.PartyBagreestoacceptthearrangement,observethelabordisciplineandprofessionalethics,carryoutrulesofsafeoperation,improveprofessionalskillsandaccomplishesproductiontasks.1.2 PartyAmaylegitimatelyadjustPartyBspostaccordingtobusinessrequirements.ArticleTwoTermofContractThiscontractwillbeeffectfrom(date,month,year)to(date,month,year),duringwhichtheprobationperiodismonths(from(date,month,year)to(date,month,year).Thecontractwillbeterminatedwhenthecontractisatitsexpiryoragreedterminationconditionsoccurs.Bothpartiesmayrescindorrenewthecontractviamutualconsultation.ArticleThreeWorkingHours3.1PartyAcarriesoutstandardworkinghourssystemof40hoursperweekandtworestdays(maybetheyarenotSaturday, Sunday).3.2PartyAmaylegitimatearrangePartyBtoworkovertimeorworkongeneralholidaysduetobusinessrequirementsonconditionthatPartyBiswillingtodoso.3.3PartyAmaychangeworkinghourssystemforbusinessrequirementafterapprovalbyrelevantgovernmentauthoritiesandPartyBshallexecuteitofhisownwill.ArticleFourRemuneration4.1PartyApaysRMB toPartyBasbasicwagepermonth.TheaforesaidremunerationexcludesallsubsidiespaidtoPartyBpursuanttoPartyAsstipulation.4.2PartyAshallstrictlyimplementrelevantregulationsandstandardperthelowestwage.4.3PartyAshallpaythewageonthe dayeverymonth.ArticleFiveLaborProtectionandLaborConditionsPartyAshallgivePartyBeducationandtrainingprogramsrelatingtolaborsafety,professionalskillsandlabordisciplinesetc.Accordingtotherequirementsofstatelaborprotectionandsafe-production,PartyAshallprovidenecessaryworkingconditiontoensurePartyBssafetyandhealth.ArticleSixSocialInsuranceandWelfare6.1PartyAshalltransactsocialinsuranceandpaythemforPartyB.PartyAshallwithholdthesocialsecuritycontributionlegallyundertookbyPartyBwhenpayingtheremunerationeverymonth.6.2PartyBwilltakeallstatutoryholidaysstipulatedbytheState.6.3PartyAcarriesoutannualvocationsystem,PartyBcantakepaidannualvocationaftercontinuouslyworkingfor1yearandtheapplyingprocedureforannualvocationshallbedonepursuanttoPartyAsstipulation.ArticleSevenPartyBsResponsibility7.1PartyBmustworkearnestlyandaccomplishitsowntaskswithqualityandquantity.7.2PartyBmustreportitsjobaccordingtothefactsandshallcooperatewithitsuppersandassisttheirjobs.7.3PartyBshallstrictlyimplementtherulesandregulationsandHandbooklegallystipulatedbyPartyA.7.4PartyBshalltakegoodcareofPartyAspropertyandhe/shemustindemnifydirectdamageduetohis/herliabilityandacceptsPartyAspunishment.7.5PartyBcannotworkforanotheremployerwithoutPartyAswrittenconsentinthedurationofLaborContract.7.6PartyBshallstrictlykeepPartyAstradesecretandcannotdivulgetoanythirdparty7.7PartyBshallstatehis/hercurriculumvitaeandeducationalbackgroundaccordingtothefacts.7.8PartyBshallobservePartyAstrainingrulesandundertakingwhenPartyAassignsPartyBtobetrained.ArticleEightCancellationoftheContractwithoutCompensationbyPartyAPartyAmaycanceltheContractatanytimewithoutcompensationtoPartyBunderthefollowingcircumstances:8.1WhenPartyBisproventobeunqualifiedforPartyAsemploymentconditionsduringprobationperiod,PartyAneednotgivePartyBthereasonforcancellation.8.2PartyBseriouslyviolatesrulesandregulations,labordisciplinelegallystipulatedbyPartyA.8.3 PartyBseriouslyneglectshis/herdutyandgraftsresultinginPartyAsgreatloss.8.4PartyBviolatesthelawsofPRCandgainsjudicialpunishmentorisfoundaguilty.ArticleNineCancellationoftheContractwithCompensationbyPartyAUnderthefollowingcircumstances,PartyAmaycanceltheContractwith30dayspriorwrittennoticetoPartyBorpayingonemonthbasicwageinsteadandlegallypayeconomiccompensationorsubsidytoPartyB.9.1PartyBisillornon-work-relatedinjured,andunabletodotheformerjoborotherjobassignedbyPartyAaftermedicaltreatment.9.2PartyBisnotcompetentforthejobandstillremainssoaftertrainingoradjustmentofthepost.9.3Thebasisfortheconclusionofthecontracthasgreatlychangedsothatthecontractcannolongerbecarriedout,whilebothpartiescannotreachanagreementonmodifyingthecontractbymutualnegotiation.9.4PartyAisclosetobankruptcyandentersintolegalrectificationperiodoritisinaseveredifficultytomeetthestandardofseveredifficultenterprisestipulatedbythelocalgovernmentandtheretrenchmentisneeded,andthenPartyAcancelsthecontractaccordingtolegalprocedure.ArticleTenCancellationoftheContractatPartyBsrequest10.1PartyBshallgive30dayspriorwrittennoticetoPartyAwhenrequestingtocanceltheContract,buthe/sheshallindemnifyPartyAaccordingtoArticle11.2.10.2Underthefollowingcircumstances,PartyBmayinformPartyAtoterminatetheContractatanytime.a.Beinprobationperiod.PartyAdidntpaytheremunerationorprovideworkingconditionsaccordingtotheContact.c.PartyAforcesPartyBtoworkbymeansofforce,threatorillegalrestrictionofpersonalfreedom.ArticleElevenLiabilityforBreachofContract11.1PartyAshalllegallypayeconomiccompensationtoPartyBwhencancelingtheContractpursuanttoArticleNine.11.2PartyBshallindemnifyPartyAforitseconomiclossaccordingtolawsandregulationsandTrainingAgreementwhenhe/shebreachestheContract.ArticleTwelveAnnexesoftheContract12.1TheAnnexesareindivisiblepartsofthiscontractandtheyhavethesameeffectasthiscontract.12.2 HandbookandotherrulesandregulationslegallystipulatedbyPartyAareannexesofthisContract.ArticleThirteenLaborDisputeIflabordisputeoccurs,bothpartiesshallresolveitthroughconsultation.Incaseoffailingtoreachanagreement,eachpartymaysubmitthedisputetoLaborDisputeArbitrationCommitteehavingjurisdiction.Ifrejectingtheaward,eachpartycantakeaproceeding.ThepartyapplyingforarbitrationshallsubmitthearbitrationapplicationtoLaborDisputeArbitrationCommitteewithin60dayswhenthelabordisputearises.Ifrejectingtheaward,thepartycansuetothecourtwithin15daysafterreceiptoftheaward.ArticleFourteenEffectivenessoftheContractThiscontractiseffectivebysignaturesofbothpartiesandshallbesubmittedtothesurveyor.ArticleFifteenMiscellaneous15.1Ifthereissomethingunclear,bothpartiesmayconcludeclausea supplement clauseandtheclauseshallhavethe same effect
