GeneralProvisions
Article1ThisLawisenactedforthepurposesofsafeguarding
nationalsecurityandinterest,performingnonproliferationandother
internationalobligations,andstrengtheningandregulatingexport
control.
Article2ThisLawshallapplywherethestateexercisescontrolon
theexportofdual-useitems,militaryproducts,nuclearandother
goods,technologies,servicesrelatedtosafeguardingnationalsecurity
andinterestorperformingnonproliferationandotherinternational
obligations(hereinaftercollectivelyreferredtoasthe"controlled
items'1).
Forthepurposesoftheprecedingparagraph,"controlleditems"
includetechnicalmaterialsandotherdatarelatedtotheitems.
ForthepurposesofthisLaw,Hexportcontrol'1meanstheprohibitive
orrestrictivemeasurestakenbythestateagainstthetransferof
controlleditemsfromtheterritoryofthePeople'sRepublicofChina
tooverseasandtheprovisionofcontrolleditemsbyacitizen,legal
person,orunincorporatedorganizationofthePeople'sRepublicof
Chinatoaforeignorganizationorforeigner.
ForthepurposesofthisLaw,''dual-useitems"meansgoods,
technologies,andservicesthatmaybeusedeitherforcivilpurposes
orformilitarypurposesortocontributetoanincreaseinmilitary
potential,especiallytodesign,develop,produceoruseweaponsof
massdestructionandtheirmeansofdeliveiy.
ForthepurposesofthisLaw,"militaryproducts'1meansthe
equipment,specialproductionequipment,andotherrelatedgoods,
technologies,andservicesusedformilitarypurposes.
ForthepurposesofthisLaw,"nuclear"meansnuclearmaterials,
nuclearequipment,non-nuclearmaterialsusedbyreactors,aswellas
relatedtechnologiesandservices.
Article3Exportcontrolshalladheretotheholisticviewofnational
security,safeguardinternationalpeace,balancesecurityand
development,andimproveadministrationandsendeesinrelationto
exportcontrol.
Article4Thestateshallimplementunifiedrulesforexportcontrol,
formulatingcontrollists,schedulesandcatalogues(hereinafter
collectivelyreferredtoas"thecontrollist'*),andpracticingexport
licensing,amongothers.
Article5ThedepartmentsoftheStateCouncilandtheCentral
MilitaryCommissionthatundertakeexportcontrolfunctions
(hereinaftercollectivelyreferredtoasthe"stateexportcontrol
authorities11)shallbeinchargeoftheexportcontrolworkas
mandatedbytheirdutiesandresponsibilities.Otherrelevant
departmentsoftheStateCouncilandtheCentralMilitary
Commissionshallundertaketheexportcontrol-relatedworkas
mandatedbytheirdutiesandresponsibilities.
Thestateshallestablishamechanismtocoordinateamongtheabove
mentioneddepartmentsinmajorissuesconcerningexportcontrol.
Thestateexportcontrolauthoritiesandtherelevantdepartmentsof
theStateCouncilshallworkcloselyandenhanceinformation
sharing.
Thestateexportcontrolauthoritiesshall,inconjunctionwiththe
relevantdepartments,establishanadvisorymechanismforexperts*
adviceonexportcontrol.
Thestateexportcontrolauthoritiesshouldissuesector-specific
guidelinesforexportcontrolatappropriatetimes,guidingexporters
toestablishandimprovetheirinternalcomplianceprogramsfor
exportcontrolandoperateinaccordancewithlawsandregulations.
Therelevantdepartmentsofpeople'sgovernmentsinprovinces,
autonomousregions,andmunicipalitiesdirectlyundertheCentral
Governmentshallundertakeexportcontrol-relatedworkin
accordancewithrelevantlawsandadministrativeregulations.
Article6Thestateshallstrengtheninternationalcooperationin
exportcontrolandparticipateindevelopinginternationalruleson
exportcontrol.
Article7Anexportermay,inaccordancewiththelaw,establishor
joinachamberofcommerce,association,oranyotherself-regulatory
organizationinagivensector.
Anysuchchamberofcommerce,association,orself-regulatory
organizationshallcomplywithlawsandadministrativeregulations,
provideitsmemberswithexportcontrol-relatedsendeesin
accordancewithitsarticlesofassociation,andplayacoordinating
andself-regulatoryrole.
