I.PartyAwishestoengagetheserviceofPartyBas__________.Thetwoparties,inaspiritoffriendlycooperation,agreetosignthiscontractandpledgetofulfillconscientiouslyalltheobligationsstipulatedinit.

V.PartyA’sObligations
1.PartyAshallintroducePartyBthelaws,decreesandrelevantregulationsenactedbytheChinesegovernment,thePartyA’sworksystemandregulationsconcerningadministrationofforeignexperts.
2.PartyAshallconductdirection,supervisionandevaluationofconditions.
3.PartyAshallprovidePartyBnecessaryworkingandlivingconditions.
4.PartyAshallprovideco-workers.
5.PartyAshallpayPartyB’ssalaryregularlybythemonth.
VI.PartyB’sObligations
1.PartyBshallobservethelaws,decreesandrelevantregulationsenactedbytheChinesegovernmentandshallnotinterfereinChina’sinternalaffairs.
2.PartyBshallobservePartyA’sworksystemandregulationsconcerningadministrationofforeignexpertsandshallacceptPartyA’sarrangement,direction,supervisionandevaluationinregardtohis/herwork.WithoutPartyA’sconsent,PartyBshallnotrenderserviceelsewhereorholdconcurrentlyanypostunrelatedtotheworkagreedonwithPartyA.
3.PartyBshallcompletethetasksagreedonscheduleandguaranteethequalityofwork.
4.PartyBshallrespectChina’sreligiouspolicy,andshallnotconductreligiouspropagandaorotheractivitiesincompatiblewiththestatusofanexpert.
5.PartyBshallrespecttheChinesepeople’smoralstandardsandcustoms.
VII.Revision,CancellationandTerminationoftheContract
Bothpartiesshouldabidebythecontractandshouldrefrainfromrevising,canceling,orterminatingthecontractwithoutmutualconsent.Thecontractcanberevised,canceled,orterminatedwithmutualconsent.Beforebothpartieshavereachedanagreement,thecontractshouldbestrictlyobserved.
1.Underthefollowingcircumstances,PartyAmayterminatethisContractbygiving30dayspriorwrittennoticetoPartyB:
1.1.wherePartyBisincompetenttoperformhis/herdutyandremainstobeincompetentdespitetrainingortransfertoadifferentpositionorrefusestobegivenfurthertrainingortobetransferedtoadifferentposition.
1.2.wherePartyBcannotresumenormalworkafteracontinued30-daysickleave,accordingtothedoctor’sdiagnosis.
2.PartyAmayterminatethisContractatanytimewithoutgivingpriornoticeorpayingseverancepaytoPartyB,if:
2.1.PartyBhasbeenprovenunabletomeettheemploymentrequirementsofPartyAduringtheprobationperiod,ifany;
2.2.PartyBcausesPartyAtoenterintooramendthisContractagainstPartyA'struewillbymeansoffraud,intimidationortakingadvantageofPartyA'sprecariousposition;
2.3.PartyBhaveanyillhabitssuchasgamblingoralcoholicaddiction,orhisbehaviorisnotuptoChinesemorality,whichhasresultedinadverseeffects,andfailtoamendafterPartyA’swarning;
2.4.PartyBhasseriousdisciplinebreachbehaviorsorinvolvementincriminalactivities.
3.PartyAmayterminatethisContractbygiving30dayspriorwrittennoticetoPartyBandgivingPartyB1-3months’salaryasacompensation.
4.PartyBmayterminatethisContractbygiving3dayspriorwrittennoticetoPartyAwithinprobationperiod,andmayterminatethisContractbygiving30dayswrittennoticetoPartyAaftertheprobationperiod.
5.PartyBmaycancelthisContractimmediatelyif:
5.1.PartyAhasnotprovidedPartyBwithnecessaryworkingandlivingconditionsasstipulatedinthecontract;
5.2.PartyAisprovedtohavefailedtopaytheremunerationdulyandinfullasstipulatedinthisContract;
5.3.therulesandregulationsofPartyAviolatethePRClawsandregulationsandimpairtherightsandinterestsofPartyB;
5.4.PartyAcausesPartyBtoenterintooramendthisContractagainstPartyB's
regulationsofthetaxationadministrationofChina.PartyB’ssalarycanbeexchangedintoforeigncurrencywithhis/herForeignExpertCertificateandincometaxpaymentcertificate.
III.AccommodationandTransportation
1.PartyAprovidesPartyBwithafreeapartmentoncampus,whichcontainsabedroom,akitchen,abathroomwithnecessaryequivalents:abed,telephone,wardrobe,televisionset,microwaveoven,washingmachine.PartyAwillpayPartyBRMBcovertheexpensesincurredfromphonecall,gasandelectricity.TheexcesspartshallbebornebyPartyB.IfPartyAcanonlyofferafreeapartmentoff-campus,PartyAwillprovideschoolbusorsubsidizePartyBRMBeachmonthastransportationallowance.
