2、ulationsofjiangsuLaborContract,employsPartyB(theemployee)asacontractemployee.Bothpartiestothiscontractsignonthebasisofequity,freewill,andmutualbenefits.第1条合同期限ContractPeriod1.1 本合同有效期自20_年月日至20年月日止(合试用期个月)oThecontractperiodofemploymentwillbevalidfrom/(D/M/Y)to/(D/M/Y)Duringwhichtheperiodofmonthswill

3、beconsideredasprobationaryemployment.1.2 在试用期内,甲方发现乙方不符合录用条件的,甲方可以即行解除本合同。PartyAhastherighttoterminatePartyBsLaborContractimmediatelywithoutnotificationifPartyBdoesnotprovetobesuitablethroughtheperiodofprobationaryemployment.第2条工作岗位、任务Positions,duties&Responsibilities2.1甲方安排乙方在部门岗位工作,位于无锡市。PartyA(th

4、eemployer)employsPartyB(theemployee)inthecapacityofinDepartment,locatedinWuxicity.2.2乙方必须按照甲方规定的岗位职责和要求全面完成指标和任务,并接受甲方对其进行的有关考核测评。PartyBisrequiredtofulfillhis/herresponsibilitiescompletelyandaccuratelyasdescribedbyPartyAandacceptperformancemeasurementhandledbyPartyA第3劳动报酬Payroll4.1试用期内该员工工资为元/月。试用期过

5、后公司实行内部薪酬管理制度,甲方依据按劳取酬准则、企业经营状况及岗位确定乙方的薪酬标准,并按有关规定支付ThesalaryoftheEmployeeisRMB$ermonthintheprobationaryperiod.Aftertheprobationaryperiod,PartyAimplementsCompanysinternalsalarysystem.PartyAwillpayPartyBmonthlysalarybasedonthefollowingconditions:theactualbusinesssituation,thelevelofPartyBspositionand

6、thegeneralprincipleofdistributionaccordingtowork”.4.2公司在实行新工资制度、调整员工工资水准或当乙方岗位职务发生变化时,甲方可根据政策给予乙方以工资待遇调整。PartyAhastherighttoadjustthesalarystandardfertyBifPartyAimplementsnewsalarysystem,ortransfersthepositionofPartyB.4.3次月3日为甲方的当月薪金发放日。SalarywillbegiventoPartyBonthe3rdofnextmonth.第4条工作条件、劳动保护LaborC

7、onditions&LaborProtection3.1甲方实行每周40小时工作制。对特殊岗位可实行不定时工作制。PartyBsnormalworkingtimewillnotexceed40hoursperweek,whereasitsflexibleforsomespecialpositionholders.3.2甲方因生产经营原因需要乙方加班时,乙方应服从。同时甲方应按规定支付乙方加班费报酬作补偿。IfitisnecessaryforPartyAtorequestPartyBtoputinovertime,PartyBmustbesubordinatedtorequestofPartyA

8、.PartyAshallprovidePartyBwitheconomiccompensationaccordingtorelevantregulations.3.3甲方为乙方提供必要的工作条件,根据国家劳动法则提供符合中国政府规定的劳动安全卫生条件和提供必要的劳动保护用品,保证乙方在人身安全及个体不受危害的环境条件下工作,对女职工及未成年工按劳动法的规定酌情予以特殊劳动保护。PartyAmustprovidePartyBwithasafeandnon-toxicworkingenvironment,necessarysafetymeasurestoguaranteesafeworkingco

9、nditionsofPartyB,accordingtoNationalSafetyandSanitationStandards.PartyAshallprovidespecialprotectionmeasuresforfemaleandunderageemployeesaccordingtotheLaborLaw.3.4甲方认为乙方的健康状况将会对工作或其他员工造成不利影响时,甲方有权按制度采取相应的措施,并有权要求乙方进行健康检查,乙方不应拒绝。IfPartyAthinksPartyBshealthinesswilleffecttotheworkorotherstaffs,PartyAw

10、illhavetheauthoritytocorrespondandwillhavetheauthoritytoaskPartyBtohaveaphysicalcheck-up,atsametimethePartyBshouldnottorefuse.3.5乙方在被聘用期间,甲方负责对乙方进行岗位职责、技能、安全规程、职业道德及相关规章制度的教育和培训,乙方须积极配合,并根据岗位职责要求努力提高自身的技能。PartyAisinchargeofvarioustrainingsuchastechnicaltraining,Positionprinciples,safetyoperations,Co