ChapterII
ControlPolicies,theControlListandControlMeasures
Section1
GeneralRules
Article8Thestateexportcontrolauthoritiesshall,in
conjunctionwithrelevantdepartments,formulateexportcontrol
policiesamongwhichthoseonmajorissuesshallbesubmittedtothe
StateCouncilorboththeStateCouncilandtheCentralMilitary
Commissionforapproval.
Thestateexportcontrolauthoritiesmayassessthedestination
countriesorregionstowhichcontrolleditemsareexported,identify
therisklevel,andtakecontrolmeasuresbasedontheassessment.
Article9Thestateexportcontrolauthoritiesshall,inaccordance
withtheprovisionsofthisLawandotherrelevantlawsand
administrativeregulations,aswellasexportcontrolpoliciesand
prescribedprocedures,formulateandrevisethelistofcontrolled
itemsforexportinconjunctionwithrelevantdepartments,and
publishthelistinatimelymanner.
Forthepurposesofsafeguardingnationalsecurityandinterestor
performingnonproliferationandotherinternationalobligations,the
stateexportcontrolauthoritiesmay,upontheapprovaloftheState
CouncilorboththeStateCouncilandtheCentralMilitaiy
Commission,imposetemporarycontrolongoods,technologiesor
sendeesoutsidethecontrollist,andmakeanannouncementthereon.
Thetermofsuchtemporarycontrolshallnotexceedtwoyears.Bythe
timethetermoftemporarycontrolexpires,anassessmentshallbe
madeinatimelymannerand,basedontheassessmentresult,
adecisionshallbemadewhethertoterminatethetemporarycontrol,
extendtheperiodofthetemporarycontrol,orincludetheitems
subjecttothetemporarycontrolintheexportcontrollist.
Article10Forthepurposesofsafeguardingnationalsecurityand
interestorperformingnonproliferationandotherinternational
obligations,thestateexportcontrolauthoritiesmay,uponthe
approvaloftheStateCouncilorboththeStateCouncilandthe
CentralMilitaryCommission,workwithrelevantdepartmentsto
bantheexportofcertaincontrolleditems,ortheexportofcertain
controlleditemstoaspecificdestinationcountryorregion,ora
specificorganizationorindividual.
Article11Exportersofcontrolleditemsshallcomplywithprovisions
ofthisLawandotherrelevantlawsandadministrativeregulations.
Whereitisprovidedbylawthataccreditationisrequired
forexportingacontrolleditem,suchaccreditationshallbeobtained
first.
Article12Thestateshalladoptalicensingsystemfortheexportof
controlleditems.
Forexportofcontrolleditemssetforthintheexportcontrollistor
itemssubjecttotemporaiycontrol,anexportershallfilean
applicationforalicensewiththestateexportcontrolauthorities.
Forexportofgoods,technologiesandservicesotherthanthoseon
thecontrollistandthosesubjecttotemporarycontrol,anexporter
shallfileanapplicationforalicensewiththestateexportcontrol
authoritiesifitknows,shouldknow,orhasbeennotifiedbythe
stateexportcontrolauthoritiesthattherelevantgoods,technologies
andservicesmayposeanyofthefollowingrisks;
(1)Endangeringnationalsecurityorinterest;
(2)Beingusedtodesign,develop,produceoruseweaponsofmass
destructionandtheirmeansofdelivery;and
(3)Beingusedforterrorism.
Whereanexporterisunabletodeterminewhetherthegoods,
technologiesorservicestobeexportedfallwithinthescopeof
controlleditemssetforthherebyandconsultsthestateexportcontrol
authorities,thelattershallrespondinatimelymanner.
Article13Thestateexportcontrolauthoritiesshallreviewan
exporter'sapplicationforexportingacontrolleditemtodecide
whetherornottograntanapproval,bytakingintofullconsideration
thefollowingfactors:
(1)Nationalsecurityandinterest;
(2)Internationalobligationsandcommitments;
(3)Thetypeofexport;
(4)Thesensitivityofthecontrolleditem;
(5)Destinationcountryorregionoftheexport;
(6)Theenduserandenduseoftheexporteditem;
(7)Therelevantcreditrecordsoftheapplicantexporter;and
(8)Otherfactorssetforthbylawsandadministrativeregulations.
