RENT CONTENT 租 赁 地 址 : 甲 方 将 其 位 于_的商铺租赁给乙方作2 / 25 商业经营用途。甲方对所出租的商铺具有合法产权、并出示房产证、身份证明等文件;乙方也应提供身份证明文件。双方可复印对方文件备存。所有复印 件仅供本次租赁使用,不得挪作它用。 LOCATION: Part B rent the shop located on_ from Part A for commercial business purposes. The shop is the legal property owned by Part A, and showed the property ownership certificate , identifications and other documents which needed for law; Party B should also provide identification. The two parties can copy each other documents for keeping. All copies can use for the rent affairs only, and can not be used for any other purpose. 租赁面积:甲方租赁给乙方的商铺建 筑面积为 _平方米 ,使用面积为 _平方米。甲方将该商铺交付乙方使用时 ,商铺结构及配套设施为 :简装修。承租期内乙方在不改变和影响房屋整体结构的前提下,可进行装修装饰、对室内空间进行重新划分;若期满不续租,其装修材料由乙方自行处理,若拆除,其费用由乙方自理。 AREA: The area of the shop is _ , in this 3 / 25 area, _ can be used. When Part A put into serviced the shop to Part B, the shop building structure and the supporting equipments was: SIMPLE DECORATION. During the rent time, Part B have the rights to decorate the shop and redistrict the space but can not change and influrence the building structure; When the contract be expired and do not renew, Part B have all rights to handle the decorations, if dismantle the decorations, Part B pay all the cost. 第二条 租赁期限 2. TERM OF CONTRACT 租赁期限:甲乙双方商定 ,租赁期限自年月日起至24: 00 止 ,共力影响导致的合同终止情形外,任何一方不得破坏租赁期限的完整和连续。 CONTRACT PERIOD: After both parties agreed, the term of contract is: stcontract terminated and the force majeure due to the influence of the contract to be terminated, either parties can not destroy the integrity and continuity of the contract. 装修免租期:甲方承诺自交付商铺给乙方的第一个月给乙方做装修,免其租金。即自 2016 年 06 月 01 日起 2016年 07 月 01 日止。租金从次月开始收取。 4 / 25 RENTAL-FREE PERIOD: Part A promised to make the first month to be RENTAL-FREE PERIOD after the shop be able to use for Part B. The period stst 续租:合同期满后 ,甲方如继续出租该商铺 ,则同等条件下 ,乙方可享有优先承租权。乙方如有意续租 ,可于合同期满前 30天向甲方提出 ,双方另行协商 ,订立新的租赁合同。 CONTRACT EXTENSION: After the contract be expired, if the shop still be able to be rent, Part B have the priority right to rent. If Part B have the mind contract be expired, after negotiated, create the new rent contract. 合同的中止 CONTRACT TERNIMATION 乙方有如下情形之一时 ,甲方有权提前中止合同 ,收回商铺: a, 乙方利用该商铺从事非法活动或损害公共利益的; b, 乙方拖欠租金超过 Under the follow status of Part B, Part A have the rights to terminate the contract, take back the shop: a, Part B use the shop to do the illegal or public-interests damaging 5 / 25 activities; 甲方有如下情形之一时 ,乙方有权提前中止合同: a,甲方不能提供商铺或提供 商铺不符合条件,严重影响乙方正常使用; b,甲方未尽房屋修缮义务,严重影响乙方正常使用的。 Under the follow status of Part A, Part B have the rights to terminate the contract: a, Part A can not offer the shop or the shop mismatch conditions, seriously affect the normal using of Part B; b, Part A does not matter the obligations, seriously affect the normal use of Part B. 第三条 租金及其支付方式和其它费用 3. RENTAL, MODE OF PAYMENT AND OTHER CHARGES 年租金总额:甲乙双方商定 ,租赁期内该商铺的年租金为¥ _,合同期限内无浮动。 TOTALOF YEAR RENTAL: After both parties negotiated, the year rental is ¥ _ during the contract period, and no fluctuate. 租金的支付 :租金按年计算 ,按半年收付。乙方在6 / 25 每半年到期后月份的 5 日前将下半个年度租金以现金或转帐方式一次交付到甲方。甲方收款后应提供给乙方有效的收款凭证。 RENTAL PAYMENT: The rental calculation is ANNUAL RENTAL. Part B pay the rental as CASH or BANK TRANSFER to Part A in 5th of the next month after every half year period expired in one time. Part have the obligations to offer the valid voucher to Part B. 