4、otheexpirationhereofifextensionisnecessary.二、工作内容JobDetails第二条乙方同意根据甲方工作需要，担任职位的工作。PartyBshallagreetotakethepositionaspursuanttoPartyAsworkneed.第三条乙方工作应达到国内相关职业要求管理标准，并能完成公司所安排合理的工作要求。PartyBshallperformitsworkinlinewithrelevantnationalstandardsontheoccupationalrequirementsmanagementandshallbecapable

5、ofreasonableworksarrangedbyPartyA.三、工作保护和条件WorkingProtectionandWorkingConditions第四条原则上执行标准工时制度，乙方每日工作时间8小时，每周工作40小时。PartyBshallbesubjecttothestandardworkinghoursysteminprinciple,namelyeighthoursperworkdayandfortyhoursperweek.第五条因设计工作的特殊性，如项目要求需要加班，不计加班费。AnyextrahourworkedbyPartyBforprojectneedasther

6、esultofspecialfeatureofdesignworkshallnotbecharged.第六条甲方为乙方提供必要的工作条件，建立健全工作方式，制订工作规范和工作制度。PartyAshallprovidenecessaryworkconditionsforPartyB,establishsoundworkmode,andformulatejobspecificationandsystem.四、劳动报酬LaborRemuneration.2第七条甲方每月18日前以货币形式支付乙方工资，每月实发工资税后为元。Clause7PartyAshallonamonthlybasispayPar

8、shallpayPartyBthesalaryduringthesickleaveinaccordancewithXXXmanagementsystem.第九条乙方患职业病或因工负伤的待遇按国家和北京市的有关规定执行。PartyBshallbeentitledtothebenefitsassetforthintherelevantrulesandregulationsoftheStateandBeijingMunicipalityifhe/sheisillwithoccupationaldiseaseorinjuredduetowork.第十条甲方为乙方提供以下福利待遇：详则见XXX管理制度。

9、PartyAshallenablePartyBtobeentitledtothefollowingwelfareandbenefits:refertoXXXmanagementsystemfordetails.六、合约的变更、解除ContractAlternationandCancellation第十一条有下列情形之一的，甲乙双方应变更合同并及时办理变更合同手续：PartyAandPartyBshallalterthisContractandpromptlygothroughcontractalternationproceduresifanyofthefollowingcircumstance

10、shappens:（一）甲乙双方协商一致的；PartyAandPartyBreachanagreementonalternationuponnegotiation;订立本合同所依据的客观情况发生重大变化，致使本合同无法履行的；TheperformanceofthisContractisrendereddiscontinuedbythesubstantialchangeofobjectivecircumstanceswhichtheconclusionofthisContractisreliedupon;（三）订立本合同所依据的法律法规、规章发生变化的。Laws,rulesandregulati

11、onsuponwhichtheconclusionofthisContractisrelied. change.第十二条乙方有下列情形之一的，甲方可以解除本合同：PartyAshallbeentitledtocancelthisContractinanyofthefollowingcircumstances:在试用期间被证明不符合录用条件的；PartyBisprovenduringtheprobationaryperiodnottosatisfytherequirementsofemployment;严重违反劳动纪律或者甲方利益造成重大损害的；PartyBmateriallyviolatesl

12、abordisciplinesorcausessubstantialdamagetoPartyAsinterests;严重失职，营私舞弊，对甲方利益造成重大损害的；PartyBseriouslyneglectshisduty,engagesinmalpracticeforselfishendsandbringssignificantdamagetoPartyAsinterests;被依法追究刑事责任的。PartBisbeinginvestigatedforcriminalliabilityinaccordancewiththelaw.第十三条有下列情形之一的，甲方可以解除本合同，但应当提前30

13、日以书面形式通知乙方：PartyAmaydissolvethisContractbygivingathirty-daypriorwrittennoticetoPartyBifanyofthefollowingcircumstanceshappens:（一）乙方患病或者非因工负伤，医疗期满后，不能从事原工作也不能从事由甲方另行安排的工作的；PartyBisincapableofperforminghisoriginalworkandanynewjobasarrangedbyPartyAafterthestipulatedperiodofmedicalleaveforanillnessornon-

14、work-relatedinjuryexpires;（二）乙方不能胜任工作，经过培训或者调整工作岗位，仍不能胜任工作的；PartyBisincompetentandremainsincompetentaftertrainingoradjustmentofhisposition;本合同订立时所依据的客观情况发生重大变化，致使本合同无法履行，经甲方双方协商不能就变更工作合同达成协议的。AmajorchangeintheobjectivecircumstancesonwhichtheconclusionofthisContractisreliedhinderscontinuedperformance