Article14Whereanexporterhasestablishedaninternalcompliance
programforexportcontrolwhichrunseffectively,thestateexport
controlauthoritiesmaygrantfacilitationtotheexporter,suchasa
generallicensefortheexportofcontrolleditems.Specific
measuresshallbeformulatedbythestateexportcontrolauthorities.
Article15Anexportershallsubmittothestateexportcontrol
authoritiescertificatesabouttheenduserandenduse,whichshallbe
issuedbytheenduserortherelevantgovernmentagencyofthe
countryorregionwheretheenduserislocated.
Article16Theenduserofacontrolleditemshallundertakenotto
changetheenduseoftherelevantcontrolleditemortransferittoany
thirdpartywithoutconsentofthestateexportcontrolauthorities.
Whereanexporterorimporterdiscoversthattheremaybeachange
ofenduserorenduse,theexporterorimportershallimmediately
reporttothestateexportcontrolauthoritiesaccordingtoapplicable
proxdsions.
Article17Thestateexportcontrolauthoritiesshallestablishrules
forthemanagementofrisksrelatedtoendusersandendusesof
controlleditems,conductassessmentandinspectiononendusers
andenduses,andstrengthenenduserandendusemanagement.
Article18Thestateexportcontrolauthoritiesshallestablishthe
restrictednamelistofimportersandenduserswhofallunderanyof
thefollowingcircumstances:
(1)Violatingtheenduserandendusemanagementrequirements;
(2)Mayendangernationalsecurityorinterest;or
(3)Usinganycontrolleditemforterrorism.
Withrespecttoimportersandendusersincludedinthecontrollist,
thestateexportcontrolauthoritiesmaytakenecessaiymeasures
suchasprohibitingorrestrictingthetradeofcontrolleditems,or
orderingasuspensionofexportingtherelevantcontrolleditems.
Anexportershallnottradewithanyimporterorenduseronthe
controllist.Whereanexporterdoesneedtotradewithsuch
animporterorenduserunderspecialcircumstances,theexporter
mayfileanapplicationwiththestateexportcontrolauthorities.
Whereanimporterorenduseronthecontrollist,aftertakingproper
measures,nolongerfallsintothecircumstancesspecifiedinthefirst
paragraph,itmayapplytothestateexportcontrolauthoritiestobe
removedfromthecontrollist.Thestateexportcontrol
authoritiesmay,accordingtoactualsituation,decidewhetherto
removetheimporterorenduserfromthecontrollist.
Article19Whereaconsignorofexportedgoodsoragentforcustoms
declarationexportscontrolledgoods,theconsignororagentshall
submitthelicenseissuedbythestateexportcontrolauthoritiestothe
Customsforinspectionandgothroughformalitiesofcustoms
declarationaccordingtotherelevantprovisionsoftheState.
Whereaconsignorofexportedgoodsfailstosubmitthelicense
issuedbythestateexportcontrolauthoritiestotheCustomsfor
inspection,theCustoms,withevidenceshowingthattheexported
goodsmayfallwithinthescopeofexportcontrol,shallquestionthe
saidconsignorandmayrequestthestateexportcontrolauthoritiesto
organizeidentification,andshallhandlethematterinaccordance
withlawbasedontheresultoftheidentificationconclusion.The
exportedgoodsshallnotbereleasedduringtheidentificationor
questioning.
Article20Noorganizationorindividualmayprovideagency,
freight,delivery,customsdeclaration,third-partye-commerce
tradingplatform,financialoranyotherserviceforanexporterwhen
theexporterisconductingactivitiesviolatingtheexportcontrollaws.
Section2
AdministrationofExportofDual-useItems
Article21Whenfilinganapplicationfortheexportofadual-use
itemwiththestateexportcontrolauthoritiesondual-useitems,an
exportershalltruthfullysubmittherelevantmaterialsaccordingto
provisionsoflawsandadministrativeregulations.
