3、services of Party C, Party A and Party B agree to en ter into this Con tract in equal status and volun tarily with articles as follow,第条 房屋基本情况 Article 1: General states of the house(一) 房屋坐落于北京市一区(县)街道办事处(乡镇),建筑面积 平方米。(a) The house is located at (Address) , and the size is Square meters.(二) 房屋权属状况:甲

6、mber of in habita nt is , and should not exceedi ng pers ons.(二)如租赁用途为居住的,甲方应自与乙方订立本合同之日起7日内,到房屋所在地的社区来京人员和出租房屋服务站办理房屋出租登记手续。对多人居住的出租房屋,乙方应将居住人员情况告知甲方,甲方应当建立居住人员登记簿,并按规定报送服务站。本合同变更或者终止的,甲方应自合同变更或者终止之日起5日内,到房屋所在地的社区来京人员和出租房屋服务站办理登记变更、注销手续。在本合同有效期内,居住人员发生变更的,乙方应当自变更之日起2日内告知服务站,办理变更登记手续。居住人员中有外地来京人员的,甲

7、方应提供相关证明,督促和协助乙方到当地公安派出所办理暂住证;居住人员中有境外人员的,(甲方/"乙方)应自订立本合同之时起24小时内到当地公安派出所办理住宿登记手续。租赁用途为非居住的,甲方应自订立房屋租赁合同之日起30日内,到房屋所在地的房屋行政管理部门办理房屋租赁合同备案手续。If the ren tal purposes is for reside nee, from the date whe n this Con tract has bee n set up, withi n 7 days, Party A should go to the Commun ity Service

8、 Stati on for Foreig ner and House Lease (here in after refers to as the "stati on") to have the house lease con tract registered. If the in habita nt is more tha n one pers on, Party B must inform the situati on of in habita nts to Party A. On the other hand, Party A must establish a regi

9、ster for in habita nts, and send it to the Stati on compl ying with regulati on. If this con tract has bee n ame nded or term in ated, party A should go to the Stati on to cha nge or logout the registrati on withi n 5 days. In the period of validity, provided the inhabitants have changed, from the d

10、ate of change, within 2 days, Party B must inform the Service Stati on and cha nge the registrati on.Party A should supply the related information about himself and/or the house if there is foreigner from other provinces within the inhabitant, to assist and supervise Party B to handle the Temporary

11、Residential Permit at Local Police Station. And Party B should go to Local police station to handle the Lodging Registration within 24 hours if there is any person from other countries, from the time whe n this con tract has bee n set up.If the ren tal purpose is not reside nee, from the date whe n

12、this con tract has bee n set up, withi n 30 days, Party A should go to the departme nt of Local House Admi nistratio n to han dle the Lease Con tract Registratio n fili ng procedure.第三条租赁期限 Article 3: Lease Term(%1)房屋租赁期自一年月一日至一年一月一日,共计一年一个月。甲方应于一年一月日前将房屋按约定条件交付给乙方。房屋交割清单(见附件一)经甲乙双方交验签字盖章并移交房门钥匙及 后视

14、he house have bee n delivered.(%1)租赁期满或合同解除后,甲方有权收回房屋,乙方应按照原状返还房屋及其附属物品、设备设施。甲乙双方应对房屋和附属物品、设备设施及水电使用等情况进行验收,结清各自应当承担的费用。乙方继续承租的,应提前一日向甲方提出(书面/ 口头)续租要求,协商一致后双方重新签订房屋租赁合同。(b) Party A has the right to retract the house upon the expirati on of the leasehold or the dissoluti on of the con tract, and, Par

15、ty B should retur n the leased house and accessary facilities in origi nal state to Party A. Both parties must check and accept the house and the accessory facilities, mea nwhile, settle acco unts of the cost which should be bore by their own.If the Lessee intends to renew the leasehold, should no t

16、ify ( writte n/ oral) the Lessor withi n on ei.moBoth parties should con clude a new lease con tract based on the agreeme nt.第四条 租金及押金 Article 4: Rental and deposit(一)租金标准及支付方式:元/( J月/季/半年/年),租金总计:人民币 元整。支付方式:(现金/ 口转帐支票/ 银行汇款),押 _付 三,各期租金支付日期:o(a) Ren tal and payme nt terms:RMB( V mon th/ three mon