11、mpanysregulationsandprovision,etc.withintheemploymentperiod.PartyBshallacceptthetrainingwithpositiveattitudeforraisinghis/herworkefficiency.第5条社会保障和福利待遇SocialInsurance&FringeBenefits5.1在劳动合同期内甲方按照中国政府有关规定为乙方办理养老保险、医疗保险、住房公积金、失业保险等手续。PartyAshouldprovidethepension,medicalinsurance,unemploymentinsuranc

12、eandhousingfundforPartyBwithinthecontractperiodaccordingtotherelevantgovernmentlaws.5.2甲方为乙方提供因伤病、工伤、职业病及计划生育而发生医疗费用保险,并创造条件办好员工福利。PartyAshallprovidethefollowingsocialinsuranceforPartyB:diseaseandinjuryrelatedtowork,occupationaldisease,pregnancywithinfamilyplanningandhandlenecessarycollectionwelfare

13、enthusiastically.5.3乙方享有国家规定的法定节假日、婚丧、探亲、生育假以及年休假等有薪假期。PartyBhastherighttoenjoypublicholidays,marriageleave,funeralleave,home-visitleave,familyplanningleave,new-yearholiday,Companyholidays,etc.5.4乙方因工作或非因工死亡的待遇等按中国政府的法规执行。PartyBscompensationforthedeathofworkingaccidentetc.isexecutedaccordingtothepre

14、vailingrulesandregulationsenactedbythegovernment.第6条劳动纪律和奖惩办法LaborDisciplineandReward6.1乙方在合同期内必须严格遵守国家法律法规,熟知并遵守本公司员工手册和各项规章制度。PartyBmustobeyStateLawsandRegulations,thewfoeEmployeeHandbookandthebylawofcompany.6.2甲方依照本公司员工手册,对于模范遵守规章制度和为公司经营、生产和发展作出重大贡献的员工予以奖励;对于违反规章制度的乙方予以处罚。PartyAwillrewardthemode

15、lemployeeswhoperformCompanysdisciplineperfectlyandmakeabigcontributiontooperation,productionanddevelopmentofCompanysbusiness.PartyAwilldisciplinarytheemployeeswhobreachCompanysEmployeesHandbook.第7条合同变更、续订、终止和解除ContractRenewandTermination7.1合同双方在履行本合同过程中确因客观情况发生重大变化,可变更本合同的有关内容,但需双方协商并办理变更手续。BothPart

16、ieshavetherighttochangethecontractsduetonotbeestimatedexternalconditionsduringtheactualcontractprocesswithnecessarynegotiationandprocedures.7.2本合同期满即行终止,甲乙双方如需延长劳动合同期限,应在合同期满前30天,续订延长合同期手续。乙方在本企业工作满10年以上,如甲乙双方同意续延劳动合同,可以签订无固定期限的劳动合同。Theexpirationdateofsignedcontractwillbeconsideredasthenaturaltermin

17、ation.IfeitherPartyAorPartyBintendstocontinuethiscontract,suchintentshallbedeliveredtotheotherparty30dayspriortotheprocessingofcontractterminationbasedonthemutualnegotiation.PartyBhadtherighttosignlifecontractswithPartyAbasedon10yearsworkingforPartyAandpermissionofPartyA.7.3乙方达到规定的退休年龄或因病丧失劳动能力提前退休时

18、,劳动合同自然终止。TheLaborContractexpiresnaturallywhenPartyBisintheretirementageorlosesthecapabilitiesduetodisease.7.4符合下列情况之一的,甲方可以解除本合同,辞退乙方。PartyAhastherighttoterminatethecontractduetothefollowingconditions.7.4.1在试用期内,甲方认为乙方不符合录用条件PartyBdoesntprovetobesuitablethroughtheperiodofprobationaryperiod.7.4.2乙方严

19、重违反劳动纪律或甲方规章制度,以及公司员工手册规定可以辞退的;PartyBactsinanywaythatisinseriousviolationofgeneralLabordisciplineorviolationofotherregulations,orviolationofHandbook.7.4.3乙方被依法追究刑事责任或被劳动教养的;PartyBbreaksStatelaw,andhasbeensentencedtopunishmentorforcedlabor.7.4.4严重失职、营私舞弊,对甲方利益造成重大损害的。PartyBisinseriousneglectofduty,or

20、engagesingrafts.7.5有下列情况之一的,甲方可以解除劳动合同,但是应当提前30天通知乙方。PartyAhastherighttoterminatePartyBsLaborContractinanyofthefollowingsituationwithwillingtoinformPartyB30daysinadvance.7.5.1乙方不能胜任工作,经过培训或调整工作岗位后仍不能胜任工作的;PartyBisdeemedincompetentevenfollowingadditionaltrainingoradjustmentofposition.7.5.2乙方因病或非因工负伤,

