摘要 随着中国加入世贸组织，我国法制化进程的加快和对外交流的增多，我国每 年都有大量法律文献被译成英文。同时，为了更好地与世界经济贸易规则和国际 惯例接轨，更多地参与国际经济政治活动，需要我们对国际经济法、国际贸易法、 涉外经济等法律法规及发达国家比较完备的法律体系有进一步了解，从而借鉴并 吸收其精华，提高我国立法质量。因此。如何准确地实现法律翻译的交际功能， 以及用什么样的翻译理论来指导法律翻译实践就成为了当今法律翻译工作者和 研究人员共同关注的焦点。 翻译界长期以来一直存在着直译与意译，归化与异化可译与不可译之争， 其实关键在于对于源语文本信息的解读，以及在重新编码过程中信息显性化和 隐性化处理上“度”的把握。在任何文本中，表示物质事件与关系的信息都 可能有隐性的意义存在，但没有被明确表示出来。在翻泽过程中，隐性信息的解 读和准确传递是翻译的关键，因为源语文本与译本具有完全重合的明示信息和隐 性信息结构的可能性几乎完全可以排除。处于字面的明示信息必须得到暗含的相 关隐性信息的补充配合才能表达出文本的完整意义。什么需要隐含表达，什么需 要明示表达，取决于各种语言自身的性质及译文的交际目的，也就是翻译行为的 目的。 功能翻译理论“把目光投射到了译作在新的文化语境里的传播与接受，注意 到了翻译作为一种跨文化传递行为的最终目的和效果，还注意到了译者在这整个 翻译过程中所起的作用”。( 谢天振，2 0 0 1 ：4 ) 在法律翻译方面，功能目的论从宏观 角度为法律翻译工作者确立了合理的翻译理论架构。其中“目的法则”为译者指 明了工作方向，“忠实性法则”和“连贯性法则”则为译者明确了翻译思路。此 外，作为目的论的发展和完善，诺的提出的“忠诚原则”加强了译者的责任感， 补充并发展了其它三条原则。目的论使译者摆脱了以往“怎么译”的条条框框的 局限，赋予了译者更高的地位和更大的自由，使他们将国外的法律翻译成既符合 我国法律语言特点又保留源语真正内涵的中文成为可能。 本文借鉴功能翻译理论中的主要观点目的论，以法律文献资料为语料来 深入探讨英汉法律互译中显性和隐性的运用及其表现特征，并举出各种英汉汉英 翻译的实例。鉴于法律语言的特点以及法律文本的功能，并根据功能目的论所提 出的三大法则，作者通过对源文和译文中表层结构的变化分析其深层结构的内涵 意义，说明如何正确处理显性和隐性的翻译，从而减少翻译过程中信息的流失， 加强读者理解的连贯性，成功地实现源语作者译者和译语读者三方之间的互 动，顺利达到跨语言交际的目的。 全文共分为六章。第一章为引言，作者介绍了显性翻译和隐性翻译的概念以 及它们在法律文本翻译中的必要性，陈述了本文研究的目的和新意。 第二章总结了法律文本的特点，简要回顾了中外法律翻译理论所经历的若干 阶段。本章最后，作者引入了法律翻译的新途径目的论。 第三章是本文的理论基础，首先介绍了在目的论形成，发展及完善过程中做 出重大贡献的四位学者及其翻译理论。此外，作者还解释了“目的论三法则”和 “忠诚原则”的涵义及它们之间的关系。 第四章从目的法则，连贯法则，忠实法则和忠诚原则四方面详细分析了目的 论适用于法律翻译的原因。 第五章是从目的论的角度看法律翻译中显性和隐性的翻译，也是本文的重 点。作者从语篇的内在逻辑关系分析目的论三法则和忠诚原则的具体应用，就如 何正确处理法律文本翻译中显性和隐性的翻译提出若干可行的翻译策略。 第六章为结论部分。 本文仅是法律翻译研究方面一点有益的尝试，希望能为以后系统，客观，高
