternrestaurantandtheimprovementofservicequality.ThespecificjobresponsibilitiesandrequirementsshallbesubjecttothejobdescriptionformulatedbyPartyA.2.工作地点为[酒店西餐厅地址AddressoftheWesternRestaurantintheHotel]。甲方可根据经营需要及乙方工作表现,调整乙方的工作地点,但应提前通知乙方,并与乙方协商一致。Theworklocationis[AddressoftheWesternRestaurantintheHotel].PartyAmayadjusttheworklocationofPartyBaccordingtobusinessneedsandPartyB'sworkperformance,butshallnotifyPartyBinadvanceandreachaconsensuswithPartyB.三、工作时间和休息休假III.WorkingHours,RestandLeave1.乙方实行[工时制度类型TypeofWorkingHourSystem]工时制度。PartyBshallimplementthe[TypeofWorkingHourSystem]workinghoursystem.标准工时制:乙方每日工作时间不超过8小时,平均每周工作时间不超过40小时。每周休息日为[具体休息日SpecificRestDays]。StandardWorkingHourSystem:PartyB'sdailyworkinghoursshallnotexceed8hours,andtheaverageweeklyworkinghoursshallnotexceed40hours.Theweeklyrestdaysare[SpecificRestDays].综合计算工时制:以[计算周期CalculationCycle]为周期,平均日和平均周工作时间与法定标准工作时间基本相同。ComprehensiveCalculationofWorkingHoursSystem:With[CalculationCycle]asthecycle,theaveragedailyandaverageweeklyworkinghoursarebasicallythesameasthelegalstandardworkinghours.不定时工作制:乙方的工作时间和休息休假由双方协商确定,但应保证乙方每周至少休息1日。FlexibleWorkingHourSystem:Theworkinghours,restandleaveofPartyBshallbedeterminedthroughnegotiationbetweenthetwoparties,butitshallbeensuredthatPartyBhasatleast1dayoffperweek.2.乙方依法享受国家规定的各类法定节假日、婚假、产假、丧假、带薪年休假等休息休假权利。具体休假天数和休假方式按照国家法律法规及甲方的相关规定执行。PartyBshallenjoytherightstorestandleavesuchasvariouslegalholidays,marriageleave,maternityleave,bereavementleave,andpaidannualleaveasstipulatedbythestate.Thespecificnumberofleavedaysandtheleavemethodsshallbeimplementedinaccordancewithnationallaws,regulationsandtherelevantregulationsofPartyA.3.甲方因经营需要安排乙方加班的,应按照国家有关规定支付加班工资或安排补休。乙方应在加班前填写加班申请表,经甲方批准后方可加班。未经甲方书面批准,乙方自行加班的,甲方有权不支付加班工资。IfPartyAarrangesPartyBtoworkovertimeduetobusinessneeds,itshallpayovertimepayorarrangecompensatoryleaveinaccordancewithrelevantnationalregulations.PartyBshallfillintheovertimeapplicationformbeforeworkingovertimeandcanonlyworkovertimeafterbeingapprovedbyPartyA.IfPartyBworksovertimewithoutthewrittenapprovalofPartyA,PartyAhastherightnottopayovertimepay.四、劳动报酬IV.LaborRemuneration1.乙方试用期月工资为[试用期工资金额AmountofProbationarySalary]元(大写:[大写金额WrittenAmountinWords])。试用期满后,乙方月工资为[转正后工资金额AmountofRegularSalary]元(大写:[大写金额WrittenAmountinWords]),其中基本工资为[基本工资金额AmountofBasicSalary]元,绩效工资根据乙方的工作表现和绩效考核结果发放。甲方可根据乙方的工作表现、公司经营状况及市场薪酬水平调整乙方的工资待遇,但不得低于当地最低工资标准。PartyB'smonthlysalaryduringtheprobationperiodis[AmountofProbationarySalary]yuan(inwords:[WrittenAmountinWords]).Aftertheprobationperiod,PartyB'smonthlysalaryis[AmountofRegularSalary]yuan(inwords:[WrittenAmountinWords]),includingabasicsalaryof[AmountofBasicSalary]yuan,andtheperformancesalaryshallbepaidaccordingtoPartyB'sworkperformanceandperformanceappraisalresults.PartyAmayadjustPartyB'ssalaryaccordingtoPartyB'sworkperformance,thecompany'sbusinessconditionsandthemarketsalarylevel,butshallnotbelowerthanthelocalminimumwagestandard.2.甲方每月[工资发放日期SalaryPaymentDate]前以货币形式支付乙方上月工资。如遇节假日或休息日,则提前到最近的工作日支付。PartyAshallpayPartyB'ssalaryforthepreviousmonthincurrencybefore[SalaryPaymentDate]ofeachmonth.Ifitfallsonaholidayorrestday,thepaymentshallbeadvancedtothenearestworkingday.3.