21、在规定医疗期满后,不能从事原工作的,也不能从事由甲方另行安排工作的;PartyBwithdiseasesornonwork-relatedinjury,andafterthetreatmentwhichdoesnotexceedtheprescribedperiod,PartyBcannottaketheoriginalworkorotherpositionarrangedbyPartyA.7.5.3甲方宣告解散或者经营期满的;PartyAfacesterminationofthewfoecontract.7.5.4企业濒临破产处于法定整顿期或因生产经营状况发生严重困难需裁减人员时;Party

22、Aisfacingbankruptcyorreorganizedseriousdifficultiesofoperationaltoreduceemployees.7.6符合下列情况之一的,甲方不得解除劳动合同。PartyAcannotterminatePartyBslaborcontractbasedonthefollowingsituations.7.6.1乙方患病或负伤在规定医疗期内的;PartyBhascontracteddiseaseornon-workrelatedinjury,andrequiredtreatmentdoesnotexceedtheprescribedperiod

23、.7.6.2乙方因工负伤或患有职业病在疗养期间和疗养终结后,经劳动鉴定机构确认大部分或全部丧失劳动能力的;Duetoanyworkrelatedinjuryoroccupationaldisease,PartyBiseitherengagedinperiodoftreatment/recuperation,ortheemployeehascompletedsuchtreatment/recuperationandhaslostpartorallthecapacitytowork,asconfiguredbytheLaborAppraisalCommittee.7.6.3实行计划生育的女方在孕期

24、、产假期和哺乳期的(严重违纪的乙方除外);PartyBisevolvedinaperiodofpregnancywithinfamilyplanning,post-natalorbreastsfeeding(excepttheseriousviolationofCompanysprovision).7.7符合下列情况之一的,乙方可以书面通知甲方,提出解除劳动合同。PartyBhastherighttoterminatethisLaborContractinanyfollowingsituations.7.7.1在试用期内的,乙方不适应工作要求的;提前三天通知。Duringtheperiodof

25、probationaryemploy,PartyBcannotsuitandengagethisjob.(Threedaysinadvance7.7.2甲方不按照本合同规定向乙方支付劳动报酬或提供劳动条件的;PartyAcannotpaypartyBssalaryorthenecessaryprotectionfacilitiesinaccordancewithitscontract.7.7.3甲方以暴力、威胁或者非法限制人身自由的手段强迫乙方劳动的;PartyBisforcedtobeworkbyPartyAwithviolationorthreat.7.7.4乙方因就学、出国出境定居,不能

26、履行劳动合同的;提前一个月通知。PartyBgoesuniversityorabroad,cannotcarryoutlaborcontract.(Onemonthinadvance)7.7.5其他符合国家规定、可以解除劳动合同的。PartyAcannotcarryoutthiscontractwiththerequiredregulationsandlawsofGovernment.7.8乙方申请辞职并经甲方同意,劳动合同可以解除。试用期内应提前三天、试用期后应提前三十天书面通知甲方,手续齐备后方可办理解除劳动合同手续。InthecasethatPartyBintendstoterminat

27、ethislaborcontract,basedonthenegotiationandapprovalbyPartyA,PartyBshalldeliverhis/herresignationinwritingtoPartyA3dayspriorintheprobationaryperiodand30daysprioraftertheprobationaryperiodtotheprocessingofcontract,thenPartyBgothroughnecessaryformulationsoftermination.7.9终止或解除本合同后,乙方的去向问题由乙方自行解决。甲方按规定为

28、乙方办理劳动关系转移手续。PartyAmusttransferPartyBsLaborFilestotherequiredBureauaccordingtotherelevantLaws.PartyBshallsolvehis/herjobproblembyhimself/herself.第8条保密及附随义务KeepSecretandEmployeesIncumbency9.1乙方在甲方工作期间接触到的资料、图纸、信息均视为甲方企业所有的知识产权和商业秘密,未经甲方书面同意,均不得私自对外泄露。ItwillbetreatedtoPartyAspropertyrightandbusinessse

29、cretwhichPartyBgetstoinformation,drawing,communicationwithintheemploymentperiod.PartyBcouldnotleakouttheinformationwithoutPartyAsagreement.9.2保密约定:Secretagreement9.2.1公司的员工不得卷入任何与公司的商务利益有冲突的活动;PartyBshouldnotentangleanyactivitywhichconflictwithcompanysbenefit.9.2.2从事掌握公司实质性内部资料(设计与工艺、市场与销售、采购和财务等专业与

