农村集体经济股份合作制改革研究-以上海市闵行区为例THE RESEARCH ON JOINT-STOCKCOOPERATIVE SYSTEM OF RURALCOLLECTIVE ECONOMYBASED ON SHANGHAI MINHAGNDISTRICT学学专作导学班校： 上海交通大学院： 国际与公共事务学院业： 公共管理（ MPA）者： 程燕玲师： 吕守军号： 1101302143级： Z1013024答辩日期： 2012 年 6 月 3 日上海交通大学 MPA 学位论文 农村集体经济股份合作制改革研究农村集体经济股份合作制改革研究-以上海市闵行区为例摘 要上世纪 80 年代以来，在广东、北京、江苏、浙江、上海等经济发达地区的农村城市化地区，一些经济基础较好的农村集体经济组织实施了股份合作制改革，对经济和社会发展起到积极作用。本文运用制度变迁、股份合作制等理论，对我国农村集体经济产权制度改革发展历程进行了总体介绍，分析了我国农村集体经济股份合作制制度安排模式、改革的演进趋势、各地改革经验对闵行区改革的借鉴作用以及股份合作制的制度缺陷。本文重点对闵行区农村集体经济股份合作制改革进行了论述，并以闵行区莘庄工业区农村集体经济股份合作制改革为实例进行个案剖析。本文介绍了闵行区改革的背景、改革的过程、改革的进展情况；分析认为改革的主要做法是因地制宜选择改革模式、有效推行民主公开、注重把握改革关键环节；从股权结构、股权流转机制、分配制度、法人治理结构四方面论述了改革后股份合作制制度安排；改革后取得了一定的成效：从产权关系来看基本实现了产权清晰、从分配机制来看建立了农民增收长效机制、从治理结构来看确立了民主管理的运行机制、从综合效益来看促进了农村集体经济持续发展、从社会治理来看促进了农村社会和谐稳定。作者认为，改革的过程中也出现了如下诸多问题，亟需进一步研I上海交通大学 MPA 学位论文 农村集体经济股份合作制改革研究究解决：第一，在政策层面存在的问题是改革后集体经济组织税收负担重、农村社区股份合作社的法律地位不明确、工商登记中存在一些制约因素、改革中存在政策障碍；第二，在操作层面存在的问题是对改革认识上存在误区、改革后组织发展定位不明确、放弃入股的村民难以再入股、改革后组织具有较强的封闭性。作为对策，作者认为：第一，在政策层面应该出台针对改革后集体经济组织的税收减免政策、明确农村股份经济合作组织的法律地位、出台工商登记相关优惠政策、加强政策研究；第二，在操作层面应该加大改革宣传力度、明确集体经济组织股份合作制改革后的发展定位、设立入股观望期、努力探索向开放式企业发展的路径。同时，应该正确处理改革后发展与分配的关系、改革后集体股、岗位股和个人股的关系、改革速度与质量的关系。另外，对如何切实做好集体土地资产处置工作、采取恰当的改革形式、理清集体资产的家底、准确界定成员资格和农龄统计、解决公开、公平、公正等问题进行了一些思考。最后，作者得出三点结论。关键词： 农村集体经济，股份合作制改革，集体资产量化II上海交通大学 MPA 学位论文 农村集体经济股份合作制改革研究THE RESEARCH ON JOINT-STOCK COOPERATIVESYSTEM OF RURAL COLLECTIVE ECONOMYBASED ON SHANGHAI MINHAGN DISTRICTABSTRACTSince 1980s, in some rural urbanization area of Guangdong, Beijing,Jiangsu, Zhejiang, Shanghai and other economically developed provinces,some rural collective economic organization with good economicfoundation implemented the reform of the stock cooperation system,which played a positive role for the economic and social development.By used institutional Change, joint-stock cooperative system theory,the article generally introduces the reform of collective economydevelopment process of our country rural property right system andanalyses of Chinas rural collective economic joint-stock cooperativesystem mode, reform and evolution trend, the experience of other areareform as reference to Minhang District and the defect of communityshare cooperation system.This paper focuses on the analysis of reform ofshare of Minhang District rural collective economy system, and makesthe reform of Xinzhuang industrial district rural collective economiccooperative shares system as an example to make a case analysis. Thispaper introduces the background, process and progress of the reform ofMinhang District; the article analyses the main way of reform is toIII上海交通大学 MPA 学位论文 农村集体经济股份合作制改革研究choose reform mode by suit measures to local conditions, push the openof effective implementation of democratic, master the key link of thereform; The article discusses the reform of joint-stock cooperative systemafter the reform of property right arrangement in four respects of theownership structure, ownership transfer mechanism, distribution system,corporate governance structure; The reform made the property rights clearin the sight of the relationship, established a long-term mechanism toincrease farmers income in the sight of allocated mechanism, establisheddemocratic management operational mechanism in the sight ofgovernance structure, promoted rural collective economy sustainabledevelopment in the sight of the comprehensive benefits, promoted socialharmony and stability in rural areas in the sight of social management.The author thinks there some problems appeared as following and needto be solved in the process of reform. first, on the policy level, theproblem is that tax burden of collective economic organizations is heavyafter the reform ,and the legal status rural community share-holdingcooperation is not clear,and there are some restricting factors In theindustrial and commercial registration,and In the process of reform, existingpolicy obstacle; second, on the operational level, the problem is theresome mistake for the understanding of reform, the organizationdevelopment orientation is not clear after the reform, the villagers whichhave given up shares have not chance to share, reform organization isstrong closure. And the development anddistribution, collective shares post shares and individual shares , speedand quality of reform should be well managed. In addition, the articleintroduces how to effectively solve the collective land asset, takeappropriate ways to reform, make it clear of collective property,accurately define membership and agricultural age statistics, solved theproblem of open, fairness and justness.