乙方依法享受的津贴、补贴、奖金等福利待遇按照甲方的相关规定执行。Theallowances,subsidies,bonusesandotherwelfarebenefitsthatPartyBenjoysinaccordancewiththelawshallbeimplementedinaccordancewiththerelevantregulationsofPartyA.五、社会保险和福利待遇V.SocialInsuranceandWelfareBenefits1.甲方应按照国家和地方有关法律法规的规定,为乙方办理社会保险登记手续,按时足额缴纳各项社会保险费用,包括养老保险、医疗保险、失业保险、工伤保险和生育保险。乙方应缴纳的社会保险费由甲方从乙方工资中代扣代缴。PartyAshallgothroughtheformalitiesforsocialinsuranceregistrationforPartyBinaccordancewithrelevantnationalandlocallawsandregulations,andpayallsocialinsurancepremiumsontimeandinfull,includingendowmentinsurance,medicalinsurance,unemploymentinsurance,work-relatedinjuryinsuranceandmaternityinsurance.ThesocialinsurancepremiumsthatPartyBshouldpayshallbewithheldandpaidbyPartyAfromPartyB'ssalary.2.乙方享有甲方提供的福利待遇,包括但不限于工作餐、住宿补贴(如有)、员工培训、员工活动等。具体福利待遇按照甲方的相关规定执行。PartyBshallenjoythewelfarebenefitsprovidedbyPartyA,includingbutnotlimitedtoworkingmeals,accommodationsubsidies(ifany),employeetraining,employeeactivities,etc.ThespecificwelfarebenefitsshallbeimplementedinaccordancewiththerelevantregulationsofPartyA.六、劳动保护、劳动条件和职业危害防护VI.LaborProtection,WorkingConditionsandOccupationalHazardProtection1.甲方应按照国家和地方有关劳动保护的法律法规,为乙方提供符合国家规定的劳动安全卫生条件和必要的劳动防护用品,建立健全生产工艺流程,制定操作规程、工作规范和劳动安全卫生制度及其标准。PartyAshall,inaccordancewithrelevantnationalandlocallawsandregulationsonlaborprotection,providePartyBwithlaborsafetyandhealthconditionsmeetingnationalstandardsandnecessarylaborprotectionarticles,establishandimprovetheproductionprocess,formulateoperatingprocedures,worknorms,andlaborsafetyandhealthsystemsandtheirstandards.2.甲方应对乙方进行上岗前的职业卫生培训和在岗期间的定期职业卫生培训,普及有关职业卫生知识,督促乙方遵守国家有关职业病防治的法律、法规、规章和操作规程,指导乙方正确使用职业病防护设备和个人使用的职业病防护用品。PartyAshallconductpre-employmentoccupationalhealthtrainingandregularon-the-joboccupationalhealthtrainingforPartyB,popularizerelevantoccupationalhealthknowledge,urgePartyBtoabidebynationallaws,regulations,rulesandoperatingproceduresonthepreventionandcontrolofoccupationaldiseases,andguidePartyBtocorrectlyuseoccupationaldiseasepreventionequipmentandpersonaloccupationaldiseasepreventionarticles.3.甲方应依法对乙方进行劳动安全卫生教育,防止劳动过程中的事故,减少职业危害。乙方在劳动过程中必须严格遵守安全操作规程。乙方对甲方管理人员违章指挥、强令冒险作业,有权拒绝执行;对危害生命安全和身体健康的劳动条件,有权提出批评、检举和控告。PartyAshalllegallyconductlaborsafetyandhealtheducationforPartyBtopreventaccidentsduringthelaborprocessandreduceoccupationalhazards.PartyBmuststrictlyabidebythesafetyoperationproceduresduringthelaborprocess.PartyBhastherighttorefusetoexecutetheillegalcommandandforcedriskyoperationofPartyA'smanagementpersonnel;andhastherighttocriticize,reportandaccusethelaborconditionsthatendangerlifesafetyandphysicalhealth.七、合同的变更、解除和终止VII.Amendment,TerminationandExpirationoftheContract1.经甲乙双方协商一致,可以变更本合同的相关内容或解除本合同。变更或解除本合同的,应当采用书面形式。TherelevantcontentsofthiscontractmaybeamendedorthiscontractmaybeterminateduponconsensusthroughnegotiationbetweenPartyAandPartyB.Anyamendmentorterminationofthiscontractshallbeinwriting.2.乙方有下列情形之一的,甲方可以解除本合同:PartyAmayterminatethiscontractifPartyBisinanyofthefollowingcircumstances:在试用期内被证明不符合录用条件的;Failingtomeettheemploymentconditionsduringtheprobationperiod;严重违反甲方规章制度的;SeriouslyviolatingtherulesandregulationsofPartyA;严重失职,营私舞弊,给甲方造成重大损害的;Seriousderelictionofduty,malpracticeforpersonalgain,causingsignificantdamagetoPartyA;被依法追究刑事责任的;Beinginvestigatedforcriminalliabilityinaccordancewiththelaw;法律法规规定的其他情形。