20、arkin gfees (l)I ndoor facilities maintenance costs(m) others 本合同中未列明的与房 屋有关的其他费用均由甲方承担。如乙方垫付了应由甲方支付的费用,甲方应根据乙方出示的相关缴费凭据向乙方返还相应费用。The Party A should bear other fees which this con tract has not listed which concerns the house. If the Party B had paid the fees related proof, Party A should retur ned

21、corresp onding fees to Party B.第六条 居间服务 Article 6: Intermediary services(%1)丙方应当认真负责地为甲乙双方订立房屋租赁合同提供机会或媒介服务,如实报告有关订立房屋租赁合同的事项,并协助甲乙双方办理物业交验。(a)Party C should provide the opport un ity or the medium service to both parties con scie ntiously and ear nestly, and no tice the information of this contract

22、 to both parties faithfully, and assist them to check and accept the property.(%1)本合同签订后(J即时/ 日内),甲方应向丙方支付月租金的加卩人民币 元整作为佣金,支付方式:口现金 /口转帐支票 /银行汇款;乙方应向丙方支付月租金的%即人民币 元整作为佣金,支付方式:口现金 / 口转帐支票 /银行汇款。甲乙双方支付的佣金总合应不超过月租金标准。(b) Upon the contract have been signed ( V Immediate/ within days), Party A%shofutlhde

24、赁双方仍应向丙方支付所约定的佣金。(c) Once the contract has been signed, the remuneration couldn't be returned whether this contract is rescinded or suspended, or modified.第七条 房屋维护及维修 Article 7: Maintenance and repair(%1) 甲方应保证出租房屋的建筑结构和设备设施符合建筑、消防、治安、卫生等方面的安全条件,不得危及人身安全;乙方保证遵守国家、北京市的法律法规规定以及房屋所在小区的物业管理规约。(a) Pa

25、rty A should ensure that the construction and facilities of rental house is conformed to relevant laws and regulations. Party B could not do any unlawful or illegal activities which are not allowed according to the State laws, the government regulations and the local byelaw. In the period of rents,

26、both parties should keep the house, the facilities and goods attached to the house in safe and suitable:(%1) 租赁期内,甲乙双方应共同保障该房屋及其附属物品、设备设施处于适用和安全的状态:(b) In the period of rents, both parties should keep the house, the good and facilities attached to the house in applicable and safe:1、对于该房屋及其附属物品、设备设施因

27、自然属性或合理使用而导致的损耗,乙方应及时通知甲方修复。甲方应在接到乙方通知后的七日内进行维修。逾期不维修的,乙方可代为维修,费用由甲方承担。因维修房屋影响乙方使用的,应相应减少租金或延长租赁期限。a. Party B should notice Party A about any damage of the houses due to poor quality, natural tear and wear or calamities. Party A should be responsible for repairing in 7 days and bear the expenses. Pr

28、ovided Party A has not repaired on schedule, Party B could repair in stead of Part A. Party A should bear the expenses which should be undertaken by himself. Once the repairing has made an impact on the usual life, Party A should reduce rental or extend the period of rent correspondingly.2、 因乙方保管不当或

29、不合理使用,致使该房屋及其附属物品、设备设施发生损坏或故障的,乙方应负责维修或承担 赔偿责任。b. The damage of the premises or the fittings that is within the control of the party B should be borne by party B.第八条 转租 Article 8: Transfer or Sublet除甲乙双方另有约定以外,乙方需事先征得甲方书面同意,方可在租赁期内将房屋部分或全部转租给他人,并就受转租人的行为向甲方承担责任。Party B should not partly or totally s

30、ublet without the written permission from party A. If the house has been transferee! or subleted, Party B should be liable for compensating for any behavior of sublet person.第九条 合同解除 Article 9: Dissolution of Contract(%1) 经甲乙双方协商一致,可以解除本合同。(a) The contract can be rescind based on the agreement(%1) 因

