协议书（公司人员） EMPLOYMENT AGREEMENT ( for Company Personnel)甲 方：陕西建工第七建设集团有限公司巴基斯坦项目部 Party A: Pakistan project department SCEGC NO.7 Construction Engineering Group Company LTD. 乙 方： 身份证号： Party B: ID No:经甲、乙双方友好协商，本着合法、公平、平等自愿、协商一致、诚实信用原则就乙方在巴基斯坦卡拉奇项目施工期间的人身安全及福利待遇达成如下协议，并共同遵守。 On the principles of legal,equality consensus, honesty and credit ,free will , and Through friendly negotiations, Party A and Party B have reached the following agreement on issues of safety and welfare of party b during the construction period in Karachi project,Pakistan. and abide by.1、 甲方权利和义务 I. Party A right and duty : 1、甲方负责为乙方办理出国体检及签证、协议履行期间的往返国际旅费、住宿（含卧具）、上下班交通、劳保用品和工作安全措施等由甲方承担费用。1.Party A shall transact the overseas physical examination ,visa application, provide round-trip international travel costs during contract performing period , accommodation (including bedding), commuting, labor protection supplies, and work safety costs ,and other costs should be borne by party A .2、 甲方负责向乙方支付工资，以公司确认的工资标准为依据，甲方实行月工资制度（日历天数），乙方在国外工作期间月工资为小写（大写 ）元人民币月。试用期工资为小写（大写 ）元人民币月（工资内包含一日三餐费用,包含五险一金的个人代扣部分的费用）。2. Party B is responsible for paying salary to Party B, according to wage standard confirmed by the company ,Party A adopt monthly pay system (calendar days), Party B monthly salary while working abroad is (Amount in Figure )RMB ,(Amount in words ) RMB . Salary of probation period of Party B is (Amount in Figure )RMB ,(Amount in words ) RMB . ( Monthly Wages contains a day charges of three meal , and individual deduction part of five insurances and Housing fund.)3、 甲方应为乙方购买境外人身意外伤害保险，承担保险费用。当保险条款发生效力时，其保险金额受益权及其支配权归甲方所有，该款项用于发生人身意外情况时的善后处理及补偿。3. Party A shall buy overseas person accident injury insurance for Party B . When the validity of insurance terms and conditions occurs, Party A own the beneficial right of insured amount and dispose right of the insurance money ,the insurance money is used for personal accident and aftermath treatment and compensation.4、 乙方在国外期间发生工伤事故或非个人原因患上工作所在国的地方性疾病时，甲方承担乙方治疗费用；若经医院鉴定需回国治疗的，甲方将负责安排乙方回国，并按照国家工伤保险条例的相关规定承担相关费用。因违反外事纪律和甲方国外项目部的各项规章制度而造成伤亡事件的，乙方应自行承担全部责任，不得向甲方主张权利。4. When work injury happens on Party B during the period of working abroad or developing local disease in the country Party B work, Part A is responsible for the cost of treatment .if Party B have to receive medical treatment in China according to hospital identification,Party B is responsible for arranging Party B return to China and bear related costs according to Injury Insurance Regulations. Casualty and injury Incident happen due to the violation of disciplines related to foreign affairs, and Party As overseas projects department rules and regulations ,Party B shall take full responsibility, shall not claim to Party B.5、 在执行本协议期间，若因不可抗力（如战争、瘟疫、内乱、经济危机、政策变化、自然灾害等）和其他意外事件发生导致协议中止，甲方须负责及时安排乙方安全回国。5. During the execution of this agreement, if the force majeure (such as war, plague, civil unrest, natural disasters, economic crisis, policy change, etc.) and other unexpected events lead to the suspension of the agreement, Party A shall be responsible for arranging Party B return home.6、 乙方有下列情况之一者，甲方有权解除协议并协助其回国，回国单程机票费用由乙方承担，该费用由甲方项目部从乙方的国外收入中扣除。 6. Party a is entitled to cancel the agreement and assist Party B return home, the return air ticket fee shall be borne by Party B. the cost deduct from Party Bs overseas income paid by Party As project department , if Party B has any one of the following circumstances:1） 经工作实践证明，乙方的工作能力与所述工作经历不符合录用条件，三个月内仍不能胜任其工作岗位要求的。