Othercircumstancesstipulatedbylawsandregulations.3.有下列情形之一的,本合同终止:Thiscontractshallbeterminatedunderanyofthefollowingcircumstances:本合同期满的;Theexpirationofthiscontract;乙方开始依法享受基本养老保险待遇的;PartyBbeginstoenjoybasicendowmentinsurancebenefitsinaccordancewiththelaw;乙方死亡,或者被人民法院宣告死亡或者宣告失踪的;ThedeathofPartyB,orPartyBisdeclareddeadormissingbythepeople'scourt;甲方被依法宣告破产的;PartyAisdeclaredbankruptinaccordancewiththelaw;甲方被吊销营业执照、责令关闭、撤销或者甲方决定提前解散的;PartyA'sbusinesslicenseisrevoked,itisorderedtoclosedown,revoked,orPartyAdecidestodissolveinadvance;法律法规规定的其他情形。Othercircumstancesstipulatedbylawsandregulations.4.本合同期满,经双方协商一致,可以续订劳动合同。Upontheexpirationofthiscontract,alaborcontractmaybereneweduponconsensusthroughnegotiationbetweenthetwoparties.八、保密和竞业限制VIII.ConfidentialityandNon-competition1.乙方对在工作过程中知悉的甲方商业秘密、技术秘密、客户信息及其他机密信息(以下统称“保密信息”)负有保密义务。未经甲方书面同意,乙方在合同期内及合同终止或解除后[竞业限制期限DurationofNon-competition]年内,不得向任何第三方披露、使用或允许第三方使用保密信息。PartyBshallbeobligatedtokeepconfidentialthebusinesssecrets,technicalsecrets,customerinformationandotherconfidentialinformationofPartyA(hereinaftercollectivelyreferredtoas"confidentialinformation")thatPartyBbecomesawareofduringthecourseofwork.WithoutthewrittenconsentofPartyA,PartyBshallnotdisclose,useorallowanythirdpartytousetheconfidentialinformationduringthetermofthecontractandwithin[DurationofNon-competition]yearsaftertheterminationordissolutionofthecontract.2.乙方在合同期内及合同终止或解除后[竞业限制期限DurationofNon-competition]年内,不得在与甲方有竞争关系的单位工作或从事与甲方业务有竞争的活动。甲方应在乙方离职后,按照国家有关规定向乙方支付竞业限制经济补偿。PartyBshallnotworkinaunitthathasacompetitiverelationshipwithPartyAorengageinactivitiesthatcompetewithPartyA'sbusinessduringthetermofthecontractandwithin[DurationofNon-competition]yearsaftertheterminationordissolutionofthecontract.PartyAshallpayeconomiccompensationfornon-competitiontoPartyBinaccordancewithrelevantnationalregulationsafterPartyBleavesthejob.3.如乙方违反保密或竞业限制约定,应向甲方支付违约金[违约金金额AmountofLiquidatedDamages]元,并赔偿甲方因此遭受的全部损失。IfPartyBviolatestheconfidentialityornon-competitionagreement,itshallpayliquidateddamagesof[AmountofLiquidatedDamages]yuantoPartyAandcompensatePartyAforalllossessufferedthereby.九、违约责任IX.LiabilityforBreachofContract1.甲乙双方任何一方违反本合同约定,给对方造成损失的,应承担赔偿责任。IfeitherPartyAorPartyBviolatesthetermsofthiscontractandcauseslossestotheotherparty,itshallbeartheliabilityforcompensation.2.甲方未按照本合同约定支付劳动报酬、缴纳社会保险费或提供劳动条件的,乙方有权解除本合同,并要求甲方支付经济补偿及赔偿金。IfPartyAfailstopaylaborremuneration,paysocialinsurancepremiumsorprovideworkingconditionsasagreedinthiscontract,PartyBhastherighttoterminatethiscontractandrequirePartyAtopayeconomiccompensationanddamages.3.乙方违反本合同约定的服务期、保密义务或竞业限制约定的,应按照约定向甲方支付违约金,并赔偿甲方因此遭受的损失。IfPartyBviolatestheserviceperiod,confidentialityobligationornon-competitionagreementasagreedinthiscontract,itshallpayliquidateddamagestoPartyAasagreedandcompensatePartyAforthelossessufferedthereby.十、争议解决X.DisputeResolution1.甲乙双方在履行本合同过程中发生的争议,由双方协商解决;协商不成的,任何一方均有权向有管辖权的劳动争议仲裁委员会申请仲裁。对仲裁裁决不服的,可以向人民法院提