31、不可抗力导致本合同无法继续履行的,本合同自行解除。(b) If Force Majeure cause to terminating the contract, the contract is rescinded.(%1) 甲方有下列情形之一的,乙方有权单方解除合同:(c) If Party A has one of the following behaviors, Party B has the right to rescind this Contract unilaterally.1、迟延交付房屋达七日的。a Within 7 days, Party A has not turn over

32、 the house.2、交付的房屋严重不符合合同约定或影响乙方安全、健康的。b The house does not conform to the contract seriously or affects the safety and healthy of Party B.3、不承担约定的维修义务,致使乙方无法正常使用房屋的。c Because Party A has not repaired house, Party B could not use house normally.(%1) 乙方有下列情形之一的,甲方有权单方解除合同,收回房屋:(d) If Party B has one

33、of the following behaviors, Party A has the right to rescind the Contract unilaterally and take back the house.1、 不按照约定支付租金达 日的。a If Party B delays rental payment in the excess of days.2、 欠缴各项费用达 元 的。b If Party B delays kinds of fees in the excess of yuan.3、擅自改变房屋用途的。c If Party B changes the use of

34、the leased house unilaterally.4、擅自拆改变动或损坏房屋主体结构的。d If Party B changes or damages the main structure of house unilaterally.5、保管不当或不合理使用导致附属物品、设备设施损坏并拒不赔偿的。e The damage of the premises or the fittings that is within the control of party B and party B refuses to compensate.6、利用房屋从事违法活动、损害公共利益或者妨碍他人正常工作

35、、生活的。?f The Party B's behaviors in the house are unlawful or interfere with other people's life.7、擅自将房屋转租给第三人的。g The Party B transfer or sublet the leased house unilaterally.(%1) 其他法定的合同解除情形。(e) Other legal situations of contract rescission.第十条 违约责任 Article 10: Responsibility for breach of t

36、he Contract(%1) 甲方有第九条第三款约定的情形之一的,应按月租金的200 %向乙方支付违约金;乙方有第九条第四款约定的情形之一的,应按月租金的 200 %向甲方支付违约金,甲方并可要求乙方将房屋恢复原状或赔偿相应损失。(a) Either of Parties9 behaviors results in the termination of the contract before its expiration, the penalty for breach should be 200% of monthly rental. Party A has the right to tak

37、e back the premises and take actions against party B*s breach.(%1) 租赁期内,甲方需提前收回该房屋的,或乙方需提前退租的,应提前日通知对方,并按月租金的 %支付违约金,甲方还应退还相应的租金。(b) In the period of rent, either Party A shall take back the house ahead, or Party B shall return the house before the contract expiration, he should informed the other p

38、arty ahead of days. Tort-feasor agrees that the penalty for breach of contract shall be % of monthly rental. At the same time, Party A should return the surplus rent.(%1) 因甲方未按约定履行维修义务造成乙方人身、财产损失的,甲方应承担赔偿责任(c) Party A has not repaired the house in time according to the contract, so Party B's sec

39、urity has been damaged. PartyA should undertake the liability of compensation.(%1) 甲方未按约定时间交付该房屋或者乙方不按约定支付租金但未达到解除合同条件的,以及乙方未按约 定时间返还房屋的,应按每逾期一日,按 标准支付违约金。(d) Having not rescinded the Contract, but tort-feasor agree that the penalty for breach of Contract shall be . a Party A shall not turn over the

40、 houses on schedule to Party B for use.b Party B shall not pay the rental on schedule according to the provisions of the Contract.c Party B shall not return the house on schedule according to the provisions of the Contract.(%1) 丙方提供虚假信息、隐瞒重要事实或有恶意串通行为的,除退还已收取的佣金外,还应赔偿由此给甲 方或乙方 造成的损失。(e) Having behav

41、iors in the following, besides returning the service fees received, the party C should also compensate the loss of Party A or Party B.a Party C provided the false information to two parties.b Party C concealed important fact to two parties.cParty C colluded with the third party maliciously.第 条 合同争议的解决办法Article 11: Headling of disputes本合同项下发生的争议,由三方当事人协商解决;协商不成的,依法向有管辖权的人民法院起诉,或按照另行达成的仲裁条款或仲裁协议申请仲裁。(a) Any dispute aris ing from the executi on of, or in conn ecti on with, the con tract sha