1) Working practice proves that Party Bs working ability and experience do not accord with employ condition, and Party B still not competent for jobs require in three months 2）在国外工作期间如发生违法违纪或严重违反外事纪律以及因工作渎职而造成工程事故，使甲方遭受重大经济损失和恶劣社会影响的。2) Any violations occurred while working abroad or serious violation of disciplines related to foreign affairs as well as the engineering accidents caused by work malpractice, resulting in significant economic losses and bad social influence.3）隐瞒个人身体状况，出国后被医院查出患有高血压、心脏病、糖尿病等慢性病、旧伤、癌症、精神疾病等非当地特有的传染病及先天性疾病的而影响工作，在当地治疗的医药费由乙方个人负担。3) Party B conceal personal physical condition and Party B is diagnosed with high blood pressure, heart disease, diabetes, old wounds, cancer,mental illness and non-local characteristic infectious disease and congenital diseases which influence the work after going abroad , medical expenses in the local shall be borne at the Party Bs costs.4）违反我国及当地法律被追究刑事责任的。4) Violation of our country and the local law and investigated for criminal responsibility according to law.5）未经项目经理同意或违反项目规章制度，私自外出的人员.5） The personnel who go out Without the permission of the project manager or violation of program rules and regulations.2、 乙方权利和义务 II .Party B right and duty :1、 乙方根据甲方的要求应遵纪守法、并提供其真实的个人简历及相关证件复印件,保证严格遵守外事纪律。遵守当地法律、尊重当地风俗习惯。 1.According to the requirements of Party A, Party B should be law-abiding, and provide the real personal resume and related certificates copies, guarantee strictly abide by the disciplines related to foreign affairs.abide by local laws, respect the local customs.2,协助甲方按照国家工伤保险条例相关规定，与因工伤、病回国人员（或家属）以及在国外发生意外人员的家属协商处理经济补偿等善后事宜及家属的抚慰工作，补偿的费用由甲方承担。2.Party B should assist party a to deal with the economic compensation for Returned staff because of illness or work injury , all costs shall be borne by party a .3、 为保证乙方的人身安全及防止大家的护照丢失，进入施工现场后，护照交由甲方统一保管。 3. In order to ensure Party Bs personal safety and avoid the loss of passport, after entering the construction site, passport under the custody of Party A 4、 乙方不能擅自单独离开施工场地，有事需外出时，应打书面报告经过甲方项目部批准方可外出，若在没有经过批准擅自外出发生意外时，甲方不予承担任何责任，全部责任由乙方承担。 4.Party b cant leave alone from the construction site without authorization, if Party B have to go out, Party B should make a written report approved by Party As project department .If accident happens , when Party B leave alone from the construction site without authorization. Party A shall not be held responsible for any and all liability shall be borne by Party B.5、 乙方每年有一次回国探亲的权利，每次不超过20日历天，探亲期间的工资正常发放，且发生的差旅费由甲方承担。 5.Party B has the right to a return home for visit ( no more than 20 calendar days), normal distribution of wages during the home visit and the traveling expenses shall be borne by Party A.3、 其他 III Others :1、 在本协议履行中，如双方发生争议应通过友好协商解决；协商不成时，可通过调解、仲裁等途径解决；仲裁由宝鸡市劳动争议仲裁委员会裁决；争议解决期间，双方应继续履行本协议无争议部分。 1. In the performance of this agreement, If dispute occurs, two sides shall settle it through friendly negotiation; If it cannot be settled after negotiation , two sides can resolve disputes through mediation, arbitration and other channels; Arbitration by the Bao ji labor dispute arbitration committee ;During the settlement of a dispute, both parties shall continue to perform non-controversial
