房屋租赁合同英文

ThisResidentialLeaseAgreement(“Agreement”)isenteredintoasof[EffectiveDate]byandbetween[LandlordFullLegalName],whosemailingaddressis[LandlordMailingAddress](“Landlord”),and[TenantFullLegalName(s)],whosecollectivemailingaddressis[TenantMailingAddress(es)](“Tenant”).

2.PropertyBeingLeased:LandlordleasestoTenanttheresidentialpropertylocatedat[FullPropertyAddress],includingallfixtures,appliances,andfurnishingsmutuallyagreeduponpriortosigningthisAgreement(the“Premises”).TenantacknowledgesthePremisesareingood,rentableconditionasoftheEffectiveDate,exceptforanypre-existingdefectsdocumentedinwritingbybothparties.

3.TermofLease:ThisAgreementshallcommenceon[LeaseStartDate]andendon[LeaseEndDate](“InitialTerm”),constitutingafixed-termlease.Unlesseitherpartyprovideswrittennon-renewalnoticeatleast[30/60]dayspriortotheendoftheInitialTermoranyrenewalterm,thisAgreementwillautomaticallyconverttoamonth-to-monthtenancyunderidenticalterms,exceptforrentadjustmentspermittedunderSection3.2.

4.RentPayments:

4.1TenantshallpayLandlordmonthlyrentof[MonthlyRentAmount]via[authorizedpaymentmethod,e.g.,certifiedcheck,onlinebanktransfer]onthe[1st]dayofeachcalendarmonth.

4.2Anylaterentpaymentsreceivedaftertheduedateshallincuralatefeeequalto[5%ofmonthlyrent/$XX]perday,orthemaximumamountallowedbyapplicablelocal/statelaw,whicheverislower.

4.3Allrentpaymentsshallbesentto[Landlord’sdesignatedpaymentaddressoronlineportal]asspecifiedbyLandlordfromtimetotime.

5.SecurityDeposit:

5.1PriortotakingoccupancyofthePremises,TenantshallpayLandlordasecuritydepositequalto[1-2months’totalrent](“Deposit”).

5.2LandlordshallholdtheDepositinaseparate,interest-bearingtrustaccountcompliantwithapplicablestate/locallaws,unlessotherwisepermittedbylaw.

5.3Within[14/30]daysofTenant’sfullvacateofthePremisesandtheendofthisAgreement,LandlordshallreturntheDepositminusanyunpaidrent,damagestothePremisesbeyondnormalwearandtear,orothersumsowedbyTenantunderthisAgreement.LandlordshallprovideTenantwithanitemizedlistofalldeductionsalongsidetheremainingDepositbalance.

6.Tenant’sResponsibilities:

6.1TenantshallmaintainthePremisesinaclean,sanitarycondition,disposeofalltrashandwasteperlocalregulations,andpromptlyrepairanydamagecausedbyTenant,theirguests,orapprovedpets.

6.2Tenantshallnotalter,remodel,orinstallanyfixturesorimprovementstothePremiseswithoutLandlord’spriorwrittenconsent.

6.3Tenantshallpayallutilities,includingelectricity,gas,water,internet,andtrashremoval,directlytorespectiveserviceprovidersduringthetermofthisAgreement,unlessotherwiseagreedinwritingbybothparties.

6.4TenantshallnotengageinanyillegalactivitiesonthePremises,andshallupholdthequietenjoymentrightsofneighboringtenantsandpropertyowners.

6.5TenantshallnotkeepanypetsonthePremiseswithoutLandlord’spriorwrittenconsent,andshallcomplywithallpet-relatedtermsifapprovalisgranted.

7.Landlord’sResponsibilities:

7.1LandlordshallmaintainthePremisesinasafe,habitableconditionthroughoutthetermofthisAgreement,includingrepairingstructuraldamage,plumbing,heating,andelectricalsystemsasneeded.

7.2Landlordshallprovideatleast[24hours]writtennoticepriortoenteringthePremisesforinspections,repairs,orshowingstoprospectivetenantsorbuyers,exceptincasesofemergencyrequiringimmediateentry.

7.3LandlordshallgrantTenantreasonableaccesstothePremisesandshallnotunreasonablywithholdconsentforvalidTenantrequests.

8.SublettingandAssignment:TenantshallnotsubletanyportionofthePremisesorassignthisAgreementtoanotherpartywithoutLandlord’spriorwrittenconsent,whichconsentshallnotbeunreasonablywithheld.

9.Insurance:Tenantshallobtainandmaintainarenter’sinsurancepolicywithaminimumcoveragelimitof[MinimumPersonalPropertyandLiabilityCoverageAmount]throughoutthetermofthisAgreement.LandlordshallmaintainacommercialpropertyinsurancepolicyforthePremisesanditsstructuralcomponents.

10.DefaultandTermination:

10.1IfTenantfailstopayrentformorethan[NumberofConsecutiveDays,e.g.,5]days,orbreachesanymaterialtermofthisAgreement,LandlordmayprovideTenantwithawrittennoticeofdefaultanddemandcurewithin[NumberofDays,e.g.,3].IfTenantfailstocurethedefaultwithinthespecifiedperiod,LandlordmayterminatethisAgreementandinitiateevictionproceedingsperapplicablelaw.

10.2IfLandlordbreachesanymaterialtermofthisAgreement,TenantmayprovideLandlordwithawrittennoticeofdefaultanddemandcurewithin[NumberofDays,e.g.,10].IfLandlordfailstocurethedefaultwithinthespecifiedperiod,TenantmayterminatethisAgreementandseekdamagesaspermittedbylaw.

10.3EitherpartymayterminatethisAgreementduringtheInitialTermonlyintheeventofamaterialbreachbytheotherparty,orasotherwiseallowedbyapplicablelocal/statelaw.

11.GoverningLawandDisputeResolution:ThisAgreementshallbegovernedbyandconstruedinaccordancewiththelawsofthestateof[State/Province]andapplicablefederallawsoftheUnitedStates.AnydisputearisingfromthisAgreementshallfirstberesolvedthroughnon-bindingmediation;ifmediationfails,disputesshallberesolvedviabindingarbitrationorlitigationinthecourtsof[County/State],asmutuallyagreedbytheparties.

12.GeneralProvisions:

12.1ThisAgreementconstitutestheentireunderstandingbetweenthepartiesandsupersedesallpriororalorwrittenagreementsrelatingtotheleaseofthePremises.

12.2NomodificationtothisAgreementshallbevalidunlessi
