EMPLOYEES AND CONTRACTORS ARE ACCOUNTABLE TO 6 6 3 THE AFRICAN MINERALS CONTRACT MANAGER OR EMPLOYEE RESPONSIBLE FOR A VISITOR 6 7 PROCEDURE 6 7 1 EDUCATION 6 8 ALCOHOL AND DRUGS 7 8 1 TESTING 7 8 2 TESTING CRITERIA 7 8 3 RANDOM workforce education counselling including possible referral to Employee Assistance Programs drug and alcohol testing and The subsequent action for laboratory confirmed positive test results 2 SCOPE This Procedure applies to all employees contractors visitors attend for work in a state that does not limit their ability to meet these requirements and within the limits outlined within this Policy Advising their Supervisor before commencing work of any factor that may influence their fitness for duty Employees must ensure that their Supervisor is advised if they are taking any prescription drug or pharmaceutical product that contains a warning that o the product may cause drowsiness or o Caution should be exercised in the operation of machinery or equipment to advise their Supervisor at any time whilst performing work if they believe that they are unfit to continue for any reason To abstain from any activity or behaviour even when not on duty for African Minerals that could prove detrimental to the reputation or good standing of African Minerals 6 3 The African Minerals Contract Manager or employee responsible for a visitor Is accountable to ensure that the contractor or visitor meets the same standards that apply to African Minerals employees Where the contractors employees have had to travel to site this accountability includes ensuring that a suitable period for rest has been provided following the completion of the previous job and travel to the African Minerals site 7 PROCEDURE 7 1 Education 7 1 1 All employees will be offered information on the details of the AML Alcohol d Ongoing training of selected testers 8 ALCOHOL AND DRUGS 8 1 Testing 8 1 1 Appointments All Senior Site Officials SSO s or Manager Health Services shall appoint verbally or in writing all persons or organisations that may conduct breath and urine testing as appointed testers This consent may be verbal and does not require written consent 8 1 2 All urine drug testing will be conducted in accordance with the collection procedures stipulated in Australian Standard AS NZS 4308 2001 or similar following which screened samples will be forwarded to an AS4308 certified laboratory or other laboratory as approved by Health Services Manager 8 1 3 All employees contractors and visitors hereafter referred to as employees whilst on a African Minerals site or whilst performing works for African Minerals may be tested in accordance with this Policy Testing can include random or blanket testing at the discretion of the SSO or the Head of Safety AML or authorised representative 8 2 Testing Criteria 8 2 1 The testing is not voluntary and is a condition of employment Refusal to test will be treated as a positive result and removal from site 8 2 2 Should the alcohol or urinalysis screening tests produce a positive result the person will be transported to home camp at the African Minerals expense 8 2 3 Any person refusing to undergo testing for drugs or alcohol will be deemed unfit for work transported home prior to possible dismissal under the policy procedures 8 2 4 Any person who has returned a laboratory confirmed positive test result in the previous twenty four 24 months may be subjected to additional drug testing in addition to the random drug testing program for the following twenty four 24 months The selection of persons to undergo additional testing shall be at the discretion of African Minerals 8 2 5 Persons under medical treatment and taking prescription medication are required to notify the Approved Tester of the type of substances being taken and the duration of use A medical certificate stating that the employee is fit for work and also the dose of the prescription drug prescribed must support this All disclosures of this nature will be treated confidentially 8 3 Random the supervisor shall direct them to the approved tester for assessment A drug and alcohol test may be administered and the provisions of Section 7 1 applied Managers at their own discretion may test for drugs outside of active duty hours if the person is housed at a African Minerals facility 8 5 2 In the event that it is not possible or practical to direct such a person stipulated in 7 5 1 to an approved testing for assessment the person will be relieved of active duty and asked to remain in an area where they present no safety risk to other staff members or the public and or they shall be taken home or make arrangements for their safe transport from the workplace 8 5 3 In the event that an employee has a reasonable suspicion that another employee may not meet the Fitness for Duty drug and alcohol criteria they shall request via their supervisor for the person to undergo an assessment The supervisor shall consult with the person and direct them to the approved testing contractor to undergo an assessment A drug and alcohol test may be administered and the provisions of 7 1 applied Vexatious or malicious reporting of issues dealt with by this procedure may result in disciplinary action or dismissal SL03 AML 00 00000 SR PRO 00001 Project Plan Alcohol and Drugs Revision A Page 9 Of 15 This document is uncontrolled once printed TONKOLILI IRON ORE PROJECT 8 5 4 The Company may carry out more frequent monitoring of specific groups or individuals where the supervisor or contract manager considers it appropriate to do so 8 6 Voluntary Testing 8 6 1 Employees can voluntarily use the B A C breath testing units provided to obtain a reading of their blood alcohol concentration Each AML site must make voluntary breath testing facilities available to staff