Improper recruitment costs: yellow light1.1 明确的收取入厂押金(包括厂服、工牌、生产工具/用具、伙食费等);1.1 Make specific charge of deposits for entering the factory (including factory uniform, work card, produce tool/equipment, board wages and etc);1.2 工人求职要交钱给厂方人员。1.2 Workers should hand in some money to the factory staff for job hunting.1.3 外籍劳工不清楚劳动合同的条款、工作条件等:黄灯1.3 Foreign workers have no idea about contract terms or working conditions, etc: yellow light2、根据所在国家的法律,外籍劳工不可以自由和雇主解除合约:黄灯2. Hide up relevant documents/The documents are not complete: yellow light6.1、工厂未与工人签劳动合同或未全部签定/劳动合同过期/劳动合同未经当地劳动部门签证/劳动合同没有员工签名/劳动合同缺乏必要条款/工人未获得一份劳动合同/等;6.1 The factory doesnt sign labor contracts with the workers or with all the workers/the labor contract is overdue/the labor contract is not approved by the local labor department/the labor contract has no signature of the employee/the labor contract is lacking in necessary provisions/the worker doesnt have one copy of the labor contract/etc;6.2、工厂未按合同约定的基本工资支付给工人;6.2 The factory doesnt pay the workers basic wage according to the contract; 6.3、工厂仅提供了部分相关数据供评审员评估;6.3 The factory provides part of the relevant data for auditors review;6.4、厂方不允许认证员复印资料。6.4 The factory doesnt allow the auditors to copy the materials.6.5、无营业执照:橙灯6.5 No business license: orange light五、惩戒性措施. Fling abuses (observed/learned in the interview): green light六、雇佣实践:. Employment Practices1、以不适当的健康检查结果来决定是否录用员工:黄灯1. Determine whether to hire an employee according to the result of improper health examination: yellow light 1.1 非法验孕。1.1. Illegal pregnancy test.2、妇女一旦怀孕就必须离职或予以解雇:黄灯2. Women employees once found to be pregnant have to leave or be dismissed: yellow light2.1 员工反映产后妇女不再录用;2.1 Employees reflect that women employees after childbirth are no longer employed;2.2 工厂要求孕妇辞职/请假。2.2 The factory requires pregnant employees to resign/ask for leave.3、员工之升迁基于个人的人际关系为依据业经查证属实:黄灯3. It is investigated and verified that employeespromotion are based on interpersonal relationship: yellow light3.1 员工升迁/定薪个案基于个人特点,如性别、民族、籍贯、年龄上限要求、长相、身高和性格血型等。3.1 Individual employees promotion/wage is based on personal characteristics, such as gender, nationality, native place, upper limit requirement of age, appearance, height, character, blood type and etc. 4、其他:绿灯4. Others: green light4.1 工厂基于年龄招募员工,如必须年满18 周岁等。4.1 The factory recruits employees based on age, for example, at least 18 years old, and etc.5、雇佣童工:红灯5. Employ child labor: red light5.1 工厂招用两名以上未满16 岁工人;5.1 The factory employs at least two workers under the age of 16.5.2 工厂资料中发现有两名以上童工但找不到工人核实;5.2 Over two child labors are found in the factorys material but no worker can verify that;5.3 两名以上员工自述年龄未满16 岁而且没有身份证,但与人事档案资料不相符;5.3 Over two employees narrate by themselves that they are under the age of 16 and have no ID card, but thats inconsistent with the personnel files;5.4 工厂在首次年龄违规发现之后仍继续使用童工。5.4 The factory continues using child labor after the age violation being found for the first time.6、未向未成年工以及从事易患职业病职业之员工提供定期健康检查:黄灯6. No regular health checkup is provided for underage workers or workers engaged in jobs that are easy to suffer from occupational diseases: yellow light 6.1 不给未成年工定期进行体检。6.1 No regular health checkup is provided for underage workers.7、未成年工无/过期/未备齐相关证明文件:黄灯7. Underage workers have no/expired/insufficient relevant supporting documents: yellow light7.1 录用未成年工不到当地劳动部门登记。7.1 No registration in the local labor department for employing underage workers.8、年龄违规:发现使用一至二名童工:橙灯8. Age violation: one or two child labors are found: yellow light8.1 工厂资料中发现有1 或2 名童工但找不到工人核实;8.1 One or two child labor are found in the factorys material but no worker can verify that;8.2 1 或2 名员工自述年龄未满16 岁而且没有提供身份证原件;8.2 One or two employees narrate that they are under the age of 16 and no original copies of ID cards are provided;8.3 过去6 个月中,有1 或2 名员工入厂时不满16 周岁(需确认订单情况,如在此6 个月内有订单,则为年龄违规,否则,算历史性童工)。