餐饮策划设计代理协议

餐饮策划设计代理协议甲方（餐饮策划方）：________PartyA(FoodandBeveragePlanningParty):________乙方（餐饮设计方）：________PartyB(FoodandBeverageDesignParty):________丙方（餐饮业主）：________PartyC(FoodandBeverageOwner):________鉴于甲方具备餐饮策划能力，乙方具备餐饮设计能力，丙方需要进行餐饮项目的策划与设计，现甲方与乙方同意为丙方提供餐饮策划与设计服务，丙方同意接受甲乙方的服务，三方根据《中华人民共和国合同法》及相关法律法规的规定，经平等、自愿、诚实信用的原则，签订本餐饮策划设计代理协议。InviewofthefactthatPartyAhastheabilitytoplanfoodandbeverageservices,PartyBhastheabilitytodesignfoodandbeverageservices,andPartyCneedstoplananddesignafoodandbeverageproject,PartyAandPartyBagreetoprovidefoodandbeverageplanninganddesignservicesforPartyC,andPartyCagreestoaccepttheservicesprovidedbyPartyAandPartyB.ThethreepartieshaveenteredintothisFoodandBeveragePlanningandDesignAgencyAgreementinaccordancewiththerelevantlawsandregulationsofthePeople'sRepublicofChina,basedontheprinciplesofequality,voluntariness,andgoodfaith.一、服务内容I.ServiceContent1.1甲方负责为丙方提供餐饮项目的策划服务，包括但不限于市场调研、品牌定位、营销策略等。1.1PartyAshallprovidefoodandbeverageprojectplanningservicesforPartyC,includingbutnotlimitedtomarketresearch,brandpositioning,marketingstrategies,etc.1.2乙方负责为丙方提供餐饮项目的设计服务，包括但不限于室内设计、菜单设计、装修风格等。1.2PartyBshallprovidefoodandbeverageprojectdesignservicesforPartyC,includingbutnotlimitedtointeriordesign,menudesign,decorationstyle,etc.二、服务期限II.ServiceDuration2.1本协议的有效期为____年，自____年__月__日起至____年__月__日止。2.1Thevalidityofthisagreementis____years,from____yearto____year.三、服务费用III.ServiceFees3.1甲方应根据其提供的餐饮策划服务收取策划费用，费用为人民币________元。3.1PartyAshallchargeplanningfeesforthefoodandbeverageplanningservicesprovided,withafeeofRMB________yuan.3.2乙方应根据其提供的餐饮设计服务收取设计费用，费用为人民币________元。3.2PartyBshallchargedesignfeesforthefoodandbeveragedesignservicesprovided,withafeeofRMB________yuan.四、服务成果IV.ServiceResults4.1甲方应提供完整的餐饮策划方案，包括策划报告、策划图等。4.1PartyAshallprovideacompletefoodandbeverageplanningscheme,includingplanningreports,planningdiagrams,etc.4.2乙方应提供完整的餐饮设计方案，包括设计图纸、效果图等。4.2PartyBshallprovideacompletefoodandbeveragedesignscheme,includingdesigndrawings,renderings,etc.五、保密条款V.ConfidentialityClause5.1甲乙双方应对丙方提供的商业秘密和客户信息进行保密，未经丙方同意，不得向第三方泄露。5.1PartyAandPartyBshallkeepthebusinesssecretsandcustomerinformationprovidedbyPartyCconfidential,andshallnotdisclosethemtoanythirdpartywithouttheconsentofPartyC.六、违约责任VI.LiabilityforBreachofContract6.1任何一方违反本协议的任何条款，应向守约方支付违约金，违约金为合同总金额的____%。6.1Anypartythatbreachesanytermofthisagreementshallpayaliquidateddamageequalto____%ofthetotalcontractamounttothenon-breachingparty.七、争议解决VII.DisputeResolution7.1本协议的签订、履行、解释及争议解决均适用中华人民共和国法律。7.1Theconclusion,performance,interpretation,anddisputeresolutionofthisagreementshallbegovernedbythelawsofthePeople'sRepublicofChina.八、其他约定VIII.MiscellaneousProvisions8.1本协议一式三份，甲乙丙三方各执一份。8.1Thisagreementshallbeexecutedinthreecopies,withonecopyheldbyeachPartyA,PartyB,andPartyC.8.2本协议自甲乙丙三方签字（或盖章）之日起生效。8.2Thisagreementshallbecomeeffectiveuponthesigning(orsealing)byPartyA,PartyB,andParty