if it is practical to do so 8 6 2 An employee who tests positive as a result of a voluntary test shall not commence work until such time as they can provide a negative test 8 6 3 Persons who blow over 0 000 BAC must inform their supervisor and may not commence work until a 0 000 BAC supervised result is recorded SSO s may dictate that any positive test for alcohol requires a suspension for 24 hours to reduce any effects of fatigue usually present with alcohol use 8 6 4 When facilities are provided on an active work site Employees may present for voluntary testing prior to presenting for work If a positive test is returned over 0 000 BAC the employee shall inform his supervisor who will arrange for the employee to be transported home camp upon subsequent test above 0 000 BAC The employee must notify management of a positive self test within one hour of commencing the relevant shift management reserve the right to send an employee home for the entire day as a result of the positive result A claim for Carers Personal Leave will be accepted for this absence in accordance with the provisions of clause 8 5 1 A first breach will be recorded on their file 8 6 5 If testing is at a camp or accommodation facility prior to going to shift and a reading over 0 000 BAC is recorded then the worker will not commence work and will not have the event placed on record This is done to encourage self testing If the test is positive they must inform their supervisor within 30 minutes to be eligible for this exemption A day s sick Leave or other entitlements will be granted by their supervisor This concession is granted only if the person has not left their home camp area and has not operated any kind of vehicle If they are on site or at an active work area a breach will be recorded 8 7 Pre Employment Testing 8 7 1 The Company may require prospective employees to undertake a drug and or alcohol test as a pre requisite to establishing an employment contract with the company 8 7 2 The results of such testing may be considered amongst other criteria in determining the suitability in matching that person to the task s required in that role 8 7 3 African Minerals reserves the right to decline or terminate a prospective employee prior to commencement and or prior to the end of the probationary period on the basis of a positive test result 8 7 4 It is the policy of African Minerals to arrange a pre employment drug and alcohol test for all prospective permanent employees 8 7 5 Any perspective employee who fails the pre employment test will not be offered a position Those who fail the initial test are ably to re apply after 12 calendar months 8 8 Drug Testing Implementation 8 8 1 Drug testing under this Policy Procedure shall commence on a date and in a manner to be determined at each site It will be July 2011 unless otherwise directed SL03 AML 00 00000 SR PRO 00001 Project Plan Alcohol and Drugs Revision A Page 10 Of 15 This document is uncontrolled once printed TONKOLILI IRON ORE PROJECT 8 9 Testing Instruments 8 9 1 Alcohol 8 9 1 1 Alcohol testing will be administered by collection and analysis of a breath test utilising a calibrated breathalyser that meets the Australian Standard AS 3547 1997 Breath Alcohol Testing Devices for Personal Use and or IML International Measurement Standards 8 9 2 Drugs 8 9 2 1 Drug testing will be undertaken by the collection and analysis of a urine sample using an approved testing device and laboratory confirmation testing where required utilising the parameters stipulated in this policy and in accordance with AS NZS 4308 2001 or other standards approved by the Health Services Manager 8 9 2 2 At the discretion of African Minerals Testing shall screen for the following classes of drugs Amphetamines Benzodiazepine Opiates Cannabinoids Cocaine metabolites Table 1 NIDT Table 2 Refer AS 4308 GC MS Opiates Morphine 300 ng ml Opiates Morphine 300 ng ml Benzodiazepines 200 ng ml Benzodiazepines 200 ng ml Cannabinoids THC 50 ng ml Cannabinoids THC 15 ng ml Methylamphetamine 500 ng ml Methylamphetamine 300 ng ml Cocaine 300 ng ml Cocaine 150 ng ml 8 9 2 3 Subsequent confirmation testing on any samples that have determined presumptively positive results at the initial screening test shall be conducted at an accredited laboratory or other approved laboratory The drugs to be screened for and the drugs metabolites to be confirmed if applicable and the concentrations of the drug metabolites at or above which are considered positive for both the NIDT device and the laboratory confirmation are as follows 8 9 3 Alcohol Breath Test Over 0 000 BAC 8 9 3 1 Employees with a blood alcohol concentration more than 0 000 BAC Will be temporarily stood aside and asked to undertake a second test within 20 minutes of the first provided nothing is taken by mouth during the intervening period If the second reading is above 0 000 BAC this will be considered a breach and the employee will be managed in accordance the provisions 8 3 3 8 3 4 8 3 5 and 8 3 6 within this procedure Employees found to have an unacceptable blood alcohol level may apply for Sick Annual Leave for one day such Application for Leave will be approved in accordance with the provisions of clause 8 5 1 and the incident recorded on the personnel file SL03 AML 00 00000 SR PRO 00001 Project Plan Alcohol and Drugs Revision A Page 11 Of 15 This document is uncontrolled once printed TONKOLILI IRON ORE PROJECT Readings of 0 100 BAC or over will be treated as gross negligence and will result in instant dismissal at the discretion of the HR manager No other warnings will be required to effect dismissal 8 10 Payments 8 10 1 Employees will not be paid for the time they are stood aside however if an Application for Sick or Annual Leave is made during any such period