1.IdentificationofParties(“PartiesClause”)
Everyleasemustopenwithclearidentificationofthepartiesinvolved.This看似basicstepisoftenoverlooked,yetitpreventsdisputesover“whoexactlysignedtheagreement.”
2.DescriptionoftheLeasedPremises(“PremisesClause”)
Vaguedescriptionslike“theapartmentonMainStreet”arearecipeforconflict.Theclausemustpinpointthepropertytoavoidargumentsoverwhat’sincluded.
Keyelements:Fulladdress(includingunit/flatnumber,buildingnameifapplicable);physicalboundaries(e.g.,“Unit3,123OakLane,includingtheattachedparkingspacemarked‘P3’”);squarefootageorsize(ifrelevant);andanyincludedfixtures/furnishings(listinanannexifextensive,e.g.,“kitchenappliances:refrigerator,oven;livingroom:sofa,coffeetable”).

3.TermoftheLease(“TermClause”)

6.UseofthePremises(“UseClause”)

7.MaintenanceandRepairs
Practicalnotes:Define“emergency”narrowly(e.g.,“threateninghealth/safety”)topreventtenantsfromclaiming“emergency”forminorissues.Forolderproperties,specifywhohandlespestcontrol(oftenthelandlord,unlesscausedbytenant’snegligence).
8.TerminationandExit
Aleaseshouldoutlinehowitends—whetherbyexpiry,mutualagreement,orearlytermination.
