PAGE中英文物业服务合同甲方(委托方):名称:____________________法定代表人:________________地址:____________________联系方式:________________乙方(受托方):名称:____________________法定代表人:________________地址:____________________联系方式:________________鉴于甲方需要乙方提供物业服务,乙方具备提供相关服务的能力和资质,双方经友好协商,依据《中华人民共和国民法典》及相关法律法规,就甲方委托乙方提供物业服务事宜达成如下协议:一、服务内容1.物业共用部位的维修、养护和管理,包括但不限于建筑物的基础、承重墙体、柱、梁、楼板、屋顶以及外墙、门厅、楼梯间、走廊通道等。2.物业共用设施设备的运行、维修、养护和管理,包括但不限于共用的上下水管道、落水管、水箱、加压水泵、电梯、天线、供电线路、照明、锅炉、暖气线路、燃气线路、消防设施、绿地、道路、路灯、沟渠、池、井、公益性文体设施和共用设施设备使用的房屋等。3.物业共用部位和相关场地的清洁卫生,垃圾的收集、清运及雨、污水管道的疏通。4.公共绿化的养护和管理。5.车辆停放管理。6.公共秩序维护、安全防范等事项的协助管理,包括但不限于小区门禁管理、巡逻等,但不包括甲方及业主的人身、财产保险和保管责任。7.装饰装修管理服务。8.物业档案资料管理。二、服务标准乙方应按照国家及地方相关物业服务标准以及行业通行标准,勤勉尽责地履行本合同约定的服务内容,确保服务质量达到以下标准:1.物业共用部位保持整洁,无明显损坏、污渍。2.物业共用设施设备正常运行,定期维护保养,确保安全可靠。3.环境卫生良好,垃圾日产日清,公共区域无异味。4.绿化养护及时,植物生长良好,景观美观。5.车辆停放有序,交通标识清晰。6.公共秩序维护措施得当,保障小区安全。7.装饰装修管理规范,无违规装修行为。8.物业档案资料齐全、规范,妥善保管。三、服务期限本合同服务期限自____年__月__日起至____年__月__日止。合同期满前,双方如无异议,则自动延续____年。四、费用及支付方式1.物业服务费用标准为每月每平方米人民币____元,甲方物业建筑面积共计____平方米,每月物业服务费用总额为人民币____元。2.甲方应于每月____日前向乙方支付当月物业服务费用。3.物业服务费用包含但不限于人员工资、办公费用、设备维护费用、绿化养护费用、清洁卫生费用等乙方为履行本合同约定服务内容所需的一切费用。4.如甲方物业面积发生变化,物业服务费用应相应调整,调整方式为:物业服务费用调整金额=调整后的物业面积×原物业服务费用标准原物业面积×原物业服务费用标准。五、双方权利义务(一)甲方权利义务1.有权监督乙方的物业服务质量,提出意见和建议。2.按照本合同约定按时足额支付物业服务费用。3.协助乙方开展物业服务工作,提供必要的便利条件。4.不得干涉乙方依法依规进行的正常物业服务活动。5.向乙方提供物业的相关资料,包括但不限于产权资料、规划设计资料、竣工验收资料等。6.配合乙方做好物业区域内的安全防范、环境卫生等工作,教育业主遵守物业管理规定。(二)乙方权利义务1.按照本合同约定的服务内容、标准和期限,提供优质、高效的物业服务。2.有权要求甲方按照合同约定支付物业服务费用。3.对物业区域内违反法律法规、管理规约的行为进行制止,并及时向有关部门报告。4.定期公布物业服务费用收支情况,接受甲方监督。5.妥善保管物业档案资料,不得泄露甲方及业主的隐私信息。6.合理使用物业共用部位、共用设施设备,不得擅自改变用途或进行有损甲方及业主利益的行为。7.加强对物业服务人员的管理和培训,提高服务水平。8.因乙方原因造成甲方或业主损失的,应承担相应的赔偿责任。六、违约责任1.若甲方未按照本合同约定按时足额支付物业服务费用,每逾期一日,应按照未支付金额的____%向乙方支付违约金。逾期超过____日的,乙方有权暂停物业服务,由此造成的一切后果由甲方承担。2.若乙方未按照本合同约定的服务内容、标准提供物业服务,甲方有权要求乙方限期整改。乙方逾期未整改或整改后仍不符合要求的,甲方有权扣除相应的物业服务费用,并要求乙方按照当月物业服务费用总额的____%向甲方支付违约金。如因乙方服务质量问题给甲方或业主造成损失的,乙方应承担全部赔偿责任。3.任何一方违反本合同约定的保密义务,应向对方支付人民币____元的违约金,并赔偿对方因此遭受的全部损失。4.如因不可抗力等不可预见、不可避免、不可克服的因素导致一方无法履行本合同约定的义务,该方不承担违约责任,但应及时通知对方并提供相关证明。七、合同变更与解除1.经双方协商一致,可以书面形式变更或解除本合同。2.若一方严重违反本合同约定,另一方有权解除本合同,并要求违约方承担违约责任。3.因不可抗力等原因导致本合同无法继续履行的,双方可协商解除合同,互不承担违约责任。八、争议解决本合同在履行过程中如发生争议,双方应首先友好协商解决;协商不成的,任何一方均有权向有管辖权的人民法院提起诉讼。九、其他条款1.本合同未尽事宜,双方可另行协商并签订补充协议,补充协议与本合同具有同等法律效力。2.本合同一式两份,甲乙双方各执一份,自双方签字(或盖章)之日起生效。甲方(盖章):____________________法定代表人(签字):________________签订日期:____年__月__日乙方(盖章):____________________法定代表人(签字):________________签订日期:____年__月__日中英文物业服务合同PartyA(theEntrustingParty):Name:____________________LegalRepresentative:________________Address:____________________ContactInformation:________________PartyB(theEntrustedParty):Name:____________________LegalRepresentative:________________Address:____________________ContactInformation:________________WhereasPartyArequiresPartyBtoprovidepropertymanagementservices,andPartyBhastheabilityandqualificationstoproviderelevantservices.Throughfriendlynegotiationbetweenthetwoparties,inaccordancewiththe"CivilCodeofthePeople'sRepublicofChina"andrelevantlawsandregulations,thefollowingagreementisreachedonPartyA'sentrustmentofPartyBtoprovidepropertymanagementservices:I.ServiceContent1.Maintenance,repairandmanagementofthecommonpartsoftheproperty,includingbutnotlimitedtothefoundation,loadbearingwalls,columns,beams,floors,roofsofthebuilding,aswellasexteriorwalls,foyers,stairwells,corridors,etc.2.Operation,maintenance,repairandmanagementofthecommonfacilitiesandequipmentoftheproperty,includingbutnotlimitedtothecommonwatersupplyanddrainagepipes,downspouts,watertanks,pressurizedwaterpumps,elevators,antennas,powersupplylines,lighting,boilers,heatinglines,gaslines,fireprotectionfacilities,greenspaces,roads,streetlights,ditches,pools,wells,publicculturalandsportsfacilitiesandthehousesusedbythecommonfacilitiesandequipment.3.Cleaningandsanitationofthecommonpartsofthepropertyandrelatedsites,collection,transportationofgarbage,anddredgingofrainandsewagepipes.4.Maintenanceandmanagementofpublicgreenery.5.Vehicleparkingmanagement.6.Assistanceinthemanagementofpublicordermaintenance,securitypreventionandothermatters,includingbutnotlimitedtoaccesscontrolmanagementandpatrolinthecommunity,butnotincludingthepersonalandpropertyinsuranceandcustodyresponsibilitiesofPartyAandtheowners.7.Decorationandrenovationmanagementservices.8.Managementofpropertyfilematerials.II.ServiceStandardsPartyBshallperformtheservicecontentstipulatedinthiscontractinaccordancewiththerelevantnationalandlocalpropertyservicestandardsandindustrygeneralstandards,anddiligentlyfulfillitsdutiestoensurethattheservicequalitymeetsthefollowingstandards:1.Thecommonpartsofthepropertyarekeptclean,withoutobviousdamageorstains.2.Thecommonfacilitiesandequipmentofthepropertyoperatenormally,areregularlymaintainedandrepaired,andareensuredtobesafeandreliable.3.Theenvironmentalsanitationisgood,thegarbageisremoveddaily,andthereisnopeculiarsmellinthepublicarea.4.Thegreeneryismaintainedinatimelymanner,theplantsgrowwell,andthelandscapeisbeautiful.5.Thevehicleparkingisinanorderlymanner,andthetrafficsignsareclear.6.Thepublicordermaintenancemeasuresareappropriatetoensurethesafetyofthecommunity.7.Thedecorationandrenovationmanagementisstandardized,andtherearenoillegaldecorationbehaviors.8.Thepropertyfilematerialsarecomplete,standardized,andproperlykept.III.ServiceTermTheservicetermofthiscontractshallbefrom[startdate]to[enddate].Beforetheexpirationofthecontract,ifbothpartieshavenoobjections,itshallbeautomaticallyextendedfor[extendedperiod]years.IV.FeesandPaymentMethods1.Thepropertyservicefeestandardis[X]yuanpersquaremeterpermonth.ThetotalbuildingareaofPartyA'spropertyis[area]squaremeters,andthetotalpropertyservicefeepermonthis[totalamount]yuan.2.PartyAshallpaythepropertyservicefeeforthecurrentmonthtoPartyBbeforethe[paymentduedate]ofeachmonth.3.Thepropertyservicefeeincludesbutnotlimitedtopersonnelsalaries,officeexpenses,equipmentmaintenanceexpenses,greenerymaintenanceexpenses,cleaningandsanitationexpenses,etc.,allexpensesrequiredforPartyBtoperformtheservicecontentstipulatedinthiscontract.4.IfthepropertyareaofPartyAchanges,thepropertyservicefeeshallbeadjustedaccordingly.Theadjustmentmethodis:Adjustedpropertyservicefeeamount=Adjustedpropertyarea×OriginalpropertyservicefeestandardOriginalpropertyarea×Originalpropertyservicefeestandard.V.RightsandObligationsofBothParties(I)RightsandObligationsofPartyA1.HastherighttosupervisethepropertyservicequalityofPartyBandputforwardopinionsandsuggestions.2.Paysthepropertyservicefeeinfullandontimeinaccordancewiththeprovisionsofthiscontract.3.AssistsPartyBincarryingoutpropertymanagementservicesandprovidesnecessaryconveniences.4.ShallnotinterferewiththenormalpropertymanagementactivitiescarriedoutbyPartyBinaccordancewithlawsandregulations.5.ProvidesPartyBwithrelevantmaterialsoftheproperty,includingbutnotlimitedtopropertyrightmaterials,planninganddesignmaterials,completionacceptancematerials,etc.6.CooperateswithPartyBtodoagoodjobinsafetyprevention,environmentalsanitation,hepropertyarea,andeducatestheownerstoabidebythepropertymanagementregulations.(II)RightsandObligationsofPartyB1.Provideshighqualityandefficientpropertymanagementservicesinaccordancewiththeservicecontent,standardsandtermstipulatedinthiscontract.2.HastherighttorequirePartyAtopaythepropertyservicefeeinaccordancewiththecontract.3.Restrainstheactsthatviolatelaws,regulationsandmanagementagreementsinthepropertyareaandpromptlyreportsthemtotherelevantdepartments.4.RegularlyannouncestheincomeandexpendituresituationofthepropertyservicefeeandacceptsthesupervisionofPartyA.5.ProperlykeepsthepropertyfilematerialsandshallnotdisclosetheprivacyinformationofPartyAandtheowners.6.Reasonablyusesthecommonpartsandcommonfacilitiesandequipmentoftheproperty,andshallnotchangetheusewithoutauthorizationorconductanyactsthataredetrimentaltotheinterestsofPartyAandtheowners.7.Strengthensthemanagementandtrainingofpropertyservicepersonneltoimprovetheservicelevel.8.IfPartyBcauseslossestoPartyAortheownersduetoitsreasons,itshallbearthecorrespondingcompensationliability.VI.LiabilityforBreachofContract1.IfPartyAfailstopaythepropertyservicefeeinfullandontimeinaccordancewiththeprovisionsofthiscontract,foreachoverdueday,itshallpayaliquidateddamagesof[X]%oftheunpaidamounttoPartyB.Iftheoverdueperiodexceeds[numberofdays],PartyBhastherighttosuspendthepropertymanagementservice,andallconsequencescausedtherebyshallbebornebyPartyA.2.IfPartyBfailstoprovidepropertymanagementservicesinaccordancewiththeservicecontentandstandardsstipulatedinthiscontract,PartyAhastherighttorequirePartyBtorectifywithinatimelimit.IfPartyBfailstorectifywithinthetimelimitorstilldoesnotmeettherequirementsafterrectification,PartyAhastherighttodeductthecorrespondingpropertyservicefeeandrequirePartyBtopayaliquidateddamagesof[X]%ofthetotalpropertyservicefeeforthecurrentmonthtoPartyA.IfPartyB'sservicequalityproblemscauselossestoPartyAortheowners,PartyBshallbearallthecompensationresponsibilities.3.Ifeitherpartyviolatestheconfidentialityobligationstipulatedinthiscontract,itshallpayaliquidateddamagesof[amount]yuantotheotherpartyandcompensateallthelossessufferedbytheotherparty.4.Ifapartyisunabletoperformtheobligationsstipulatedinthiscontractduetoforcemajeureandotherunforeseeable,unavoidableandinsurmountablefactors,thatpartyshallnotbeartheliabilityforbreachofcontract,butshallpromptlynotifytheotherpartyandproviderelevantcertificates.VII.ContractAlterationandTermination1.Withtheconsensusofbothpartiesthroughnegotiation,thiscontractcanbealteredorterminatedinwriting.2.Ifonepartyseriouslyviolat
