“互联网+“公证如何助力版权保护? “随着云计算、大数据、移动互联网、物联网等新兴信息网络技术的快速发展， 电子数据成为信息世界中新的证据之王，在司法实践中的重要性日益凸显。 ”近 日，记者从中国互联网电子数据研究院第一期培训暨电子数据公证研讨会 上了解到，电子证据公证在知识产权类案件尤其在著作权保护中的作用越来越 明显。然而， 面对海量的电子证据，如何对发表在微博上的文字、聊天记录、 手机通话等进行公证，以确保电子证据的真实、合法及其与待证事实的关联性？ 与会人士认为，实践 证明，与互联网公司合作，通过技术手段，把证据与当事 人隔离开来，进行客观化，固定化，并且在事后由公证机构对其进行检验，这 是对传统公证方式的挑战，也 是目前最现实的选择。 公证服务版权保护全过程 电子证据是指通过电子邮件、电子数据交换、网上聊天记录、博客、微博 客、手机短信、电子签名、域名等形成或者存储在电子介质中的信息。目前我 国民事诉 讼法第六十三条已将电子证据作为独立的证据形式。在上述电子数据 公证研讨会上，隆安律师事务所创始人徐家力律师就直言，电子数据公证在知 识产权类案件中起 到了生死攸关的作用。 近日，司法部律师公证工作指导司、中国公证协会联合发布的中国公证 服务知识产权发展情况报告认为，在知识产权公证中，保全证据公证总量位 列第一， 占比过半，公证证据效力在知识产权保护中得到充分发挥。据了解， 在著作权保全证据公证方面，早期主要是大量购买盗版光盘公证、网络视频公 证、网吧侵权公 证、超市餐饮店播放音乐侵犯著作权的公证。目前，著作权领 域比较多的是盗版软件或未注册软件的使用、盗用或未经原著作权人同意冒用 著作权的保全证据公证， 此外，未经作者同意擅自转载作者已经发表的作品、 或转载后未署名、或擅自改编作者作品行为的保全证据公证也较常见。从著作 权保全证据公证的内容变化不难看 出，随着网络技术的发展，电子证据的保全 证据公证越来越多。 健全公证机制保护知识产权 然而，如中国互联网协会副秘书长石现升所言，“海量、无痕、易变、不 易保存”是电子证据呈现的主要特征，这使得传统的公证服务模式面临严峻挑 战。其中 一个重要问题是，传统的公证模式采取现场取证、现场拍照等方式， 以确保原始证据的产生都是在公证员面前发生的。但在互联网的背景下，QQ 聊 天、淘宝购物等 这些电子数据的产生时不可能都有公证员在现场，这时公证行 业该如何应对？ 北京市公证协会信息化委员会主任吴凤友分析，目前一种还是坚持传统方 式，必须眼见为实，否则无法公证；一种是公证机构自己投入，自己研发，搭 建电子数 据公证平台，比如 2012 年 8 月，上海市东方公证处自主研发电子证 据保全平台“公证证据宝”，2013 年，厦门市鹭江公证处推出了“公证云”平 台；还有一 种，更多地选择了与专业的技术公司合作，在电子证据产生的时候， 虽然公证员无法在现场，但通过技术的手段，把证据客观化固定化，事后再由 公证机构对其进行 检验。 北京市方圆公证处就选择了通过“安存录音”“公正邮”“无忧存证”出 证。据了解，这是杭州安存网络科技有限公司基于安存电子证据公证平台推出 的系列产 品。该公司创始人徐敏介绍，这一平台能在电子数据生成的同时，便 将其完整备份在云存储中，解决证据的固化和保存的问题。同时，采取最高级 别加密传输保护、 公安部的完整性鉴别、分布式存储隔离和安全防护保障，确 保数据实时同步备份传输过程中不被篡改，从而保证证据的真实性。此外，通 过与全国的公证处合作，公 证机关可以直接进入数据库后台调取已备份保全的 数据，并以公证的形式对电子数据进行形式固定，解决证据如何取得法庭认可 以及归档的问题。“我们希望用最好 的技术，将最原始的数据和最有效力的公 证结合起来。”徐敏表示。 “无论是自建平台还是和专业技术公司合作，我们在电子数据公证上的探 索都还刚刚起步。”如北京市方圆公证处负责人叶欢江所言，不少公证处仍在 观望，如何应对电子数据公证这一全新的挑战。 “Internet +“ How to boost copyright protection notary? “With cloud computing, the rapid development of big data, mobile Internet, networking and other new information network technology, electronic data has become a new world of information king of evidence, the importance of judicial practice has become increasingly prominent.“ Recently, Reporters from the China Institute of Electronic Data Internet first training-cum-workshop learned notarization of electronic data, electronic evidence notarized in such cases, especially the role of intellectual property in copyright protection is becoming increasingly apparent.