8.3 Over the previous six months, one or two employees are under the age of 16 when entering the factory (order status shall be confirmed, if there were orders during the six months, it will be age violation, otherwise historical child labor) 9、未成年工被安排从事法律禁止工种:黄灯9. Juvenile employees are arranged to engage in the type of work forbidden by the law: yellow light9.1 未成年工在劳动部规定的禁止范围内如井下、有毒有害、高处、高温环境下从事国家规定的第四级体力劳动强度劳动,如做胶水工、喷油工、焊锡工、搪胶工、高温啤机工、裁床、冲床工等。9.1 Juvenile employees engage in the jobs of fourth grade manual labor in the environment within the prohibition scope stipulated by the Ministry of Labor like underground, poisonous and harmful, high altitude, high temperature environment, such as glue workers, oil workers, solder workers, soft plastic workers, injection workers, bed cutting workers, punchers and etc.10、员工之小孩出现在生产区域内:橙灯10. Children of employees appear in the production area: orange light10.1 员工的小孩在厂里玩;10.1 Children of employees play in the factory;10.2 员工带小孩上班;10.2 Employees are working with their children around;10.3 发现生产区域有小孩。10.3 Children are found in the production area.10.4 员工伪造年龄资料:橙灯10.4 Employees forge their age material: orange light10.5 工人借别人的身份证/用虚假身份证入厂。10.5 Workers use other peoples ID/false ID for entering the factory.七、强迫劳工. Compulsory Labor1、工人被锁于生产车间/厂区内(判断工人是否有行动自由):红灯1. Workers are locked up in the production workshop/the factory (judging the freedom of action for workers): red light2、向使用监狱劳工的国营实体采购产品/材料:红灯2. Purchase product/material from state-owned entities using prison labor: red light2.1 直接购买犯人生产的产品;2.1 Purchase product produced by the prisoners directly;2.2 间接购买犯人生产的产品;2.2 Purchase product produced by the prisoners indirectly;2.3 工厂将产品外发给监狱生产;2.3 The factory subcontract with the prison to produce;2.4 由监狱(或使用监狱工的企业)采购原材料;2.4 Raw material is purchased by the prison (or the enterprise using prison labor)2.5 外发产品到从监狱采购原料的企业进行加工;2.5 Subcontract with the enterprise purchasing raw material from the prison for processing;2.6 外发产品到使用监狱工的企业加工。2.6 Subcontract with the enterprise using prison labor for processing.3、不当之生理需求之限制:黄灯3. Improper restrictions of physiological needs: yellow light3.1 工人上洗手间、喝水、吃饭不方便(如有时间或其他不合理限制的离岗证);3.1 Its not convenient for the workers to go to the bathroom, to drink water, to have a meal (like a leave certificate of time limit or other unreasonable limits)3.2 限制工人上洗手间的时间(吃饭/喝水)。3.2 Restrict the time for the workers to go to the bathroom (to have a meal/to drink water)3.3 经常性的一周工作七天:黄灯3.3 Work for seven days in a week on a regular basis: yellow light3.4 在过去的三个月中,每个月内有两次或以上连续7 天没有休息日。3.3 There were over two times of no day off for consecutive seven-day period every month in the past three months.4、不加班就予以处罚或开除:黄灯4. Workers who do not work overtime will be punished or dismissed: yellow light4.1 工人不愿加班要处罚(如扣工资、记过、开除、降工资、停工等)。4.1 Workers who are not willing to work overtime will be punished (such as wage deduction, demerit record, dismissal, wage cut, shutdown and etc).5、扣留政府核发之证件:橙灯5. Detain the certificates approved and issued by the government: orange light6、现场发现工厂扣留工人的身份证、暂住证、学历、结婚、计生、未婚及其它有效证件。