1、海洋运输货物保险合同（附英文）适用各方一、责任范围本保险分为平安安险、水渍险险及一切险三三种。被保险险货物遭受损损失时，本保保险按照保险险单上订明承承保险别的条条款规定，负负赔偿责任。（一）平安险。本本保险负责赔赔偿：1、被保险货物物在运输途中中由于恶劣气气候、雷电、海海啸、地震、洪洪水自然灾害害造成整批货货物的全部损损失或推定全全损。当被保保险人要求赔赔付推定全损损时，须将受受损货物及其其权利委付给给保险公司。被被保险货物用用驳船运往或或运离海轮的的，每一驳船船所装的货物物可视作一个个整批。推定定全损是指被被保险货物的的实际全损已已经不可避免免，或者恢复复、修复受损损货物以及运运送货物到原原

2、订目的地的的费用超过该该目的地的货货物价值。2、由于运输工工具遭受搁浅浅、触礁、沉沉没、互撞、与与流冰或其他他物体碰撞以以及失火、爆爆炸意外事故故造成货物的的全部或部份份损失。3、在运输工具具已经发生搁搁浅、触礁、沉沉没、焚毁意意外事故的情情况下，货物物在此前后又又在海上遭受受恶劣气候、雷雷电、海啸等等自然灾害所所造成的部份份损失。4、在装卸或转转运时由于一一件或数件整整件货物落海海造成的全部部或部份损失失。5、被保险人对对遭受承保责责任内危险的的货物采取抢抢救、防止或或减少货损的的措施而支付付的合理费用用，但以不超超过该批被救救货物的保险险金额为限。6、运输工具遭遭遇海难后，在在避难港由于于

3、卸货所引起起的损失以及及在中途港，避避难港由于卸卸货，存仓以以及运送货物物所产生的特特别费用。7、共同海损的的牺牲、分摊摊和救助费用用。8、运输契约订订有“船舶互互撞责任”条条款，根据该该条款规定应应由货方偿还还船方的损失失。（二）水渍险。除除包括上列平平安险的各项项责任外，本本保险还负责责被保险货物物由于恶劣气气候、雷电、海海啸、地震、洪洪水自然灾害害所造成的部部份损失。（三）一切险。除除包括上列平平安险和水渍渍险的各项责责任外，本保保险还负责被被保险货物在在运输途中由由于外来原因因所致的全部部或部分损失失。二、除外责任本保险对下列损损失不负赔偿偿责任：（一）被保险人人的故意行为为或过失所造

4、造成的损失。（二）属于发货货人责任所引引起的损失。（三）在保险责责任开始前，被被保险货物已已存在的品质质不良或数量量短差所造成成的损失。（四）被保险货货物的自然损损耗、本质缺缺陷、特性以以及市价跌落落；运输迟延延所引起的损损失或费用。（五）本公司海海洋运输货物物战争险条款款和货物运输输罢工险条款款规定的责任任范围和除外外责任。三、责任起讫（一）本保险负负“仓至仓”责责任，自被保保险货物运离离保险单所载载明的起运地地仓库或储存存处所开始运运输时生效，包包括正常运输输过程中的海海上、陆上、内内河和驳船运运输在内，直直至该项货物物到达保险单单所载明目的的地收货人的的最后仓库或或储存处所或或被保险人用

5、用作分配、分分派或非正常常运输的其他他储存处所为为止。如末抵抵达上述仓库库或储存处所所，则以被保保险货物在最最后卸载港全全部卸离海轮轮后满六十天天为止。如在在上述六十天天内被保险货货物需转运到到非保险单所所载 明的目目的地时，则则以该项货物物开始转运时时终止。（二）由于被保保险人无法控控制的运输延延迟、绕道、被被迫卸货、重重行装载、转转载或承运人人运用运输契契约赋予的权权限所作的任任何航海上的的变更或终止止运输契约，致致使被保险货货物运到非保保险单所载明明目的地时，在在被保险人及及时将获知的的情况通知保保险人，并在在必要时加缴缴保险费的情情况下，本保保险仍继续有有效，保险责责任按下列规规定终止

6、。1、被保险货物物如在非保险险单所载明的的目的地出售售，保险责任任至交货时为为止，但不论论任何情况下下，均以被保保险货物在卸卸载港全部卸卸离海轮后满满六十天为止止。2、被保险货物物如在上述六六十天期限内内继续运往保保险单所载原原目的地或其其他目的地时时，保险责任任仍按上述第第（一）款的的规定终止。四、被保险人的的义务被保险人应按照照以下规定的的应尽义务办办理有关事项项，如因未履履行规定的义义务而影响保保险人利益时时，本公司对对有关损失，有有权拒绝赔偿偿。（一）当被保险险货物运抵保保险单所载明明的目的港（地地）以后，被被保险人应及及时提货，当当发现被保险险货物遭受任任何损失，应应即向保险单单上所

7、载明的的检验、理赔赔代理人申请请检验，如发发现被保险货货物整件短少少或有明显残残损痕迹应即即向承运人、受受托人或有关关当局（海关关、港务当局局等）索取货货损货差证明明。如果货损损货差是由于于承运人、受受托人或其他他有关方面的的责任所造成成，并应以书书面方式向他他们提出索赔赔，必要时还还须取得延长长时效的认证证。（二）对遭受承承保责任内危危险的货物，被被保险人和本本公司都可迅迅速采取合理理的抢救措施施，防止或威威少货物的损损失，被保险险人采取此项项措施，不应应视为放弃委委付的表示，本本公司采取此此项措施，也也不得视为接接受委付的表表示。（三）如遇航程程变更或发现现保险单所载载明的货物、船船名或航

8、程有有遗漏或错误误时，被深险险人应在获悉悉后立即通知知保险人并在在必要时加缴缴保险费，本本保险才继续续有效。（四）在向保险险人索赔时，必必须提供下列列单证：保险单正本、提提单、发票、装装箱单、磅码码单、货损货货差证明、检检验报告及索索赔清单。如如涉及第三者者责任，还须须提供向责任任方追偿的有有关函电及其其他必要单证证或文件。（五）在获悉有有关运输契约约中“船舶互互携责任”条条款的实际责责任后，应及及时通知保险险人。五、索赔期限本保险索赔时效效，认被保险险货物在最后后卸裁港全部部卸离海轮后后起算，最多多不超过二年年。附件OCEAN MMARINEE CARGGO CLAAUSES（I）Scopp
