论文摘要 论文缘起于罗伯特- 达尔关于联邦党人文集的一句评论。联邦党人文集是 现代政治学的经典名著，被誉为美国宪法的“圣经”，对美国宪法的意涵作了深度的理 论阐述。其中，共和概念是联邦党人文集的核心概念，特别是麦迪逊对“共和政体” 与“民主政体”的区分，从联邦党人整体理路来看，对他们所欲构建的复合共和制( 联 邦制) 政治理论具有基石性作用。然而，达尔在论民主一书中则认为，麦迪逊“缺 乏历史依据”地区分了民主与共和两概念，从而将民主与共和的涵义“弄糊涂”了。达 尔的质疑是否正确? 麦迪逊等联邦党人的共和概念是否真如达尔所言缺乏历史依据而 存在理论的迷误? 或者说，共和概念在麦迪逊等联邦党人的理路中自有它的特定内涵， 是政治思想史上的一种创新? 本文尝试对联邦党人文集中的共和概念进行疏理，进 而对这些问题做出回答。 论文首先追溯了与本文相关的共和思想渊源：亚里士多德、西塞罗和孟德斯鸠的共 和思想。古代经典作家亚里士多德与西塞罗对共和政体做出了最早的论述。亚氏之共和 概念有如下涵义：公共利益、混合政体、中产阶级掌权、宪政。西塞罗认为共和国是“人 民的事务”，治理形式是混合政体，其所要寻求的是“平等”、“稳定”、“和谐”和“均 衡”。他们的思想加上孟德斯鸠美德、和平、宽厚与平等的共和国理念，成为联邦党人 的共和思想基础。而美国史学家约翰帕特里克迪金斯关于联邦宪法与古典思想的关 系论述，在一定程度上总结了历史，为下文以之为参照从另一角度进一步阐述联邦共和 理念与古典共和思想的关系奠定了基础。 论文接下来重点论述了联邦党人如何通过 联邦党人文集构建了其复合共和制的 理念。在构筑共和概念时，联邦党人通过其对人性的理解，巧妙地继承并改造了古典共
