PROMOTINGADVANCEDARTIFICIAL

INTELLIGENCEINNOVATIONANDSECURITY

BytheauthorityvestedinmeasPresidentbytheConstitutionandthelawsoftheUnitedStatesofAmerica,itisherebyordered:

Section1.Purpose.

TheUnitedStatescontinuestoleadtheworldinArtificialIntelligence(AI)becauseoftheenormoustalentandinnovationofourAIindustry,andbecausewerefusetostiflethisinnovationwithoverlyburdensomeregulation.MyAdministrationhasunleashedtremendoustechnologicalgrowthandeconomicinvestmentinAIbyslashingthebureaucraticconstraintsthattheprioradministrationplacedonAmerica’sAIdevelopersandresearchers,andbyinsteadencouragingAIinnovationandacceleratingresponsibleAIadoptionacrossgovernmentandindustry.

AdvancedAIcapabilitiesmakeourNationstronger,butalsointroducenewnationalsecurityconsiderationsthatrequirecoordinatedactionacrossexecutivedepartmentsandagencies(agencies),andcomponents.Asthesecapabilitiesevolve,myAdministrationwillcontinuetoworkcloselywithindustrytoensurethatthebestandmostsecuretechnologyisdeployedrapidlytoconfrontanyandallthreatstoourcountry.WewillcontinuetoleadanAmericaFirstcybersecurityeffortthat

enhancesbothournationalsecurityandourglobalAIdominance.

ItisthepolicyoftheUnitedStatestopromoteAIinnovationandsecuritybyworkingcollaborativelywiththeprivatesectortomodernizegovernmentandprivatesectorinformationsystemsandhardenthemagainstexternalthreats;toprotectAmericaningenuityandintellectualpropertyfromexploitationandtheftbyadversaries;andtocultivateAmerica’sadvancedAI-enabledcapabilities.

Sec.2.UpgradingAmericanSystemsforAdvancedAI.

(a)Within30daysofthedateofthisorder,theCommitteeonNationalSecuritySystemsshallprioritizethecyberdefenseofNationalSecuritySystems,asdefinedin44U.S.C.3552(b)(6)(A),bytakingappropriateandexpeditiousactionconsistentwiththepurposeofthisorder.

(b)Within30daysofthedateofthisorder,theSecretaryofWarshallprioritizethecyberdefenseofDepartmentofWarinformationsystemsbytakingappropriateandexpeditiousactionconsistentwiththepurposeofthisorder.

(c)Within30daysofthedateofthisorder,theSecretaryofHomelandSecurity,throughtheDirectoroftheCybersecurityandInfrastructureSecurityAgency(CISA),inconsultationwiththeDirectoroftheOfficeofManagementandBudget(OMB),theAssistanttothePresidentforNationalSecurityAffairs,and

theNationalCyberDirector,shallreleaseBindingOperationalDirectivesandotherguidanceasappropriateto:

(i)expediteandprioritizethecyberdefenseofcivilianFederalGovernmentinformationsystemsinordertoprotectourNation’svitalfunctions;

(ii)establishorexpandFederalprogramsandcybersecurityservicesthatenhanceAI-enableddefensivetools;and

(iii)facilitateaccesstocybersecuritytoolsandservicesincluding,whereappropriate,coveredfrontiermodelsforagencies,Stateandlocalauthorities,andoperatorsofcriticalinfrastructuresuchasruralhospitals,communitybanks,andlocalutilities.

(d)Within30daysofthedateofthisorder,theSecretaryoftheTreasury,inconsultationwiththeNationalCyberDirector,theSecretaryofWar,throughtheDirectoroftheNationalSecurityAgency(NSA),andtheSecretaryofHomelandSecurity,throughtheDirectorofCISA,shallformanAIcybersecurityclearinghouse,involuntarycollaborationwiththeAIindustryandoperatorsofcriticalinfrastructure,thatcoordinatesanddeconflictsscanningforsoftwarevulnerabilities,discoversandvalidatessuchvulnerabilities,andcoordinatesandprioritizesremediationanddistributionofvulnerabilitypatches.

(e)Within30daysofthedateofthisorder,theDirectorofOMB,incoordinationwiththeNationalCyberDirectorandthe

DirectorofCISA,shalldeterminewhetheranyFederalgrantprogramshaveavailableandrelevantfundingthatcanbedirectedtowardapplicantsdevelopingadvancedAIvulnerabilitydetection.

(f)Within60daysofthedateofthisorder,theDirectoroftheOfficeofPersonnelManagementshallexpandtheUnitedStatesTechForceInformationCybersecuritySpecialisthiringandplacementpathways.

Sec.3.SecureFrontierModelDeployment.

Within60daysofthedateofthisorder,theSecretaryoftheTreasury,theSecretaryofWar,throughtheDirectorofNSA,andtheSecretaryofHomelandSecurity,throughtheDirectorofCISA,inconsultationwiththeWhiteHouseChiefofStaff,throughtheNationalCyberDirector,theAssistanttothePresidentforScienceandTechnology(APST),andtheSecretaryofCommerce,throughtheDirectoroftheNationalInstituteofStandardsandTechnology,andincoordinationwithotheragencies,asappropriate,shall:

(a)developandmaintainaclassifiedbenchmarkingprocesstoassesstheadvancedcybercapabilitiesofAImodelsanddeterminethethresholdatwhichanAImodelshouldbedesignateda“coveredfrontiermodel”forthepurposesofthisorder,sharingsuchassessmentswithAIdevelopersandresearchersasappropriate.Suchadeterminationshallbemade

bytheDirectorofNSA,inconsultationwiththeNationalCyberDirector,theAPST,theDirectorofCISA,andotherrepresentativesoftheDepartmentofWar,asappropriate.

(b)designavoluntaryframeworkwithAIdevelopersthroughwhichdeveloperswouldbeableto:

(i)engagetheFederalGovernmenttodeterminewhethermodel(s)underdevelopmentmeetthedesignationof“coveredfrontiermodel”;

(ii)providetheFederalGovernmentwithaccesstocoveredfrontiermodels,subjecttoappropriateconfidentiality,cybersecurity,insider-risk,andintellectual-propertyprotection,use,andnondisclosurerequirements,foraperiodofupto30daysbeforetheyplantoreleasesuchmodelstoothertrustedpartners;and

(iii)collaboratewiththeFederalGovernmenttoselecttrustedpartnersthatwillhaveearlyaccesstocoveredfrontiermodelstopromotesecureinnovationandstrengthenthecybersecurityofcriticalinfrastructure.

(c)Nothinginthissectionshallbeconstruedtoauthorizethecreationofamandatorygovernmentallicensing,preclearance,orpermittingrequirementforthedevelopment,publication,release,ordistributionofnewAImodels,includingfrontiermodels.

Sec.4.ProtectionAgainstCriminalActors.

TheAttorneyGeneralshallprioritizetheenforcementof18

U.S.C.1028,18U.S.C.1030,18U.S.C.1343,andallotherapplicableFederalcriminallawsagainstanyonewhoutilizesAItoillegallyaccessordamageacomputerwithoutauthorization,orwhoutilizesAIwhileengagedinsuchillegalaccesstofurtheranyothercrime.Thisincludesbreachinganypublicorprivateinformationtechnologysystem,oremployingAIagentstounlawfullyaccessdataorinformationthatissubsequentlyusedforacriminalorunlawfulpurpose.

Sec.5.GeneralProvisions.

(a)Nothinginthisorder