Article22Thestateexportcontrolauthoritiesondual-useitems
shallhandleapplicationsfortheexportofdual-useitems,and
shalldecidewhethertoapproveordisapprovesuchapplications
withinthestatutorytimeperiodafterreviewingthe
applicationseitherindependentlyorinconjunctionwiththerelevant
departmentsinaccordancewiththisLawandotherrelevantlawsand
administrativeregulations.Wherethedecisiontoapprove
anapplicationismade,anexportlicenseshallbeissuedbythelicense
issuingauthority.
Section3
AdministrationofExportofMilitaryProducts
Article23Thestateshallpracticeamonopolysystemfortheexport
ofmilitaryproducts.Anexportershallfirstbeaccreditedforthe
exportofmilitaryproductsandoperatewithinthebusinessscopeof
accreditation.
Suchaccreditationshallbegrantedbythestateexportcontrol
authoritiesonmilitaryproductsuponreview.
Article24Anexporterofmilitaryproductsshall,accordingtothe
controlpoliciesandthenatureoftheproductstobeexported,apply
tothestateexportcontrolauthoritiesonmilitaryproductsforreview
andapprovaloftheexportofsaidproductsaswellasthespecific
exportprogramsandcontracts.
Theexportofmajormilitaryproductsaswellasthespecificexport
programsandcontractsshallbesubjecttoreviewbythestateexport
controlauthoritiesonmilitaryproductsinconjunctionwithrelevant
departmentsandthereafterbesubmittedtotheStateCouncilandthe
CentralMilitaryCommissionforapproval.
Article25Beforeexportingmilitaryproducts,theexportershall
applytotherelevantexportcontroldepartmentofthestateon
militaryproductsforalicensetoexportthemilitaryproducts.
Whenexportingmilitaryproducts,theexportershallsubmittothe
Customsthelicenseissuedbytherelevantexportcontroldepartment
ofthestateonmilitaryproductsforinspectionandgothrough
formalitiesofcustomsdeclarationaccordingtotherelevant
provisionsofthestate.
Article26Anexporterofmilitaryproductsshallauthorizean
approvedmilitaryexporttransportcompanytotransportthemilitary
productstobeexportedandprovideotherrelatedservices.Specific
measuresshallbeformulatedbythestateexportcontrol
authoritiesonmilitary7productsinconjunctionwiththerelevant
departments.
Article27Anexporterorascientificresearchorproductionentityof
militaryproductsthatintendstoparticipateinaninternational
militaryproductexhibitionshallapplyforapprovalwiththestate
exportcontrolauthoritiesonmilitaryproductsinaccordancewith
relevantprocedures.
ChapterIII
SupendsionandAdministration
Article28Thestateexportcontrolauthoritiesshallconduct
supendsionandinspectionontheexportofcontrolleditemsin
accordancewiththelaw.
Thestateexportcontrolauthoritiesmaytakethefollowing
measureswheninvestigatingsuspectedviolationsofthisLaw:
(1)Enteringtheplaceofbusinessofthepartyunderinvestigationor
anyotherrelevantpremiseforinspection;
(2)Questioningthepartyunderinvestigation,oranyinterestedparty
orotherrelevantorganizationorindividual,andrequiringthemto
explainthemattersunderinvestigation;
(3)Consultingandmakingcopiesoftherelevantdocumentation,
agreements,accountbooks,businesscorrespondenceandother
documentsandmaterialsofthepartyunder
investigationoranyinterestedpartyorotherrelevantorganizationor
individual;
Inspectingthemeansoftransportusedforexport,stoppingthe
loadingofsuspecteditems,ororderingthereturnoftheitemsthat
havebeenillegallyexported;
(5)Sealinguporseizingitemsinvolvedinacase;and
(6)Checkingthebankaccountofthepartyunderinvestigation.
ThemeasuressetforthinSubparagraph(5)or(6)ofthepreceding
paragraphshallbetakenwiththewrittenapprovalofthepersonin
chargeofthestateexportcontrolauthorities.
Article29Thestateexportcontrolauthoritiesshallperformtheir
dutiesinaccordancewiththelaw,andtherelevantdepartmentsof
theStateCouncil,localpeople'sgovernmentsandtheirrelevant
departmentsshallprovideassistance.
Wherethestateexportcontrolauthorities,independentlyorin
conjunctionwithrelevantdepartments,conductaninspectionor
investigationinaccordancewithlaw,therelevantorganizationsand
individualsshallcooperateandmaynotrefusetoacceptor
obstructtheinspectionorinvestigation.