6. Its found on site that the factory detained the workers ID cards, Temporary Residence Permit, Education Certificate, Marriage Certificate, Unmarried Certificate and other valid documents.7、限制员工行动:黄灯7. Restrict the action of the workers: yellow light7.1 下班后不许工人回宿舍或离开宿舍;7.1 Prohibit the workers from returning to the dormitory or leaving the dormitory after work;7.2 工人欠公司的钱不可辞职;7.2 Workers owing the company money cannot resign;7.3 工人损坏公司的财物未赔完钱前不可以辞职/不批准工人辞工;7.3 Workers who have damaged the property of the company cannot resign/will not be approved to resign before they have finished the compensation;7.4 批准工人辞工时间大于法定时间;7.4 Time used to approve the workers to resign is longer than the legal limits of time;7.5 合同期内不准员工辞工(提前申请也不批);7.5 No employees are allowed to resign within the contract period (application in advance is not approved)7.6 非工作时间限制工人外出(宿舍或工厂);7.6 Workers are restricted to go out (of the dormitory or the factory) on their own time;7.7 公司付款为工人培训,未满合同期不可辞职。然而,雇佣合同却没有因为接受培训而不许在合同未满前辞职的相关规定;7.7 The company pays for the workers training, and they cannot resign before the contract is due. However, there are no relevant regulations in the employment contract that employees are not allowed to resign because of the training before the contract is due;8、工厂工作守则、劳动契约有违法条款:黄灯8. There are illegal terms in the factorys code of practice or labor contract: yellow light8.1 如果合同/厂规厂纪中有不合法的条款则为此项,如工人入厂需缴纳押金。8.1 If there are illegal terms in the contract or the regulations and policies of the factory, it belongs to this item, for example, the workers should hand in some deposit when entering the factory. 9、限制工人加入工会:橙灯9. Restrict the workers to the Labor Union: orange light10、工厂的厂规厂纪/劳动合同显示厂方未尊重员工选择参加工会组织的自由,干涉、阻挠或禁止员工加入合法团体。10. It shows in the regulations and policies/labor contract of the factory that it did not respect the employees freedom to choose their participation in a trade union organization, and it interfered with employees joining a legal organization, or stand in the way, or prohibited them from doing that. 八、工时部分. Hours of Work八、工时部分On work hours1、违反沃尔玛的第七天休息之政策:黄灯Violation against WMs one rest in seven days: yellow light1.1工厂未能提供第7天休息(非经常性-且不是每个月都发生两次或以上)。Factory management didnt fully ensure one rest in seven days (not regular violation either, once or so in a month).2、超时加班:黄灯2. Overtime hour exceeds limits: yellow light2.1加班时间大于法定的36小时/月;2.1 Overtime hour exceeds 36h/month as of legal limits.2.2每天加班大于3小时。2.2 Daily overtime hour exceeds 3 hours3、严重超时加班:橙灯3. Overtime hour far exceeds limits: orange light3.1工人上班时间大于72小时/六天或七天;3.1 Work hour in 6/7 consecutive days exceeds 72 hours.3.2工人在连续24小时内工作时间大于14小时。3.2 Working time exceeds 14 hours in 24 consecutive hours.4、未成年工的工作时间超过法定范围:黄灯4. Juvenile employees work beyond legal hour limits: yellow light4.1安排未成年工上夜班。4.1 Juvenile employees are arranged to work night shift.5、记时系统-无记时/无卡钟/无完整系统以确认工作时间:橙灯5. No attendance device or system to record work hour: orange light5.1上下班时间部分没有记录(工厂应提供截止到审核前一天的打卡记录,但未必是打印件,否则视为违规,另记录在检查权里);5.1 Punch in or out records are not complete (factory management is obliged to provide attendance records (not necessarily printed copy) dated to the previous day of auditing, otherwise it will be deemed as a violation.)5.2加班时间全部/部分没有记录;5.2 No/incomplete overtime hour records.5.3上班或下班时间工作没有记录(如果员工只是个别时间漏打卡,但相应工资计算正确,则不算此违规);5.3 No punch in and punch out record (in case of individuals who forgot to punch, if their wages are based on real work hour, then it wont be deemed as a violation.)5.4只有上班无下班考勤记录;5.4 Only punch in records5.5正常上班打卡,加班不打卡;5.5 Only regular work hour records, no overtime hour records5.6工厂完全无考勤系统;5.6 No attendance system available at all.5.7无精确的工作时间记录确认工资情况(生产资料工作时间与考勤记录不一致);5.7 No accurate work hour records to verify wages (inconsistency between production records and attendance records).5.8工人打下班卡后还在工作;5.8 Work after punch out5.9手工考勤无明确的上下班时间及/或员工本人没有每日签核;5.9 No detailed time records for m