首期款的支付 :订立本合同后甲方将商铺交付乙方装修时 ,乙方一次向甲方交纳相当于 租金总额 10%共计¥ _;免租期过后,乙方一次性补交租金支付周期内的当期房租; THE MODE OF PAYMENT OF FIRSTINSTALLMENT: When Part A put into service shop to Part B for decorating after this contract be signed, Part B pay 10% of total rental in one time, it is: ¥ _ ; After RENTAL-FREE PERIOD, Part B pay the remainder rental in this RENTAL PERIOD to Part A in one time; 水、电费及其他公用事业费 :合同期内 ,政府对租赁物征收的有关税、费项 ,由甲方负责缴交,该商铺的卫生7 / 25 费、电费、水费及经营活动产生的一切费用由乙方负责 ,乙方应如期足额缴交上述应缴费用 ,如因乙方欠费造成向甲方追缴时 ,甲方有权向乙方追缴。 WATER,ELECTRIC AND OTHER PUBLIC UTILITY CHARGES: During contract period, Part A pay all the tax and charges, etc government revenue from the shop, and Part B pay the clean, electric, water and all the charges because the business, Part B have the obligations to pay the charges enough and on time, if Part A be disgorged from other parties cause Part B arrears, Part A have the rights to disgorge from Part B. 合同签订时水电表使用情况: 水表: _吨 电表: _度 合同签订时最近一期水电费缴纳凭据经双方签字确认后以附件形式加入本合同。 The status of water and electric meters when contract be signed: WATER METER: _ TON ELECTRIC METER: _KWH The copies of the latest water and electric charged voucher be confirmed and signed by both parties 8 / 25 then add into the contract as annex. 第四条 招牌设置 4. SHOP SIGN SETTING 甲方同意乙方在符合国家法律、法规、政府规章和规范性文件的前提下,在租赁商铺的室内外安装设置带有其公司标志的招牌等广告装置,并协助乙方做好跟物业装修申请、施工以及广告设 置的交涉工作。 Part A agreed Part B set the shop signs and other advertising equipments with company logo in outside of the shop comply with the state laws, regulations, government regulations and normative documents, and Part A have the obligations to assist Part B to apply to the property management company, construction and other signs setting works needed negotiate with other parties. 第五条 双方的责任和权利 5. OBLIGATIONS AND RIGHTS 甲方的责任和权利 OBLIGATIONS AND RIGHTS OF PART A 租 赁 合 同 - LEASE CONTRACT 出租人 LESSOR: _ 9 / 25 电话 Tel : _ 手机 Mobile :_ 承租人 LESSEE: 通讯地址 Mail Add: 电话 Tel: 传真 Fax: 住客姓名 The occupants of the premises will be: 甲、乙双方经协商一致,订立本合同。合同内容如下: This lease has been mutual agreed and set up by PARTY A and PARTY B as the following: 1. 出租物业 The Premises to be leased are described as follows: 地址 Location: 面积 Area: 电话 Tel: _条 IDD 直线 , _ IDD lines 2 租金 Rental: 租金每月为 元整 , 形式支付 PARTY B shall pay as rent the sum of ; per month. 租金包括家具和电器的配置 , 供暖费 , 物业管理费、水费 ,电费 ,+煤气费、健身卡、卫星收视费。 The Rent includes the Furniture、 the Electrical Appliances , 10 / 25 Heating Fee, Management fee, water fee , electricity fee, gas fee, Fitness card, Satellite TV service fee. 租金应在入住前及此后每月的 号前支付。甲方应在收到租金后向乙方开具正式发票。甲方应每月提前向乙方发出支付租金的书面通知。 The first rental shall be paid before moving in and the following rental shall be paid before the th of each succeeding 1 month term. PARTY A shall issue to PARTY B official invoice upon receiving the rental. Party A shall send prior written notice to Party B for monthly rental payment request. 租金以人民币支票或转账形式支付 . Rental is payable in Ren Min Bi by check or by bank transfer. 在本租约有效期内,租金不予调整。 Rent will not be modified during the term of this Lease Agreement. 3 押金 Deposit: 乙方须支付相当于两个月房租的押金 , 以人民币支票或转帐形式支付)。甲方应在收到押金后向乙方开具统一收据。 A deposit of two months equivalent rental 11 / 25 shall be paid by PARTY B in RMB by check or by bank transfer. PARTY A shall issue to PARTY B official receipt upon receiving the deposit. 押金在合同终止后 10天内由甲方以相同币种全额退还给乙方。如果延期返还,则每延期一日,按每日万分之四支付给乙方利息。 