Thestateorgansandtheirstaffmembersconductinganinspectionor
investigationshallhavetheobligationtokeepconfidentialanystate
secret,tradesecret,personalprivacyorpersonalinformationthathas
cometotheirknowledgeduringtheinvestigation.
Article30Forthepurposesofstrengtheningtheadministrationof
theexportofcontrolleditemsandpreventingtherisksofviolating
thelawsabouttheexportofcontrolleditems,thestateexportcontrol
authoritiesmaytakemeasuressuchasholdingadmonitorytalksand
issuingwarningletters.
Article31Anyorganizationorindividualshallhavetherightto
reportanysuspectedviolationofthisLawtoanexportcontrol
departmentofthestate,andtheexportcontroladministrative
departmentofthestatereceivingsuchareportshallhandlethe
matterinatimelymannerinaccordancewiththelawandshallkeep
theinformantconfidential.
Article32Thestateexportcontrolauthoritiesshall,inaccordance
withinternationaltreatiesconcludedoraccededtoorbasedonthe
principleofequalityandmutualbenefits,conductcooperationand
exchangeinexportcontrolv\dthothercountriesorregionsand
internationalorganizations.
AnyorganizationorindividualwithintheterritoryofthePeople's
RepublicofChinashallcomplywiththerelevantlawswhen
providingexportcontrol-relatedinformationtopartiesoverseas,and
noorganizationorindhddualshallprovidesuchinformationwhereit
mayendangernationalsecurityorinterest.
ChapterIV
LegalLiabilities
Article33Anexporterthatengagesintheexportofacontrolled
itemwithoutaccreditationthereofshallbegivenawarningandbe
orderedtoceasetheillegalact,withanyillegalgainstherefrom
confiscated,andshallbefinednotlessthanfivetimesbutnotmore
thantentimestheillegalturnoveriftheillegalturnoveris500,000
yuanormore,ornotlessthan500,000yuanbutnotmorethanfive
millionyuanifthereisnosuchillegalturnoverortheillegalturnover
islessthan500,000yuan.
Article34Anexporterthatcommitsanyofthefollowingactsshall
beorderedtoceasetheillegalact,withanyillegalgainstherefrom
confiscated,andshallbefinednotlessthanfivetimesbutnotmore
thantentimestheillegalturnoveriftheillegalturnoveris500,000
yuanormore,ornotlessthan500,000yuanbutnotmorethanfive
millionyuanifthereisnosuchillegalturnoverortheillegalturnover
islessthan500,000yuan.Ifthecircumstancesareserious,the
exportershallbeorderedtoceasebusinessoperationforrectification,
orevenbediscreditedfortheexportofrelevantcontrolleditem:
(1)Exportinganycontrolleditemwithoutalicense;
(2)Exportingacontrolleditembeyondthescopesetforthinthe
exportlicense;and
Exportinganitemthatisprohibitedtoexport.
Article35Wherealicensefortheexportofanycontrolleditemis
obtainedbyfraud,bribery,oranyotherimpropermeans,oris
illegallytransferred,thelicensingshallberevoked,withtheexport
licensesurrenderedandtheillegalgainstherefromconfiscated,and
theviolatorshallbefinednotlessthanfivetimesbutnotmorethan
tentimestheillegalturnoveriftheillegalturnoveris200,000yuan
ormore,ornotlessthan200,000yuanbutnotmorethantwo
millionyuanifthereisnosuchillegalturnoverortheillegalturnover
islessthan200,000yuan.
Wherealicensefortheexportofanycontrolleditemisforged,
altered,ortraded,theillegalgainstherefromshallbeconfiscated,
andtheviolatorshallbefinednotlessthanfivetimesbutnotmore
thantentimestheillegalturnoveriftheillegalturnoveris50,000
yuanormore,ornotlessthan50,000yuanbutnotmorethan
500,000yuanifthereisnosuchillegalturnoverortheillegal
turnoverislessthan50,000yuan.