30、管理岗位;大自动焊机、自动切割机、机械设备管理维修等)岗位工作的员工必须遵守职业行为约束,在从甲方离职后二年后,不能从事本行业或与本公司利益密切关联的工作,以保证甲方的利益得到维护。PartyBwhograspsthecompanysimportantdataandinformationshouldobeytheagreementandshouldnotengageinthepositionswhichinfluencethecompanysbenefit.(Suchasdesign,technology,marketing,sales,purchasing,equipment,finance

31、,auto-weldmachineoperatorforlargepole,auto-cutmachineoperator,maintenance,etc.).Inordertovindicatecompa曲benefits,PartyBshouldnotengageinthepositionthatisassociatedwithcompOriyenefit.9.2.3公司实行工资保密制度,乙方不得打听和讨论他人的工资;PartyBshouldnotdiscusssalarywithothersaccordingtocompanyssalarysystem.9.2.4公司员工如有违反上述规定

32、的行为,按公司管理制度的相关规定处理并需承担相应的法律责任。IfPartyBdisobeyscompanyssystem,PartyBwillbepunishedandshouldassumethelegalburden.9.3双方劳动关系结束一周内,乙方应按甲方要求办妥离职手续。乙方须根据公司“移交清单”要求向公司指定人员办理工作、资料、相关物品的移交手续,“移交清单”经甲方书面确认后视为移交完毕。PartyBshouldtransactdemissionprocedureaccordingPartyAsrequirementwithinaweekafteremploymentperiod.

33、Atthesametime,PartyBwilltransactthework,information,articlesandmustbegottentheconfirmformthePartyA.9.4乙方应自觉维护甲方企业的形象和声誉,保守甲方的知识产权和商业秘密,在离开甲方公司后,不得散布对甲方不利的言论和作出对甲方不利的行为。PartyBshouldvindicatePartyAsvisualizeandreport,andshouldkeepPartyAspropertyrightandbusinesssecret.PartyBshouldnotspreadthesayinganda

34、cttheactivitythatadverseforPartyA.第se违约责任LiabilitiesResultingfromBreachofContract10.1甲乙双方必须履行劳动合同,乙方若违反本合同规定或约定,给甲方造成经济损失的,须承担经济赔偿责任。具体赔偿金额按责任、损失的大小程度和有关规定确定。PartyA&Bmustfulfillthecontract.Eachpartyisliableforlossessustainedbytheotherpartythatresultfrombreachofcontract.Specificcashamountsofrecompens

35、ewillbesetdependingonthedegreeresponsibilitiesfortheloss,onthesizeofthelossandontherelevantregulations.10.2如果乙方在本合同期内,由甲方出资培训(含境内外实习、进修)需要延长合同期限的;由甲乙双方另行签订协议。如乙方在合同期内受过甲方出资培训,因个人情况辞职或者自行离职,需按甲方规定赔偿相应的培训费用。If,withintheperiodofvalidityofthislaborcontract,PartyAprovidesPartyBwithtraining(includingovers

36、eastraining),bothsidesneedtoconsultprolongationofthiscontract.IfPartyBresigns,PartyAhastherighttoclaimtherecompenseoftraining.Specificcashamountsofrecompensewillbesetdependingonthedegreeresponsibilitiesfortheloss,andontherelevantregulations.10.3乙方因其他行为对甲方造成损失的,应当根据其造成的实际损失情况赔偿甲方相应的损失。IfPartyBwascaus

37、esdamageonPartyA.PartyBshouldpaytoPartyA.10.4上述赔偿费用甲方可以按照有关规定在支付乙方劳动报酬时,要求乙方同时支付。TheMountwhichPartyBshouldpaytoPartyAwillbedeductedinrewardofPartyB.第10条劳动争议LaborContentions11.1甲乙双方因履行本合同而发生劳动争议时,适用劳动争议程序。Ifduringthebindingperiodofthiscontract,PartyA&Bencounteradisputethatcannotberesolved,thisdisputeshouldbehandledaccordingtotheofficialproceduresofLaborContention.11.2劳动争议由双方协商解决,也可由一方或双方自劳动争议发生之日起60天内向甲方所在地劳动争议仲裁机构申请仲裁。Bothsidescansettlethedisputebilateral,orcanalsoappealtoLaborContentionforarbitrationwithin60days.第11条其他Others12.1在签署本合同书时,甲方已向乙方出示了本公司员工手册以及有关规章制度,乙方经