The deposit shall be refundable in full amount in 10 days after the contract expiration, in same currency and excluding interest thereupon. In case PARTY A delays the refund of the deposit, PARTY A shall pay interest to PARTY B at the rate of % per day of delay. 甲方应按时付清各种帐单。若以上出租房屋及其家具、设备等因乙方原因出现遗失或非正常的损坏,乙方应负责赔偿。 PARTY A shall pay off on time all the bills due. In case there is any loss or unusual damage to the furnishings, contents or the rental premises due to PARTY B s reason, PARTY B shall compensate for it. 4 租期 Lease term: 乙方租用出租房屋期限为 1 年,即自 年 月 日至 年 月 日。 From 16 July XX to 15 July XX for one year. 12 / 25 5 出租人的责任 PARTY A s obligation: 3 甲方声明及保证甲方为该出租房屋的合法拥有人,有合法地位出租此房屋,并就出租事宜已取得有关方面的批准。 PARTY A assures to be the legal owner of the leased premises, to have the necessary legal capacity to lease it, and PARTY A action has been ratified by the authorities concerned. 租赁期内,若甲方出售该出租房屋导致该出租房屋所有权发生转移 ,甲方须保证本合同能继续执行。 In case PARTY A sells the premises during the lease which leads to the premises ownership be transferred, PARTY A shall ensure that the said contract will be implemented continuously. 甲方须按时将清洁状况良好的出租房屋交付乙方使用,保证在租赁期内出租房屋内的各项设施能正常使用。 PARTY A shall hand over the said premises to PARTY B on time and assure the said premises will be cleaned and in good status during the lease term. 甲方有义务负责 出租房屋及设施的正常维护和保养,如房屋或设施非因甲方原因出现故障,甲方应在收到乙方通知后二十四小时内自行或通过其他方式解决故障,否13 / 25 则,乙方有权雇佣第三方进行维修,由甲方承担所有费用并承担相关责任。由于不可抗力、自然损耗或乙方以外的原因造成的损坏,亦由甲方承担有关费用。 PARTY A shall bear the responsibility of the said premises normal repairs and maintenance, and pay the cost related. In case the premises or facilities are in bad conditions not due to the reason of PARTY B, PARTY A shall complete the repair work within 24 hours upon receipt of the notice from PARTY B. Otherwise, PARTY B shall have the right to hire any third parties for the repair work at the cost of PARTY A. The cost of repairs to the said premises, if damaged by Force Majeure reasonable wear and tear or by accidents beyond PARTY B S control, should also be borne by PARTY A. 租赁期内,在乙方遵守合同及支付租金的前提下,未经乙方允许,甲方不得进入该 出租房屋。 During the lease, PARTY A shall not get in the said premises without PARTY B S permission if PARTY B has been carrying out the contract normally. 甲方应督促管理公司向乙方提供足够的服务,如冷水、热水、煤气 ,电的供应及各种设备的正常工作。 Party A 14 / 25 shall direct Property Management Company to provide sufficient and continuous services to Party B, including provision of cold water, hot water, gas and electricity and ensure proper maintenance of equipment therein. 房产税及与租赁有关的所有税费由甲方承担。 Premises tax and other leasing related taxes shall be paid by PARTY A. 6 承租方的责任 PARTY B S obligations: 乙方申明及保证其在中国拥有合法居留权,并按有关规定办理必要的居住登记手续。 PARTY B assures to have the legal right of residence in China, and shall complete the residential formalities complying with the local regulations. 住客应按时支付电话费含上网费、水电煤气费。 The occupant shall pay the telephone bills and internet fee, extra water electricity gas fee on time. 乙方只能将出租房屋用做住宅,不得将之用作公司及代表处的注册地址,亦不可作为公开的办公室。 The premises are limited for residential use only by PARTY B, and are prohibited from registering as legal address for any company or agency, or using as public office. 15 / 25 乙方不得在出租房屋内进行违反法律及政府对出租房屋用途有关规定的行为。 PARTY B shall not carry in the premises any unlawful or illegal activities which are not allowed according to the leasing regulations from the government. 租赁期内,未经甲方书面同意,乙方不得将出租房屋部分或全部转租他人。 PARTY B shall not partly or totally sublet the said premises without the written permission from PARTY A. 