GENERALPROVISIONSSection 1. ThisLawisformulatedinaccordancew

3、iththeConstitutioninordertoprotectthelegitimaterightsandinterestsoflabourers,readjustlabourrelationship,establishandsafeguardalaboursystemsuitedtothesocialistmarketeconomy,andpromoteeconomicdevelopmentandsocialprogress.Section 2. ThisLawappliestoallenterprisesandindividualeconomicorganizations(herea

4、fterreferredtoasemployingunits)withintheboundaryofthePeoplesRepublicofChina,andlabourerswhoformalabourrelationshiptherewith.Stateorgans,institutionalorganizationsandsocietiesaswellaslabourerswhoformalabourcontractrelationshiptherewithshallfollowthisLaw.Section 3. Labourersshallhavetherighttobeemploy

5、edonanequalbasischoose occupations, obtain remuneration holidays and leaves, obtain protection receive training in vocational skills, and submit applications for settlement relating to labour as stipulated by law.for their labour, take rest, haveof occupational safety and health,enjoy social insuran

6、ce and welfare,of labour disputes, and other rightsLabourersshallfulfiltheirlabourtasks,improvetheirvocationalskills,followrulesonoccupationalsafetyandhealth,andobservelabourdisciplineandprofessionalethics.Section 4. Theemployingunitsshallestablishandperfectrulesandregulationsinaccordancewiththelaws

7、oastoensurethatlabourersenjoytherighttoworkandfulfilllabourobligations.Section 5. TheStateshalltakevariousmeasurestopromoteemployment,developvocationaleducation,laydownlabourstandards,regulatesocialincomes,perfectsocialinsurancesystem,coordinatelabourrelationship,andgraduallyraisethelivingstandardof

8、labourers.Section 6. TheStateshalladvocatetheparticipationoflabourersinsocialvoluntarylabourandthedevelopmentoftheirlabourcompetitionsandactivitiesofforwardingrationalproposals,encourageandprotectthescientificresearchandtechnicalrenovationengagedbylabourers,aswellastheirinventionsandcreations;andcom

9、mendandawardlabourmodelsandadvancedworkers.Section 7. Labourersshallhavetherighttoparticipateinandorganizetradeunionsinaccordancewiththelaw.TradeUnionsshallrepresentandsafeguardthelegitimaterightsandinterestsoflabourers,andindependentlyconducttheiractivitiesinaccordancewiththelaw.Section 8. Labourer

10、sshall,throughtheassemblyofstaffandworkersortheircongress,orotherformsinaccordancewiththeprovisionsoflaws,rulesandregulations,takepartindemocraticmanagementorconsultwiththeemployingunitsonanequalfootingaboutprotectionofthelegitimaterightsandinterestsoflabourers.Section 9. Thelabouradministrativedepa

11、rtmentoftheStateCouncilshallbeinchargeofthemanagementoflabourofthewholecountry.Thelabouradministrativedepartmentsofthelocalpeoplesgovernmentsatorabovethecountylevelshallbeinchargeofthemanagementoflabourintheadministrativeareasundertheirrespectivejurisdiction.CHAPTER II. PROMOTIONOFEMPLOYMENTSection

TheStateshallcreateconditionsforemploymentandincreaseopportunitiesforemploymentbymeansofthepromotionofeconomicandsocialdevelopment.TheStateshallencourageenterprises,institutionalorganizations,andsocietiestoinitiateindustriesore_pandbusinessesfortheincreaseofemploymentwithinthescopeofthestipulati

13、onoflaws,andadministrativerulesandregulations.TheStateshallsupportlabourerstogetjobsbyorganizingthemselvesonavoluntarybasisorbyengaginginindividualbusinesses.Section 11. Localpeoplesgovernmentsinvariouslevelsshalltakemeasurestodevelopvariouskindsofjob-introductionagenciesandprovideemploymentservices

14、.Section 12. Labourersshallnotbediscriminatedagainstinemployment,regardlessoftheirethniccommunity,race,se_,orreligiousbelief.Section 13. Femalesshallenjoyequalrightsasmalesinemployment.Itshallnotbeallowed,intherecruitmentofstaffandworkers,tousese_asaprote_tfore_cludingfemalesfromemploymentortoraiser

15、ecruitmentstandardsforthefemales,e_ceptforthetypesofworkorpoststhatarenotsuitableforfemalesasstipulatedbytheState.Section 14. Wheretherearespecialstipulationsinlaws,rulesandregulationsontheemploymentofthedisabled,thepersonnelofnationalminorities,anddemobilizedarmymen,suchspecialstipulationsshallappl

16、y.Section 15. Noemployingunitsshallbeallowedtorecruitjuvenilesundertheageof16.Unitsofliteratureandart,physicalcultureandsport,andspecialartsandcraftsthatneedtorecruitjuvenilesundertheageof16mustgothroughtheformalitiesofe_aminationandapprovalaccordingtotherelevantprovisionsoftheStateandguaranteetheir

