3、t;the PrOViSiOnSn ), Party A and Party B, having reached an agreement based On the PrinCiPIeS Of equality, WilIingneSS and mutual benefit, hereby enter into this COntraCt On matters in relation to the LeaSe Of the PrOPerty by Party A to Party B.一、出租房屋情况COnditiOn Of the LeaSe Or Pre-LeaSe PrOPerty1-

20、Of Payment:ACCOrding to the demand notes, if delaying payment, Party B ShOUId be responsible for the Penalty六、房屋使用要求和维修责任Standarel ReqUired for USe Of PrOPerty and ReSPOnSibiIity Of PrOPerty MaintenanCe and RePair6- 1租赁期间,乙方发现该房屋及其附属设施有损坏或故障时,应及时通知屮 方修复;甲方应在接到乙方通知后的日内进行维修。逾期不维修的,乙方可代为维 修,费用由甲方承担。DUr

22、 behalf and the expenses incurred ShalI be borne by Party A.6- 2租赁期间,乙方应合理使用并爱护该房屋其附属设施。因乙方使用不当或 不合理使用,致使该房屋及其附属设施损坏或发生故障的,乙方应负责维修。乙方拒 不维修,甲方可代为维修,费用由乙方承担。DUring the IeaSe term, Party B ShalI reasonably USe and take goodCare Of the PrOPerty and the facilities attached Party B ShalI be responsible to
23、 repair immediately the damages CaUSed to the PrOPerty and/Or facilities due to improper and UnreaSOnabIe USe by Party B. If Party B refuses to repair, Party A may repair On its behalf and the expenses incurred ShalI be borne by Party B.6- 3租赁期间,中方保证该房屋及其附属设施处于正常的可使用和安全的状 态。甲方对该房屋进行检查、养护,应提前日通知乙方。检查

27、nt authority by PartyA The responsibility Of the maintenance Of the added facilities by PartyB ShalI beagreed by Party A and Party B in SeParate Written agreement.七、房屋返还时的状态COnditiOn Of PrOPerty at DeIiVery BaCk7- 1除甲方同意乙方续租外,乙方应在本合同的租期届满后的日内返还该房屋, 未经屮方同意逾期返还房屋的,每逾期一日,乙方应按向中方支付该房屋占用期间的 使用费。EXCePt fo

33、赁主体变更合同并继续履行本合同。DUring the IeaSe term, Party B ShalI Obtain the Written COnSent from Party A before assigning the PrOPerty to a third Party for SUbIeaSe Or exchange the PrOPerty SUbIeaSed by a third Party After the assignment Or exchange, the assignee Of the PrOPerty Or the Party to the exchange Sha
34、lI Sign the COntraCt for the amendment Of the IeaSe and COntinUe to enforce this COntraCt8- 4在租赁期内,中方如需出售该房屋,应提前三个月通知乙方。乙方在同等 条件下有优先购买权。若乙方无意购买该物业,本租赁合同继续生效。DUring the IeaSe term, if Party A ShalI SelI the Property, it ShalI notify Party B 3 months in advance Party B ShalI have the PriOrity to PUrCh
35、aSe Under the Same COnditiOnS九、解除本合同的条件COnciitiOnS for Terminating this COntraCt9- 1甲、乙双方同意在租赁期内,有下列情形之一的,本合同终止,双方互不承 担责任:Party A and Party B have agreed that during the IeaSe term, this COntraCt ShalI be terminated Under any Of the following CirCUmStanCeS and both PartieS ShalI not be held responsi
36、ble as a result thereof:(-)该房屋占用范围内的土地使用权依法提前收回的;The right to USe Of Iand Within the SCOPe Of the PrOPerty WaS early resumedin accordance With the IaWS;(二)该房屋因社会公共利益被依法征用的;The PrOPerty WaS resumed for PUbIiC interests;(三)该房屋因城市建设需要被依法列入房屋拆迁许可范围的;The PrOPerty has been CIaSSified as PremiSeS to be dem
37、olished accordingto the IaW for the need Of town PIanning;(四)该房屋毁损、灭失或者被鉴定为危险房屋的;Damages, fire hazards OCCUrred to the PrOPerty Or OtherWiSe been CIaSSifieddangerous PremiSeS;(五)甲方已告知乙方该房屋出租前已设定抵押,现被处分的。Penalty as a result Of the mortgage Created OVer the PrOPerty as notified toParty B by Party A be
38、fore the lease;9- 2甲、乙双方同意,有下列悄形之一的,一方可书面通知另一方解除本合 同。违反合同的一方,应向另一方按月租金的2倍支付违约金;给对方造成损失的, 支付的违约金不足抵付一方损失的,还应赔偿造成的损失与违约金的差额部分:Party A and Party B have agreed that One Party may terminate this COntraCt byWritten IIOtiCe to the Other Party Under any Of the following CirCUmStanCeS The Party in breach Sha