2.IfPartyAcannotprovidePartyBwithanapartment,PartyAmustassistPartyBinlocatinganaccommodationandwillsubsidizePartyBRMBpermonthasanaccommodationandtransportationallowance.PartyBisobligatedforallaccommodationexpenses.
IV.Healthcareandaccidentalinsurance
1.PartyAwillpayPartyBRMB_____tobuyinsurancewhichcovershis/herexpenditureformajordiseases,hospitalizationandpersonalaccidentswhilehe/sheworksforPartyA.PartyAwillassistPartyBinselectingsuitableinsurancepackages.
2.IfPartyBfailstobuyaninsuranceinChinaforhisownreasons,PartyAwillprovidePartyBRMB_____tobuyaninternationalinsurance,whichcoversmajordiseases,in-patienttreatmentexpensesandaccidentswithindurationofhis/herserviceforPartyA.
V.WorkHoursandHolidays
1.TheworkhoursofPartyBshouldbe8hoursaday,5daysaweek.
2.IfPartyArequestsovertimework,PartyBwillreceiveovertimepayinaccordancewithChineseLaborActs.
3.PartyBshallbeentitledtopaidleaveonallPRCstatutorypublicholidays.
4.PartyBshallbeentitledanannualleavewithpayof_____workingdaysforthefirstyearofemployment,_____workingdaysforthesecondyearofemploymentand_____dayseveryyearthereafter.TheannualpaidleaveofPartyBfortheyearinwhichhe/shejoinsinordepartsfromPartyAshallbepro-rated.
VI.TravelExpensesandVacationsallowance
1.IfPartyBfulfillsallobligationsofa1-year-contract,areturnairticketallowanceofRMB_____willbepaidbyPartyAattheendofthecontractperiod.Ifthecontractperiodislessthan1year,theairticketallowancewillbeproratedbasedonthetimehe/sheservesforPartyA.
2.PartyB,whofailstocompletethecontractforhis/herpersonalreasons,willforfeittherighttotheabovestatedpaidleaveairticketallowanceafterthelastdayofduty.
3.LuggagetransportationexpenseswillbepaidtoPartyBupto1/5oftheinternationalairticketpriceinRMB.SinceairlinesbetweenChinaandUnitedStatesofAmericastipulatethatcarriageoftwolargepiecesofluggageuptoamaximum64kgisfreeofcharge,foremployedpartyfromtheUnitedStatesPartyAmaynotbearhis/herluggagetransportationexpenses.
4.AllthefeesincurredfromhealthexamandvisaapplicationarebornebyPartyA.
VII.SickLeave
1.Forsickleavemorethanoneday,amedicalcertificatesignedbyadoctorfromtheappointedhospitalisnecessary.AllsickleavesmustbeapprovedfromtheDirectorortheHeadTeacher.Forsickleaveof(7)daysorless,PartyAwillpayasusual.After(7)days,PartyAwillpayPartyB70%oftheregularsalary.Themaximumallowablesickleaveis(30)days.After(30)days,PartyAwillstopthesalarypaymentandhastherighttoterminatethecontract.
2.AllleavesmustbeapprovedfromtheDirectororhisDeputy.IfPartyBisapprovedofaleaveforpersonalreasons,he/shewillnotbepaidduringtheabsenceperiod.Inoneschoolyear,PartyBshallnotaskforleavesofabsenceforaccumulativelymorethan(10)days,andshallnotaskforaleaveofabsenceforcontinuouslymorethan(3)days.
3.Uponproductionofanappropriatemedicalcertificate,afemaleemployedPartywillbegrantedmaternityleaveonfullpayfor90days.AnyextensionofmaternityleavewillbedeterminedinaccordancewithPRClawsandmaybegrantedonaleavewithoutpaybasis.Paternityleaveonfullpaywillbegrantedforupto3days.
4.(3)days’salarywillbedeductedforeachonedayabsentwithoutapprovalbeforehand.Over10daysleavewithoutapprovalaheadoftimeisdeemedasviolationofthecontract.PartyAreservestherighttoterminatethecontractandaskforpenaltyfromPartyB.
5.Latenessforclassandendofclassaheadofscheduleshallresultina1-daypaydeductionfromPartyB’ssalaryfor2occurrences.Upto5occurrenceswillresultinnotonlyacertainamountofsalarydeductionbutalsoaterminationofthecontractbyPartyA.
VIII.ProbationPeriodandCreditBail
1.PartyAwillsetaprobationperiodof(1)monthsforPartyBuponthesignatureofthecontract.DuringwhichtimePartyBwillreceivearegularsalaryassetinthecontract.Duringtheprobationperiod,PartyAhastherighttoterminatethecontractwithPartyBifPartyAfindsoutPartyBi