15、ofthisContract,andafterconsultation,PartyAandPartyBareunabletoreachanagreementonamendingthisContract.第十四条甲方濒临破产进行法定整顿期间或者生产经营状况发生严重困难，符合裁减人员条件的，甲方可以解除合同。PartyAshallbeentitledtorescindthisContractintheeventthatPartyAisbankruptorentersstatutoryconsolidationperiodorexperiencesdifficultiesintheproductio

16、nandoperationorfindsitnecessarytoreducetheworkforce.第十五条乙方有下列情形之一的，甲方不得解除本合同；PartyAshallnotcancelthisContractinanyofthefollowingcircumstances:患病或者非因工负伤，在规定的医疗期内的；PartyBisillorinjurednotduetoworkandthemandatorymedicaltreatmentperiodhasnotexpired;女职工在孕期、产期、哺乳期内的;PartyBisawomanwhoispregnant,onmateriali

17、tyleave,ornursingababy;第十六条乙方解除本合同，应当提前30日以书面形式通知甲方，甲方应予以办理相关手续。但乙方给甲方造成经济损失尚未处理完毕或因其他问题正在被审查期间的情况除外。UnlessotherwisealleconomiclossescausedtoPartyAbyPartyBhavebeencompletelycoveredorPartyBisnotunderanyinvestigationforotherissues,PartyBmaycancelthisContractbygivingathirty-daypriorwrittennoticetoParty

18、A,andPartyAunderthiscircumstanceshallgothroughrelevantformalities.第十七条有下列情形之一的，乙方可以随时通知甲方解除本合同：PartyBmayterminatethisContractbygivinganoticetoPartyAanytimeifanyofthefollowingcircumstancesoccurs:在试用期内的；PartyBisstillintheprobationaryperiod;甲方以暴力、威胁或者非法限制人身自由的手段强迫劳动的；PartyAforcesPartyBtoworkbyviolence,

19、duressorillegalrestrictiontophysicalfreedom;甲方未按照本合同约定支付劳动报酬或者提供劳动条件的；PartyAfailstopaylaborremunerationorprovidelaborconditionsinaccordancewithrelevantclausesofthisContract.第十八条有下列情形之一的，本和同终止：ThisContractshallceasetobevalidinanyofthefollowingcircumstances:（一）合同期限届满；ThetermofthisContractexpires;（二）合同

20、约定的终止条件出现；ConditionsforterminationasstipulatedinthisContractappear;（三）乙方达到离休、退休、退职条件。PartyBsatisfiesresignationandretirementconditions.第十九条有下列情形之一的，甲方根据乙方在甲方工作年限和乙方解除本合同前12个月的平均工资，工作需满1年后支付1个月的经济补偿金：Clause19PartyAshallbeentitledtodissolvethisContractinanyofthefollowingcircumstance,providedhowevertha

21、tseverancepayshallbeprovidedaccordingtoPartyBsworkingyearsatPartyAandPartyBsaveragesalaryinthepasttwelvemonthspriortosuchdissolution.IfPartyBworksafullyear,suchseverancepayshallbeone-monthsalary.双方协商一致，由甲方解除本合同；TwopartiesheretoagreeuponconsultationtoletPartyAterminatethisContract;乙方不能胜任工作，经过培训或调整工作岗

22、位，仍不能胜任工作，由甲方解除本合同的；PartyBisincapableofthejobandremainsincapableaftertrainingorpositionadjustment.第二十条乙方违反本合同约定条件解除工作合同或违反保守商业秘密事项，给甲方造成经济损失的，应依法承担赔偿责任。Clause20PartyBshallassumecompensationliabilityforanyeconomiclosssustainedbyPartyAduetoPartyBsterminationofthisContractinviolationofthetermsandcondit

23、ionsagreedhereinorbreachofnon-disclosureobligationforbusinesssecrets.七、争议及其它DisputeandMiscellaneous第二十一条双方因履行劳动合同发生争议，当事人可以向本单位劳动争议调解委员会申请调解；调解不成的，应当自劳动争议发生之日起，60日内向劳动争议仲裁委员会提出书面申请。Clause21DisputesarisingfromorinconnectionwiththeperformanceofthelaborcontractbytwopartiesheretomaybefurnishedtoPartyAslabordisputemediationcommitteeformediation;ifmediationeffortfails,anapplicationmaybefiledtothelabordisputearbitration
