论文摘要 进行这一研究的原因主要有三点。第一，立法翻译对于不同国家和组织问的相互交 流呈现前所未有的重要作用。第二，有必要基于语料库对法律英语词汇的独特性进行研 究。第三。法律语言的研究还没有得到中国学者的足够重视。 本文的研究问题主要包括：( 1 ) 中国英语立法语料库中主题词和关键主题词的分布 如何；( 2 ) 中国立法英语语料库中词语词的特征是什么。 本研究采用的是基于语料库的方法，研究步骤如下： ( 1 ) 根据研究目的自建中国立法英语语料库( e l l c ) 并赋码，此语料库根据主 题划分为经济法、刑法、行政法、民商法、宪法、诉讼与非诉讼程序法以及社会法共七 个子类库。确定以中国英语立法语料库为观察语料库，以英国国家语料库的书面语部分 和英国国家语料库的小说部分作为两个参照语料库。 ( 2 ) 以英国国家语料库的书面语部分作为参照语料库，用语料库软件w o r d s m i t h t o o l s 得到中国立法英语语料库各子类库的主题词、关键主题词和联想词。所有功能词 手动删除，不能确定的词用专业检索工具p o w e r g r e p 在中国英语立法语料库中进行逐 一检索。然后根据主题词、关键主题词和联想词分析主题词与主题之间的关系。 ( 3 ) 本文认为词语词包括名词，词语动词，形容词和副词。我们以英国国家语料 库的小说部分作为对比语料库，用专业检索工具p o w e r g r e p 分别检索名词，词语动词， 形容词和副词在两个语料库中的绝对频数。然后，处理数据并讨论分析，以1 0 0 ，0 0 0 形符为标准得到名词，词语动词，形容词和副词在两库中的标准频数，研究中国立法英 语中词语词的总体分布特征。然后对名词，词语动词，形容词和副词的各个子类进行检 索，处理数据并讨论分析，以1 0 0 ，0 0 0 形符为标准得到名词，词语动词，形容词和副词 在两库中的标准频数，利用所得到的频数信息以及语境信息对中国立法英语名词，词语 动词，形容词和副词的各个子类的用法特征进行对比研究，同时从文体的角度分析中国 立法英语中词语词特点的形成原因。 通过研究发现： ( 1 ) 主题词和关键主题词与相应的法律主题密切相关，并构成一定的语义网络。 这些词主要用来表达法律语篇结构、权力主体、判决、惩罚、管理、法律行为、心理、 人以及各种组织等。 ( 2 ) 中国立法英语语料库和英国国家语料库子库小说部分在词语词的整体使用上 存在显著性差异。并且两库中名词与名词、词语动词与词语动词、形容词和形容词以及 副词和副词在使用上都存在差异。 ( 3 ) 在名词方面，普通名词、单数时间名词、单位词以及专有名词在两库中存在 差异，只有时间名词的复数形式在两库中不存在差异；名词化是立法文本的显著特征。 ( 4 ) 在词语动词方面，其过去分词形式和词语动词的畸形式在中国英语立法语料 库中更常使用，而在词语动词的非限定形式、基本形式以及一般过去时态的使用上，中 国英语立法语料库则不如英国国家语料库中小说部分使用普遍。大量使用被动语态这一 结构是立法语篇的特征之一，其主要原因在于立法语篇具有严格的非个人特点及它的去 语境化特性。 ( 5 ) 在形容词方面，一般性形容词在中国英语立法语料库中使用非常普遍，而一 般比较级、最高级形容词和链接动词的形容词在小说部分中较多使用；立法语篇中较多 使用正式的和长的形容词。 ( 6 ) 在副词方面，除了引导同位结构的副词和w h 开头的普通副词之外，两库中 所有其他副词的使用都存在差异；副词在中国英语立法语料库中的使用远远少于英国国 家语料库的小说部分；副词古体词的使用是法律语篇的特征之一。 本文分析了造成以上差异的原因在于中国法律英语具有自身的特征；立法语篇代表 最复杂和最深奥的文体形式，法律语篇具有规则性、严肃性、保守性、严谨性以及权威 性。 本研究的发现对法律英语教学和研究的启示在于：( 1 ) 法律翻译人员在充分理解中 国法律英语词语词的基础上能够更准确地翻译法律汉语。( 2 ) 法律词典的编纂需要语料 库提供数据上的支持。( 3 ) 法律英语语料库对法律英语教学有重要作用，如教师可以充 分利用现有法律英语语料库或自建专门法律语料库，从而发现法律英语的文体特点。 关键词：词语词，立法文本，文体，语料库 珊 a b s t r a c t t h er a t i o n a l ef o rt h ew e s e n ts t u d yi sm a n i f o l d f i r s t ，t h et r a n s l a t i o no fl e g i s l a t i v et e x t sh a sb e e n t a k i n go nu n p r e c e d e n t e dv i t a lr o l e si nt h ee x c h a n g e sb e t w e e nl e g a lf i e l d sf o rt h ep e o p l ei nd i f f e r e n t c o u n t r i e sa n do r g a n i z a t i o n s s e c o n d ，t h eu n i q u e n e s so ft h el e g a lw o r d sd e t e r m i n e st h en e c e s s i t yo ft h e s t u d yo ft h e m f i n a l l y ，t h ei m p o r t a n c ei nf o r e n s i cl i n g u i s t i c ss t u d i e sh a sn o ty e tb e e nf u l l yr e a l i z e db y c h i n e s es c h o l a r s t h em a j o rr e s e a r c hq u e s t i o n so ft h es t u d ya r e a sf o l l o w s ( 1 ) w h a ta mt h ek e yw o r d sa n dk e y k e y - w o r d si ne a c hc a t e g o r yi nt h ee n g l i s hl e g i s l a t i v et e x t sc o r p u so l c h n a ( 1 1 e r a a f t e re l t c c ) ?