it will be approved automatically by the area manager In the event the Employee has no leave entitlements they may elect to take leave without pay or seek approval for a debiting of entitlements not yet accrued The Company will reimburse all costs and lost entitlements only if a laboratory confirmed blood or urine test taken by the approved collector determines a blood alcohol drug concentration level below the levels stipulated in this policy that would have enabled the employee to perform his her normal work under this Policy including negative results in each of the drug classes required in this policy 8 11 Calibration of Testing Equipment 8 11 1 Equipment used for breath testing must be calibrated in accordance with the Australian Standard AS NZS 3547 or any other such relevant standard as approved by the Manager of Health Services 9 TEST RESULTS DRUG TESTING 9 1 Presumptive Positive at Initial Screening 9 1 1 Persons who have returned a presumptive positive result at initial screening shall Have their Supervisor informed that a presumptive positive result has been returned and in the case of a contractor the relevant nominated supervisor of African Minerals shall also be informed Be given transport to home camp Be advised that they should not be in charge of any motor vehicle If this advice is refused and they elect to drive African Minerals would have an obligation to report the matter to the police Be recorded on a report to the nominated relevant manager or contractor representative The employee may apply for Sick Leave or Annual Leave during the intervening period which will be approved In the event the Employee has no leave entitlements they may elect to take leave without pay or seek approval for a debiting of entitlements not yet accrued If the laboratory GCMS results confirm the positive result See section 8 3 9 2 Dispute of Laboratory Confirmed Positive On Site Urine Test 9 2 1 Laboratory confirmed Positive Urine test may not be disputed by any individual unless approved by the Manager of Human Resources should they deem there are exceptional circumstances The HR Manager shall inform the appropriate Vice President of their decision in writing 9 3 Procedure for Confirmed Positive Laboratory Test 9 3 1 African Minerals employee who have failed the initial site screening test but returned a negative laboratory result shall not have the event placed on their personnel file and any related entitlements will be re credited SL03 AML 00 00000 SR PRO 00001 Project Plan Alcohol and Drugs Revision A Page 12 Of 15 This document is uncontrolled once printed TONKOLILI IRON ORE PROJECT 9 3 2 Employees who have failed the initial site screening test and return a confirmed positive laboratory test shall have the event recorded on their personnel and be issued with a formal first warning The person shall be informed by their Departmental Manager of conditions concerning their employment and Be offered counselling and or rehabilitation through the Employee Assistance Program Be informed that they shall be included in the additional random drug testing program for the next twenty four 24 months Be informed that they are not authorised to return to work unless they supply a negative laboratory test at their cost Be informed that a further positive result in the next 24 months will result in dismissal 9 3 3 First Defaulters of the Fitness for Duty Drug and Alcohol standard shall be 9 3 3 1 Informed by their Departmental Manager of conditions concerning their employment and 9 3 3 2 Informed about the African Minerals 2 strikes disciplinary procedure should they be detected again within twenty four 24 months 9 3 3 3 Subjected to an oral and written warning placed on their file as a first warning 9 3 3 4 Offered counselling through the Employee Assistance Program at the discretion of the HR Manager 9 3 3 5 Informed that they shall be included in the additional random drug and alcohol testing program for the next twenty four 24 months 9 3 3 6 Probationary employees are excluded from the operation of this section and on first default are subject alternative disciplinary action up to and including termination of employment at the discretion of their direct manager 9 3 4 Second Defaulters of the Fitness for Duty Not within 24 months 9 3 4 1 Have an oral and written warning and a letter placed on their file as a second warning 9 3 4 2 Attend counselling through the Employee Assistance Program and If the employee is unwilling to participate in counselling and or rehabilitation program as recommended it will be considered a further breach of this policy and dealt with as a third breach 9 3 4 3 Be instructed to present to enrol in the next Fitness for Duty Drug Education Program which they shall attend 9 3 4 4 Be advised that failure to comply with the provisions of Section 8 3 4 2 and or Section 8 3 4 3 shall be consider a third and final breach of the procedure as referenced in Section 8 3 6 9 3 5 Second Defaulters of the Fitness for Duty within 24 months 9 3 5 1 Any person who returns a second positive result within twenty four 24 months of a previous positive result will have their employment terminated 9 3 6 Third Defaulters of the Fitness for Duty Career Long SL03 AML 00 00000 SR PRO 00001 Project Plan Alcohol and Drugs Revision A Page 13 Of 15 This document is uncontrolled once printed TONKOLILI IRON ORE PROJECT 9 3 6 1 Any person who returns a third positive result not subject to termination by section 8 3 5 will have their employment terminated 9 4 Procedure for Positive On Site Urine Test for Confirmed Laboratory on Site Urine Test Contractor 9 4 1 Contractor personnel who return a presumptive positive on site test shall be subjected to the provisions of Section 8 1 1 above with the following addition 9