若因乙方使用不当或不合理使用,出租房屋及其内的设施出现损坏或发生故障,乙方应 及时联络管理机构或甲方进行维修,并负责有关维修费用 . The damage of the premises or the fittings that are within the control of PARTY B shall be borne by PARTY B, and PARTY B shall contact the management office or PARTY A instantly. 租赁期内,乙方对出租房屋进行装修或增加水、电、消防等设施,须经甲方同意并经 有关部门批准,并由甲方执行监理,所需费用由乙方承担。双方解约时,乙方不能移走自行添加的结构性设施,甲方亦不必对上述添加设施进行补16 / 25 偿。 PARTY B, upon written permission of PARTY A, may make additions or alterations dealing with water, electricity supply or fire protection, at his own expense, subject to necessary permits or licenses required by the authorities concerned and under the supervision of PARTY A .No structural alterations or additions can be removed from the premises upon the expiration of this contract. No reimbursement for the said additions. 乙 方有权在墙壁上悬挂画、图片或其他装饰性物品。合同履行期限届满或提前解约时,甲方应承担费用拔掉钉子、粉刷墙壁或使墙壁恢复原状,并承诺不以此为由扣留乙方的押金。 PARTY B is entitled to hang pictures, paintings or other decorative articles on the walls. Upon expiration or early termination of the contract, PARTY A shall bear the cost to remove the nails, repaint the wall or restore the wall to the original state, and PARTY A shall not retain PARTY B S deposit for the reason of doing things above. 租赁合同期满的前一个月内,经合理事先书面通知,17 / 25 乙方应允许甲方或其授权人 引领潜在客人参观在出租房屋。 During the last month of the contract, after reasonable prior written notice to PARTY B, PARTY A or his nominee shall be allowed to show the said premises to the potential clients. 租赁期满,若甲,乙双方未达成续租协议,乙方应于租期届满时或之前迁离出租房屋并将钥匙及清理干净的房屋归还甲方 . PARTY B shall return the premises in a clean condition to PARTY A at the expiration of the contract if there is no renewal thereupon. 7 提前解约 Early termination: 六个月后,乙方如要退租,应提前一个月书面通知甲方终止本租约。在此情况下,甲方应在本租约终止后十日内将押金全额退还乙方。 After six months, Party B may, upon one month advance written notice to Party A, terminate this Tenancy Agreement without any liabilities. Under this circumstance, Party A shall return the deposit in full to Party B within ten days after the termination. 18 / 25 若因自然界的不可抗力,如火灾、洪水、台风、地震、战争等意外损害导致出租 房屋无法居住,合同即自动终止,甲、乙双方互不承担责任。 If the said premises are so damaged by force majeure that it s no longer habitable, the contract shall be terminated automatically. Neither PARTY A nor PARTY B shall bear any responsibility to each other. 8 续租 Renewal: 租赁期满,乙方有优先续租权,但须提前一个月通知甲方,并安排签订续租合同。 PARTY B retains the priority to renew this lease upon expiration , while one-month prior notice to PARTY A is necessary, and PARTY A shall arrange the signature for the renewal contract. 9 争议的解决 Dispute Resolution: 9 1 本合同适用法律为中华人民共和国相关法律。 The contract is governed by the laws of the People s Republic of China. 9 2 在履行本合同过程中产生的任何争议由双方协商解决,协商不成,可向中国国际经济贸易仲裁委员会申请仲裁。 In case of any dispute arising out of the 19 / 25 performance of this Contract, PARTY A and PARTY B shall consult together to reach unanimity, otherwise both parties can submit the dispute to the China International Economic and Trade Arbitration Commission for arbitration. 10 其他 Others: 本合同以中英文两种文字拟成,两种文本同等有效 。 The contract is drawn in both Chinese and English versions. Both texts have equal effect. 本合同一式二份,甲、乙双方各执一份。 Two copies of the contract will be drawn and remained in the possession of PARTY A & PARTY B. 本合同自签定之日起生效。 The contract shall come into force on the date of signature. 本合同的附件是本合同必不可少的组成部分。附件一列明的物品在甲、乙双方核实签字后生效。 The appendix is an indivisible part of this contract.