17、righttocompulsoryeducation.CHAPTER III. EMPLOYMENTCONTRACTSANDCOLLECTIVEAGREEMENTSSection 16. Alabourcontractistheagreementreachedbetweenalabourerandanemployingunitfortheestablishmentofthelabourrelationshipandthedefinitionoftherights,interestsandobligationsofeachparty.Alabourcontractshallbeconcluded

18、wherealabourrelationshipistobeestablished.Section 17. Conclusionandmodificationofalabourcontractshallfollowtheprinciplesofequality,voluntarinessandunanimitythroughconsultation,andshallnotruncountertothestipulationsoflaws,administrativerulesandregulations.Alabourcontractonceconcludedinaccordancewitht

19、helawshallpossesslegalbindingforce.Thepartiesinvolvedmustfulfiltheobligationsstipulatedinthelabourcontract.Section 18. Thefollowinglabourcontractsshallbeinvalid:(1) labourcontractsconcludedinviolationoflaws,administrativerulesandregulations;and(2) labourcontractsconcludedbyresortingtosuchmeasuresasc

20、heatingandintimidation.Aninvalidlabourcontractshallhavenolegalbindingforcefromtheverybeginningofitsconclusion.Whereapartofalabourcontractisconfirmedasinvalidandwherethevalidityoftheremainingpartisnotaffected,theremainingparthallremainvalid.Theinvalidityofalabourcontractshallbeconfirmedbyalabourdispu

21、tearbitrationcommitteeorapeoplescourt.Section 19. Alabourcontractshallbeconcludedinwrittenformandcontainthefollowingclauses:(1) termoflabourcontract;(2) contractsofwork;(3) labourprotectionandworkingconditions;(4) labourremuneration;(5) labourdisciplines;(6) conditionsfortheterminationofalabourcontr

22、act;and(7) responsibilityfortheviolationofalabourcontract.Apartfromtherequiredclausesspecifiedintheprecedingparagraph,othercontentsinalabourcontractmaybeagreeduponthroughconsultationbythepartiesinvolved.Section 20. Thetermofalabourcontractshallbedividedintofi_edterm,fle_ibletermortakingthecompletion

23、ofaspecificamountofworkasaterm.Incasealabourerhaskeptworkinginasameemployingunitfortenyearsormoreandthepartiesinvolvedagreetoe_tendthetermofthelabourcontract,alabourcontractwithafle_ibletermshallbeconcludedbetweenthemifthelabourersorequested.Section 21. Aprobationperiodmaybeagreeduponinalabourcontra

24、ct.Thelongestprobationperiodshallnote_ceedsi_months.Section 22. Thepartiesinvolvedinalabourcontractmayreachanagreementintheirlabourcontractonmattersconcerningkeepingthecommercialsecretsoftheemployingunit.Section 23. Alabourcontractshallterminateuponthee_pirationofitstermortheemergenceoftheconditions

25、fortheterminationofthelabourcontractasagreeduponbythepartiesinvolved.Section 24. Alabourcontractmayberevokeduponagreementreachedbetweenthepartiesinvolvedthroughconsultation.Section 25. Theemployingunitmayrevokethelabourcontractwithalabourerinanyofthefollowingcircumstances:(1) tobeprovednotuptothereq

26、uirementsforrecruitmentduringtheprobationperiod;(2) toseriouslyviolatelabourdisciplinesortherulesandregulationsoftheemployingunit;(3) tocausegreatlossestotheemployingunitduetoseriousderelictionofdutyorengagementinmalpracticeforselfishends;and(4) tobeinvestigatedforcriminalresponsibilitiesinaccordanc

27、ewiththelaw.Section 26. Inanyofthefollowingcircumstances,theemployingunitmayrevokealabourcontractbutawrittennotificationshallbegiventothelabourer30daysinadvance;(1) wherealabourerisunabletotakeuphisoriginalworkoranynewworkarrangedbytheemployingunitafterthecompletionofhismedicaltreatmentforillnessori

28、njurynotsufferedatwork;(2) whenalabourerisunqualifiedforhisworkandremainsunqualifiedevenafterreceivingatrainingoranadjustmenttoanyotherworkpost;and(3) noagreementonmodificationofthelabourcontractcanbereachedthroughconsultationbythepartiesinvolvedwhentheobjectiveconditionstakenasthebasisfortheconclus

29、ionofthecontracthavegreatlychangedsothattheoriginallabourcontractcannolongerbecarriedout.Section 27. Duringtheperiodofstatutoryconsolidationwhentheemployingunitcomestothebrinkofbankruptcyorrunsintodifficultiesinproductionandmanagement,andifreductionofitspersonnelbecomesreallynecessary,theunitmaymake

30、suchreductionafterithase_plainedthesituationtothetradeunionorallofitsstaffandworkers30daysinadvance,solicitedopinionsfromthemandreportedtothelabouradministrativedepartment.Wheretheemployingunitistorecruitpersonnelsi_monthsafterthepersonnelreductioneffectedaccordingtothestipulationsofthissection,ther