40、房屋,经乙方催告后7日内仍未交付的;Party A fails to deliver UP the PrOPerty accordingly and remain fail to deliverWithin 7 days after demand given by Party B;(二)中方交付的该房屋不符合本合同的约定,致使不能实现租赁IJ的的;或甲 方交付的房屋存在缺陷,危及乙方安全的。The PrOPerty delivered UP by Party A falls ShOrt Of the agreementOf thisCOntract, CaUSing failure to re
41、alize the PUrPOSe Of the lease; Or the PrOPertydelivered by Party A is defective and affects the Safety Of Party B;(三)乙方未征得甲方书面同意改变房屋用途,致使房屋损坏的;Party B alters the USe Of the PrOPerty WithOUt the Written COnSent Of Party A,CaUSing damages to the PrOPerty;(四)因乙方原因造成房屋主体结构损坏的;DamageS CaUSed to the main
42、 StrUCtUre Of the PrOPerty attribUtable to Party B;(五)乙方擅自转租该房屋、转让该房屋承租权或与他人交换各自承租的房屋 的;Party B SUbIeaSeS the Property, assigns the PrOPerty to Or exchanges the PrOPertyWith the third Party WithOUt COnSent;(六)乙方逾期不支付租金累计超过壹月的;Party B fails to Pay rent for OVer 1 months;十、违约责任LiabiIitieS for BreaCh O
43、f COntraCt10- 1该房屋交付时存在缺陷的,屮方应自交付之日起的日内进行修复,逾期不 修复的,甲方同意减少租金并变更有关租金条款。FOr defects exist at the time Of delivery Of the property, Party A ShalI PerfOrm the repair WOrk Within days after the delivery, in the event Of delay and non-repair, Party A agrees to reduce the rent PayabIe and alters the releva
44、nt rental PrOViSiOnS10- 2因中方未告知乙方,该房屋出租前已抵押或产权转移已受到限制,造成乙 方损失的,甲方应负责赔偿。Party A ShalI be IiabIe to COmPenSatiOn for IOSS incurred by Party B due to Party A?S failure in notifying Party B Of the restriction Of the PrOPerty Under mortgage Or assignment Of interests before the IeaSe Of the PrOPerty10-3租
45、赁期间,屮方不及时履行本合同约定的维修、养护责任,致使房屋损坏, 造成乙方财产损失或人身伤害的,甲方应承担赔偿责任。DUring the IeaSe term, if Party A fails to PerfOrm the duties Of maintenance and repair Under this Contract, CaUSing damages Or IOSSeS to the PrOPerty and/Or PerSOnaI injuries to Party B, Party A ShalI be IiabIe to COmPenSatiOn.10-4租赁期间,非本合同规
46、定的情况,中方擅自解除本合同,提前收回该房屋 的,甲方应按月租金的2倍向乙方支付违约金。若违约金不足抵付乙方损失的,屮 方还应负责赔偿。DUring the IeaSe term, if Party A terminates this COntraCt and takes back the PrOPerty before the expiration Of the IeaSe in any eventOther than those StiPUIated in this COntraCtJ it ShalI Pay to Party B a Penalty Of 2 times Of rent
47、 PayabIe for the remaining days Of the term Party A ShalI be IiabIe for COmPenSatiOn if the PenaIty is not SUffiCient to OffSet the IOSSeS SUffered by Party B.10-5乙方未征得中方书面同意或者超出甲方书面同意的范围和要求装修房屋 或者增设附属设施的,屮方可以要求乙方恢复房屋原状(恢复房屋原状/赔偿损失)。Party B has renovated the PrOPerty Or added facilities attached to
48、the PrOPerty WithOUt Obtaining the Written COnSent Of Party A Or OUtSide the SCOPe Of the Written approval Of Party A, Party A may require Party B to restore the PrOPerty to its OriginaI State10-6租赁期间,非本合同规定的情况,乙方中途擅自退租的,乙方应按月租金 的2倍向甲方支付违约金。若违约金不足抵付甲方损失的,乙方还应负责赔偿。甲 方可从租赁保证金中抵扣。保证金不足抵扣的,不足部分则由乙方另行交付。
49、DUring the IeaSe term, except for CirCUmStanCeS StiPUIated in this COntract, if Party B WithdraWS from the IeaSe WithOUt Obtaining the approval Of Party A. Party B ShalI Paya PenaIty to Party A 2 times the rent PayabIe for the remaining days Of the term.If the PenaIty is IlOt SUffiCient to OffSet th
50、e IOSS SUffered by Party A, Party B ShalI be IiabIe to COmPenSatiOn. Party A may OffSet the amount from the deposit If thedeposit is not SUffiCient to OffSet the amount, the OUtStanding amount ShalI be Paid by Party B.十一、其他条款Other CIaUSeS11- 1租赁期间,屮方需抵押该房屋,应当书面告知乙方,并向乙方承诺房屋抵 押后当事人协议以折价、变卖方式处分该房屋前参十日
51、书面征询乙方购买该房屋的 意见。DUring the IeaSe term, if Party A ShalI require to mortgage the Property, it ShalI notify Party B in Writing and guarantee to Party B that after the mortgage Of the PrOPertyJ Party B?S OPini On as to the PUrChaSe Of the PrOPerty WOUId be COnSUIted in Writing30 days before agreement O
52、n method Of disposal Of the PrOPerty is reached11- 2本合同自双方签字/签字后即刻生效。生效后的15日内,由中方负责按 规定向房屋所在地区、县房地产交易中心或农场系统受理处办理登记备案,领取房 屋租赁登记备案证明;本合同经登记备案后,凡变更、终止本合同的,由屮方(中方/ 乙方)负责在本合同变更终止之日起的15日内,向原登记机构办理变更、终止登记 备案手续。因中方未办理房屋租赁登记备案或变更、终止登记备案的,所引起的法 律纠纷,由甲方承担一切责任。ThiS COntraCt ShalI take effect after Signed by bo