Article36Whoeverwiththeknowledgeofanexporter'sviolationof
exportcontrollawsstillprovidestheexporterwithagency,freight,
delivery,customsdeclaration,third-partye-commercetrading
platform,financial,orotherservicesshallbegivenawarningandbe
orderedtoceasetheillegalact,withanyillegalgainstherefrom
confiscated,andshallalsobefinednotlessthanthreetimesbut
notmorethanfivetimestheillegalturnoveriftheillegalturnoveris
100,000yuanormore,orbefinednotlessthan100,000yuanbut
notmorethan500,000yuanifthereisnosuchillegalturnoverorthe
illegalturnoverislessthan100,000yuan.
Article37Anexporterthattradeswithanyimporterorenduser
ontherestrictednamelistinviolationofthisLawshallbegivena
warningandbeorderedtoceasetheillegalact,withanyillegal
gainstherefromconfiscated,andshallbefinednotlessthan10times
butnotmorethan20timestheillegalturnoveriftheillegalturnover
is500,000yuanormore,ornotlessthan500,000yuanbut
notmorethanfivemillionyuanifthereisnosuchillegalturnoveror
theillegalturnoverislessthan500,000yuan.Ifthecircumstances
areserious,theexportershallbeorderedtoceasebusinessoperation
forrectification,orevendiscreditedfortheexportoftherelevant
controlleditem.
Article38Anexporterthatrefusestoacceptorobstructsan
inspectionshallbegivenawarningandfinednotlessthan100,000
yuanbutnotmorethan300,000yuan.Ifthecircumstancesare
serious,theexportershallbeorderedtoceasebusinessoperationfor
rectification,orevendiscreditedfortheexportoftherelevant
controlleditem.
Article39Fromthedatewhenthedecisionpunishinganexporter
forviolationofthisLawcomesintoforce,thestateexportcontrol
authoritiesmayrefusetoacceptanyapplicationforanexportlicense
filedbytheexporterwithinfiveyears;andthedirectlyliable
personinchargeandotherdirectlyliablepersonsmaybeprohibited
fromconductingtherelevantexportoperationsforfiveyears,orfor
life,ifsuchpersonsareheldcriminallyliableforanyviolationofthe
exportcontrollaws.
Thestateexportcontrolauthoritiesshall,inaccordancewiththelaw,
includeanyviolationofthisLawbyanexporterinitscreditrecords.
Article40Exportcontrol-relatedviolationsassetforthinthisLaw
shallbepunishedbystateexportcontrolauthorities.Whereany
otherlaworadministrativeregulationprovidesthatanexport
control-relatedviolationshallbepunishedbytheCustoms,the
CustomsshallimposepunishmentinaccordancewiththisLaw.
Article41Anorganizationorindividualmayapplyfor
administrativereconsiderationagainstthedecisionnottoapprove
imposedthereuponbythestateexportcontrolauthorities.The
decisionofadministrativereconsiderationshallbefinal.
Article42,Anystatefunctionaryengagedintheexportcontrolthat
neglectsduty,practicesfavoritismorfraud,orabusespowershallbe
imposedwithadisciplinaryactioninaccordancewiththelaw.
Article43Anyexportcontrol-relatedviolationasissetforthofthis
Lawwhichendangersnationalsecurityorinterestshallbepunished
inaccordancewithotherrelevantlawsandadministrativeregulations,
inadditiontobeingpunishedinaccordancewiththisLaw.
Whoever,inviolationofthisLaw,exportsanycontrolleditem
prohibitedtobeexportedbythestateorexportsanycontrolleditem

Article44Whereanyorganizationorindividualoutsidethe
territoryofthePeople'sRepublicofChinaviolatestheprovisionsof
thisLawontheadministrationofexportcontrol,whichendangers
thenationalsecurityandinterestofthePeople'sRepublicofChina,
orobstructsthefulfillmentofnonproliferationandother
internationalobligations,theorganizationorindividualshallbeheld
legallyliableandbepunishedinaccordancewiththelaw.

Article45Thetransit,transshipment,throughshipment,or
re-exportofcontrolleditems,ortheexportofcontrolleditemsto
overseasfromareasunderspecialcustomssupervisionsuchas
bondedareasandexportprocessingzones,aswellasbondedplaces
undercustomssupervisionsuchasexportsupervisionwarehouses
andbondedlogisticscenters,shallbegovernedbytherelevant
provisionsofthisLaw.