31、educedpersonnelshallhavetheprioritytobere-employed.Section 28. TheemployingunitshallmakeeconomiccompensationsinaccordancewiththerelevantprovisionsoftheStateifitrevokesitslabourcontractsaccordingtothestipulationsinsection24,section26andsection27ofthisLaw.Section 29. Theemployingunitshallnotrevokeitsl

32、abourcontractwithalabourerinaccordancewiththestipulationsinsection26andsection27ofthisLawinanyofthefollowingcircumstances:(1) tobeconfirmedtohavetotallyorpartiallylosttheabilitytoworkduetooccupationaldiseasesorinjuriessufferedatwork;(2) tobereceivingmedicaltreatmentfordiseasesorinjurieswithinthepres

33、cribedperiodoftime;(3) tobeafemalestaffmemberorworkerduringpregnant,puerperal,orbreast-feedingperiod;or(4) othercircumstancesstipulatedbylaws,administrativerulesandregulations.Section 30. Thetradeunionofanemployingunitshallhavetherighttoairitsopinionsifitregardsasinappropriatetherevocationofalabourc

34、ontractbytheunit.Iftheemployingunitviolateslaws,rulesandregulationsorlabourcontracts,thetradeunionshallhavetherighttorequestforreconsideration.Wherethelabourerappliesforarbitrationorbringsinalawsuit,thetradeunionshallrenderhimsupportandassistanceinaccordancewiththelaw.Section 31. Alabourerwhointends

35、torevokehislabourcontractshallgiveawrittennoticetotheemployingunit30daysinadvance.Section 32. Alabourermaynotifyatanytimetheemployingunitofhisdecisiontorevokethelabourcontractinanyofthefollowingcircumstances:(1) withintheprobationperiod;(2) wheretheemployingunitforcesthelabourertoworkbyresortingtovi

36、olence,intimidationorillegalrestrictionofpersonalfreedom;or(3) failureonthepartoftheemployingunittopaylabourremunerationortoprovideworkingconditionsasagreeduponinthelabourcontract.Section 33. Thestaffandworkersofanenterpriseasonepartymayconcludeacollectivecontractwiththeenterpriseonmattersrelatingto

37、labourremuneration,workinghours,restandvacations,occupationalsafetyandhealth,andinsuranceandwelfare.Thedraftcollectivecontractshallbesubmittedtothecongressofthestaffandworkersortoallthestaffandworkersfordiscussionandadoption.Acollectivecontractshallbeconcludedbythetradeuniononbehalfofthestaffandwork

38、erswiththeenterprise;inenterprisewherethetradeunionhasnotyetbeensetup,suchcontractshallbealsoconcludedbytherepresentativeselectedbythestaffandworkerswiththeenterprise.Section 34. Acollectivecontractshallbesubmittedtothelabouradministrativedepartmentafteritsconclusion.Thecollectivecontractshallgointo

39、effectautomaticallyifnoobjectionsareraisedbythelabouradministrativedepartmentwithin15daysfromthedateofthereceiptofacopyofthecontract.Section 35. Collectivecontractsconcludedinaccordancewiththelawshallhavebindingforcetoboththeenterpriseandallofitsstaffandworkers.Thestandardsonworkingconditionsandlabo

40、urpaymentsagreeduponinlabourcontractsconcludedbetweenindividuallabourersandtheenterpriseshallnotbelowerthanthoseasstipulatedincollectivecontracts.CHAPTERIV.WORKINGHOURS,RESTANDVACATIONSSection 36. TheStateshallpracticeaworkinghoursystemunderwhichlabourersshallworkfornomorethaneighthoursadayandormore

41、than44hoursaweekonaverage.Section 37. Incaseoflabourersworkingonthebasisofpiecework,theemployingunitshallrationallyfi_quotasofworkandstandardsonpieceworkremunerationinaccordancewiththeworkinghoursystemstipulatedinsection36ofthisLaw.Section 38. Theemployingunitshallguaranteethatitsstaffandworkershave

42、atleastonedayoffinaweek.Section 39. Whereanenterprisecannotfollowthestipulationsinsection36andsection38ofthisLawduetoitsspecialproductionnature,itmayadoptotherrulesonworkinghoursandrestwiththeapprovalofthelabouradministrativedepartment.Section 40. Theemployingunitshallarrangeholidaysforlabourersinac

43、cordancewiththelawduringthefollowingfestivals:(1) theNewYearsDay;(2) theSpringFestival;(3) theInternationalLabourDay;(4) theNationalDay;and(5) otherholidaysstipulatedbylawsandregulations.Section 41. Theemployingunitmaye_tendworkinghoursduetotherequirementsofitsproductionorbusinessafterconsultationwiththetradeunionandlabourers,butthee_tendedworkinghourforadayshallgenerallynote_ceedonehour;ifsuche_tensioniscalledforduetospecialreasons,thee_tendedhoursshallnote_ceedthreehoursadayunderthecondit
