(二) 乙方不能达到所担任岗位的绩效指标或者相应的要求的; (三) 乙方在试用期内请假次数超过5天或者迟到早退超过6次的; (四) 乙方的背景调查或者在履历中发现有弄虚作假行为的; (五) 乙方顶撞上司或在工作期间发生殴斗行为的;或者其他任何主管认为乙方不能符合该职位的要求的; (六) an employer may terminate an employment contract during the probation period if (1) is proved not to satisfy the conditions for employment during the probation period; (2) materially breaches the employers rules and regulations; (3) commits serious dereliction of duty or practices graft, causing substantial damage to the employer; (4) has additionally established an employment relationship with another employer which materially affects the completion of his tasks with the first-mentioned employer, or he refuses to rectify the matter after the same is brought to his attention by the employer; (5) causes the employment contract to be invalid due to the circumstance specified in item (6) 二、工作内容job description: 第二条 乙方同意根据甲方工作需要,承担以下职责_ the employer agrees to employ mr./ms._(name) as _(job title) in _department 第三条甲方有权依据公司发展的需要对乙方的工作内容进行变更 part a may change part b s position according to the development of the company. 三、劳动报酬remuneration of labour 第四条 乙方基本工资依据职位和岗位等级标准支付,正式录用后每月基本工资为人民币 _元,试用期工资为正式录用后工资的80%;每年依据工作表现调整,但不低于国家所规定的最低工资标准。 the salary of the employee is _,and shall be monthly paid by the employer in accordance with regulation of the company. it shall be paid by legal tender and not less than the standard minimum salary in guangdong province. 第五条 甲方向乙方支付薪金的期限为次月的号前(遇节假日的,不超过假日回来后下个月最后一天)足额发放乙方上月的工资,乙方收到工资后如有异议应当在3天内提出,否则视为无异议处理the salary shall be paid before _ . if the delay or default of salary due to holiday or other special reason, the salary shall be paid not later than the end of next month。 part b should to raise an objection in three days after receiving the salary, or it means that part b agrees with that. 第六条 甲方根据公司的经营效益和乙方的个人表现和业绩发放奖金,奖金的数额没有明确的规定,完全根据甲方效益和乙方绩效来确定。 part a may pay bonus according to the performance of part b 四、劳动合同的变更、解除、终止、续订 termination, modification, renew and discharge of the contract 第八条 订立本合同所依据的客观情况发生重大变化,致使本合同无法履行的,经甲乙双方协商同意,可以变更本合同的相关内容。 due to the force majeure, the relevant clauses of the contract may be modified by the parties. 第十条 经甲乙双方协商一致,本合同可以解除。the contract can be modified or terminated by the parties through consultation; 第十一条 乙方有以下情形之一的,甲方有权解除劳动合同并无须给乙方任何经济补偿金: (一)严重违反公司员工手册、人力资源管理制度、行政管理制度、岗位职责规定、上司任务安排等一系列公司规章制 度的; (二)严重失职,营私舞弊,给甲方利益造成重大损害的; (三)被依法追究弄事责任的; (四)乙方同时在其他地方兼职或以任何形式,对甲方的工作任务造成严重影响,或者经过甲方提出后仍不改正。 (五)在试用期被证明不录用条件的;(六)乙方被发现其存在虚假欺骗行为(包括但不限于其假工作经历、假学历证、假身份证明等),使甲方违背真实意 思的情况下与乙方订立合同的; the contract may be discharged by the employer with immediate effect and the employee will not be compensated if the employee : (1 materially breaches the employers rules and regulations; (2) commits serious dereliction of duty or practices graft, causing substantial damage to the employer; (3) has additionally established an employment relationship with another employer which materially affects the completion of his tasks with the first-mentioned employer, or he refuses to rectify the matter after the same is brought to his attention by the employer (4)the employee is being charged with criminal offences: 第十二条 有下列情况之一的,甲方提前三十天以书面形式通知乙方本人或者额外支付乙方一个月工资后,可以解除劳动合同: (一) 乙方患病或者非因工负伤,在规定的医疗期满后不能从事原工作,也不能从事单位另行安排的工作的; (二) 乙方不能达到所担任岗位的绩效指标或者相应的要求的,经过培训或者调整工作岗位,仍不能达到的; (三) 劳动合同订立时所依据的客观情况发生重大变化,致使劳动合同无法履行,经甲乙双方协商,未能就变更劳动 合同内容达成协议的。 an employer may terminate an employment contract by giving the employee himself 30 days prior written notice, or one months wage in lieu of notice, if: (1) after the set period of medical care for an illness or non-work-related injury, the employee can engage neither in his original work nor in other work arranged for him by his employer;
