法律英语句法特征的文体学分析 摘要 法律语言是法律职业专用的语言，是法律思想的外衣和法律精神的体现。 法律的撰写和记录主要靠书面语言来实现。法律英语是英语的一个特殊语域， 具有区别子文学语言和其他实用文体的显著特点。作为英语的功能变体，法律 英语的文体特点取决于法律的特殊社会功能。法律在社会活动中的特殊作用要 求法律英语正式、准确、保守，要避免模糊和歧义。但对于正式和准确的过度 追求，使得法律英语显得过于复杂、累赘，甚至是枯燥乏味。所有这些特点在 法律英语的句法中都有所体现，因此通过对法律英语句法的研究，能够对这一 特殊语域有更深的认识。功能文体学是现代文体学的主要理论之一，韩礼得关 于有动的前景化突出，语境及语境的三要素等理论很有影响及启发性。本文对 法律英语句法特征的研究遵循功能文体学的研究理论和方法。宏观分析在于三 大纯理功能在法律语境中的体现，以及法律语境中的语景、语旨和语式的实现 方式；微观研究在于具体的法律英语的句法特征。最后的结论是作为英语的功 能变体，法律英语的句法特征是由其应实现的功能所决定的，反过来，其句法 特征又为语言实现功能而服务。 本论文分为五章对以上问题进行分析论述： 第一章即“引言”。首先是文献综述。之后简要介绍了法律的作用，及其 对法律语言的影响，即法律的功能性决定了法律语言的特殊性。法律英语的特 点在其句法中有典型的反映，对法律英语句法的研究，可以加深对这一文体的 深层认识。功能语言学的相关理论为研究法律英语这一英语的功能变体提供了 理论指导，本论文将主要依靠功能语言学、功能文体学的理论对法律英语的句 法特点进行分析、归纳、总结。 第二章是文体与文体学，简要介绍文体学研究的发展历程及现状，重点介 绍功能文体学的相关研究理论，如突出性特征，突出的形式，功能文体学的主 要研究方法和步骤及其对现代文体学的指导和影响。 第三章引入论文的重点概念法律和法律英语。法律英语是英语的功能变体 之一，是实现法律功能的主要手段和方式。本章首先讨论三大纯理功能在法律 英语中的体现，之后引入法律语篇和法律语境。分述法律语境的三个要素，即 情景、语旨、方式。最后概括性介绍法律英语的总体特征，即是一种极正式的、 保守的、朴实的、烦琐而累赘的语言 第四章是文章的主体，即法律英语句法的文体特征。文章分别从十一个方 面进行详尽的论述。这十一个方面是：法律英语的基本句型；主要使用情态动 词规定义务，授予权利；通篇使用陈述语气；大量使用长句；完整句的运用； 复杂的状语从句成分：时态上基本只使用一般现在时；虚拟语气的间或使用； 主动语态和被动语态的交替使用；尾重句和松散句的搭配使用；名物化。对以 上十一个部分的讨论，主要以具体的法律条款或合同条款为实例，通过实例说 明相关理论和结论。 第五章是全文的总结。通过以上的分析论证，得出以下结论：法律英语作 为一种功能变体，其句法的文体特征主要是由其所要实现的功能决定的，法律 的严肃性、权威性和准确性决定了法律英语的正式性、保守性、精确性、完整 性。但同时，由于对准确性的过分追求，导致了法律英语在句法上表现出烦琐、 复杂，甚至拖沓、累赘的特点。除去法律功能的限制和影响，法律语言特点的 形成还有一定的历史原因。即法律文件撰写者为了避免任何可能的缺失和漏 洞，刻意地保持对传统风格的严格遵守。这一主观原因也是造成法律文件长久 以来表现出同大众交际语言或一般实用语言有巨大差异的另一要素。 关键词：法律英语；法律语境；功能；句法特征 t h e s t y l i s t i ca n a l y s i so f t
